HomeMy WebLinkAboutR-2005-088 84 Commerce Center (site plan) RESOLUTION NO. 2005-088 A RESOLUTION OF THE CITY OF DANIA BEACH, FLORIDA, APPROVING THE SITE PLAN REQUEST SUBMITTED BY JODY OBERHOLTZER, REPRESENTING 84 COMMERCE CENTER,INC.,FOR PROPERTY LOCATED AT THE SOUTHWEST CORNER OF SW 23RD TERRACE AND STATE ROAD 84,DANIA BEACH; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. WHEREAS,Section 8.4 of Article 1 of Chapter 8 of the Code of Ordinances of the City of Dania Beach, Florida, states that a site plan is required as a condition to the issuance of a building permit; and WHEREAS,Jody Oberholtzer,representing 84 Commerce Center,Inc.,has applied for site plan approval for the proposed construction of a 15,000 square foot office/warehouse in an IROM (Industrial Research Office Marine)zoning district,to be located at the southwest corner of SW 23rd Terrace and State Road 84, Dania Beach; and WHEREAS,the Planning & Zoning Board on April 20, 2005, recommended that the City Commission grant the site plan request(SP-63-04),based upon the criteria set forth in Section 8.4 of Article 1 of Chapter 8 of the Code of Ordinances of the City of Dania Beach; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA: Section 1. That that certain application(SP-63-04)for site plan approval,a copy of which is attached and made a part of this Resolution as Exhibit"A" is approved. It is further noted that the original Site Plan is maintained in the office of the Community Development Department of the City of Dania Beach. Section 2. That based upon the criteria set forth in Section 8-4(p) of Article 1 of Chapter 8, aof the Code of Ordinances of the City of Dania Beach, all site plan approvals shall automatically ® expire and become null and void unless building permits are obtained on or before 18 months from the date of this Resolution. Section 3. That all resolutions or parts of resolutions in conflict with this Resolution are repealed to the extent of such conflict. Section 4. VARIANCE i I 0 To provide an 8' setback (south); required. WAIVER 1. To provide a 10' street side setback (north); 30' required. 2. To provide an 11' rear set back (west); 20' required. 3. PROPERTY INFORMATION: ZONING: IROM FUTURE LAND USE: Industrial EXISTING USE: Vacant PROPOSED USE: Office/Warehouse The applicant is proposing an office/warehouse project on the south west corner of State Road 84 and SW 23 Terrace. The City Commission conditionally approved this site plan and variance on July 9, 2002 (Reso. No. 2002-102), however that approval has since expired. VARIANCE l ® To provide an 8' setback (south); ,!` required. A small portion of the building is setback 8' from the south lot line. This requires a variance because it is less than the minimum 10' by code. The building placement is the same as the original site plan approved in 2002. WAIVER 1. To provide a 10' street setback (north); 30' required. 2. To provide an 11' setback (west); 20' required. The IROM zoning requires a 30' street yard setback along State Road 84 and SW 23 Terrace and a 20' west setback. However the code allows the City Commission to reduce these setbacks to 10' without a variance. The building placement is the same as the original site plan approved in 2002. 3. To provide 25.9% pervious area; 30% is required. Waiver of this requirement was conditionally approved by the City Commission in 2002 if the applicant provided additional storm water capacity to compensate for the 5% decrease in pervious area, said improvements to be in the form of a french drain or other on site storm water measure to be determined by the Public Work/Utilities Director. The original site plan was approved with 25% pervious area, the applicant is now proposing to provide 25.9% pervious area. While grading on the proposed swale centerline and a section (Section A-A on Sheet C 1 of 6) were provided, the plan fails to show and/or demonstrate how impounded water coming from both the sidewalk and the existing pavement (on SW 23rd Terrace and SR 84) to the proposed swale will be positively discharged. Based on the grading plan, the surface run-off to the swale is expected to be very significant so much so that the provision of a sodded swale alone may not suffice to meet adequate drainage. Please provide us your calculations to demonstrate drainage adequacy. Please let me know if you have any comments or questions. I would like to voice a concern I have, which you may or may not believe to be valid, which is the traffic pulling out onto State Road 84 east bound or turning onto 23`d Terrace. I am the owner of the boat service center next to this lot. We frequently have customers pulling out with 18 to 35 foot boats who could get hit by oncoming traffic because they can not see far enough around the proposed building. If the ten foot set back is approved, this may not allow the drivers pulling out to easily view the oncoming traffic,nor allow oncoming cars ample time to slow down if they notice these vehicles pulling out. Traffic taround that stretch can be heavy at times and there are constant speeding cars. My concern is that someone is going to get involved in an accident and end up in the boat yard or worse yet, killed. The full 30 foot set back may be too much and I understand that the developer is trying to make use of all possible space, but ten feet does seem to be a little close. I write this only as a concern and hope you have taken this into consideration in your decision to approve or deny the waiver. Sincerely, Bradley . Criteria Statements: ® Variance # 1: Setback requirements — 30 ft. along StateRoad 84—we have only provided 10 ft. I Variance #2: Side and Rear setback requirements — 20 ft. — we have only provided 8 ft. and 11 ft. respectively The reason we require these variances is because the property is under 1 acre and if we provided all of the required setbacks the property would not be economically viable for building and ,,would possibly remain undeveloped. Variance # 3: 30% Landscaping — The above variances have impacted our ability to provide the required 30%.
