HomeMy WebLinkAboutR-2005-099 Flair for Hair Sign Variance RESOLUTION NO. 2005-099 A RESOLUTION OF THE CITY OF DANIA BEACH, APPROVING THE VARIANCE REQUEST BY LEONID SHUTOV, OWNER OF GOLDEN KEY PLAZA, INC., FROM CHAPTER 28, "ZONING", ARTICLE 28, "SIGNS", FOR PROPERTY GENERALLY LOCATED AT 801-833 SOUTH FEDERAL HIGHWAY, DANIA BEACH; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the Dania Beach Code of Ordinances, Chapter 28, "Zoning", Article 28, "Signs", sets the signage regulations businesses within the City of Dania Beach; and WHEREAS,Leonid Shutov,owner of Golden Key Plaza,Inc.,has applied for variance(VA- 32-05) from Chapter 28, Zoning Article 28.110 to allow: I) A 78 square foot; 15 foot tall monument sign; and 2) Monument sign to be setback 12" - 18" from the US 1 property line for property located at 801-833 South Federal Highway, Dania Beach; and WHEREAS,the Planning&Zoning Board on June 15,2005,recommended approval of the variance request, subject to submission of professionally drawn sign plans, based upon the criteria set forth in Chapter 28,"Zoning",Article 28,"Signs", Section 28.095 of the Code of Ordinances of the City of Dania Beach; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA: Section 1. That that certain application VA-32-05, from requirements in Chapter 28, "Zoning", Article 28, "Signs", is approved with the following conditions: (1) The base of the sign and the exterior elements be painted and stucco to match the building. (2) A black background with white cut-out letters. (3) A survey of the property in order for staff to determine the location of the sign. Section 2. That all resolutions or parts of resolutions in conflict with this Resolution are repealed to the extent of such conflict. Section 3. That this Resolution shall be in force and take effect immediately upon its passage and adoption. PASSED and ADOPTED on July 26, 2005. Leeds, AICP, Director Date June 29, 2005 Community Development Department City Manager Date CITY OF DANIA BEACH COMMUNITY DEVELOPMENT DEPARTMENT STAFF REPORT • DATE: July 26, 2005 TO: Ivan Pato, City Manager FROM: Laurence Leeds, AICP, Director SUBJECT: VA-32-05: The applicant, Leonid Shutov (Golden Key Plaza) is requesting a variance to allow a 15 foot tall, 78 sq. ft. wall sign setback 12" — 18" from the property line; sign code allows a 7 foot high, 36 square foot monument sign setback 5 feet from the property line. LOCATION: Multi-Tenant Shopping center located at 833 South Federal Highway. The subject property consists of two retail buildings facing each other and separated by a common parking lot. The retail store entrances face inward such that no store is directly visible from US 1. This is a small shopping center without a supermarket or other anchor store to attract business. The north and south exterior walls of each building are located on property lines, prohibiting a monument sign north or south of the complex. The buildings are setback only five feet from the road, prohibiting the construction of a monument sign in front of the building. Construction of a permitted monument sign (36 square feet in area) in the parking lot between the buildings would have limited visibility. Based on the twin building configuration, 0' building setbacks adjacent to both side yards, limited distance between buildings (60 feet), and the absence of windows facing US 1, there appears to be a legal hardship to grant a variance to the standard monument sign. PLANNING AND ZONING BOARD RECOMMENDATION On June 14, 2005 the Planning and Zoning Board recommended approval subject to submission of a professionally drawn sign detail. CITY COMMISSION PREVIOUS ACTION On June 28, 2005 the City Commission continued this request to the July 26, 2005. Due to the positioning of our building and it's businesses, we are unable to capture drive • by business. As you are aware, the only way to accomplish that goal is to have exposure on U.S. 1. Our hopes are high that the City of Dania Beach will agree that this variance is very important to the tenants of this complex and their business livelihood.
