COKER, JR., ESQ., COKER & FEINER, ON BEHALF OF B & JCM PROPERTIES, LLC, FROM CHAPTER 28,"ZONING",FOR PROPERTY GENERALLY LOCATED AT THE NORTHWEST CORNER OF INTERSTATE 95 AND STIRLING ROAD,DANIA BEACH; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. WHEREAS,the Dania Beach Code of Ordinances,Chapter 28,"Zoning", Section 6.21,sets the Off-Street parking requirements within the City of Dania Beach; and WHEREAS,the Dania Beach Code of Ordinances,Chapter 28,"Zoning",Section 18.60(a), prescribes the area requirements within the "IROM" (Industrial Research Office Marine) zoning district; and WHEREAS,the Dania Beach Code of Ordinances, Chapter 28, "Zoning", Section 28-140, sets the sign regulations for shopping centers, hotels, office complexes and industrial complexes within 1,000 feet of 1-95 or 1-595; and WHEREAS,the firm Coker&Feiner,on behalf of B &JCM Properties LLC,have applied for variances (VA-25-05) to allow the following: l. to allow a 6 story Hotel; (The Dania Beach Code of Ordinances allows a maximum of 5 stories, per Chapter 28, Zoning Section 18.60(a) —IROM Area Requirements); 2. to allow 153 parking spaces;(The Dania Beach Code of Ordinances requires 175 spaces, per Chapter 28, Zoning, Section 6.21 —Off Street Parking Requirements); and 3. to allow a pole sign with an area of 100 square feet; (Dania Beach Code of Ordinances permits a 48 square foot sign,per Chapter 28,Zoning,Section 28-140—Sign Regulations for Shopping centers,hotels,office complexes and industrial complexes within 1,000 feet of I-95 or I-595) for property generally located at the northwest corner of Interstate 95 and Stirling Road, Dania Beach; and WHEREAS, the Planning & Zoning Board on June 15, 2005, recommended that the City Commission grant variance request VA-25-05 based upon the criteria set forth in section 10.13 of Article 10, of Chapter 28, "Zoning", of the Code of Ordinances of the City of Dania Beach; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA: Section 1. That that certain application VA-25-05, for a variance as described above from requirements in Chapter 28, "Zoning", of the City of Dania Beach Code of Ordinances, a copy of which is attached and made a part of this Resolution as Exhibit "A", is approved. Section 2. That all resolutions or parts of resolutions in conflict with this Resolution are repealed to the extent of such conflict. Section 3. That this Resolution shall be in force and take effect immediately upon its passage and adoption. G Corinne Church, AICP, Principal Planner (LIP, SUBJECT: VA-25-05/SP-16-04: The applicant, Coker & Fiener on behalf of the property owner B&JCM Properties, LLC., is requesting variances and site plan approval to allow the construction of a 150 room hotel located at the northwest corner of Interstate 95 & Stirling Road. VARIANCES: 1) To allow 6 stories; 5 stories permitted. 2) To allow 153 parking spaces; 175 spaces required. 3) To allow a pole sign area of 100 square feet; 48 square feet permitted. SITE PLAN: 150 room Best Western hotel VARIANCE ANALYSIS 1. To allow 6 stories The code allows a maximum of 5 stories, 62 feet tall building. Height variances for 6 - 10 stories have been previously approved for hotel use along the I-95 corridor. 2. To allow 153 parking spaces. The code requires 175 parking spaces for a 150 room hotel. The applicant is proposing 153 parking spaces, or 1.0 parking space per room. The Springhill Suites and Hilton Gardens (located on Stirling Road behind the Burger King) each provide 1A spaces per room. Wyndham and Marriot hotels both obtained parking variances (0.75 and 1.0 spaces per room respectively) based on a commitment to provide dedicated airport shuttle service. The applicant has agreed to provide such a service. 3. To allow a pole sign area of 100 square feet. The hotel is directly visible from I-95. The sign code also permits significant wall signage for a building of this size at this location. The hotel is separated from the interstate by an exit ramp, therefore staff can support a variance to allow a 100 square foot pole sign. SITE PLAN ANALSIS The applicant is requesting approval to construct a 150 room hotel with associated parking & pool. The submitted plans were distributed for review to several City departments. The Broward Sheriff's Office reviewed the project for Crime Prevention Through Environmental Design (CPTED) principals and recommended changes, which the applicant has agreed to provide. The applicant has obtained a tree preservation/removal permit (approved by ® the city landscape consultant) for the site. CITY COMMISSION PREVIOUS ACTION On July 26, 2005 the City Commission continued this item to allow the applicant and adjacent property owner to work with FDOT regarding property access for both sites. On August 9, 2005 the City Commission continued this item at the applicant's request. On August 23, 2005 the City Commission continued this item to allow the applicant to meet with FDOT and the neighboring property owner. PLANNING AND ZONING BOAR® RECOMMENDATION VARIANCES 1.
