A RESOLUTION OF THE CITY OF DANIA BEACH, APPROVING THE
VARIANCE REQUEST BY DYNAMIC F & B HOLDINGS (DB/A TARKS
RESTAURANT),FROM CHAPTER 28,"ZONING",ARTICLE 28,"SIGNS",FOR
PROPERTY GENERALLY LOCATED AT 1317 SOUTH FEDERAL HIGHWAY,
DANIA BEACH;PROVIDING FOR CONFLICTS;FURTHER,PROVIDING FOR
AN EFFECTIVE DATE.
WHEREAS, the Dania Beach Code of Ordinances, Chapter 28, "Zoning", Article 28,
"Signs", prescribes the signage regulations for businesses within the City of Dania Beach; and
WHEREAS, Dynamic F & B Holdings d/b/a Tarks Restaurant is the owner of property
located at 1317 South Federal Highway, and it has applied for a variance(VA-26-05)from Chapter
28, "Zoning", Article 28, "Signs", Section 28.110 to allow:
1) a 24-square foot monument sign measuring 12 feet tall by 2 feet wide to be setback 2 feet
from the US 1 property line (Chapter 28, Zoning, Article 28 — Signage, allows a 36-
square foot,7 foot tall monument sign,if setback 5 feet from the US 1 property line);and
2) a replacement wall sign(north building side) 2 '/z feet x 8 feet (the Sign code allows a 2
'/2 foot x 7 '/2 foot wall sign); and
WHEREAS,the Planning&Zoning Board on July 20,2005,recommended approval of the
variance request, VA-26-05, based upon the criteria set forth in Chapter 28, "Zoning", Article 28,
"Signs", Section 28.200 of the Code of Ordinances of the City of Dania Beach;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF DANIA BEACH, FLORIDA:
Section 1. That that certain application VA-26-05, from requirements in Chapter 28,
"Zoning", Article 28, "Signs", is approved, subject to monument sign base to be beige-colored
stucco finish to match the building and sign cabinet to consist of white letters with teal background.
Section 2. That all resolutions or parts of resolutions in conflict with this Resolution are
repealed to the extent of such conflict.
Section 3. That this Resolution shall be in force and take effect immediately upon its
passage and adoption.

SUBJECT: VA-26-05: The applicant, Tarks, on be half on Dynamic F & B
Holdings, Inc, is requesting variances to allow the following
1. To allow a monument sign 12 feet tall (7 feet permitted)
setback 2 feet (5 feet required) from the road.
2. To allow a replacement wall sign 2 % feet x 8 feet; 20
square feet channel letter sign (18 '/z sq. ft. permitted)
LOCATION: 1317 South Federal Highway
Monument Sign: The proposed monument sign is 24 square feet, less than the 36
square feet allowed by code. The applicant proposes a beige colored stucco finish to
match the building. The sign cabinet will consist of white letters with teal background.
The subject property consists of a restaurant and parking area. In the parking lot,
intersection vision regulations (US 1/SE 13 Terrace) require a 10 — 15 foot sign
setback from US 1, resulting in the loss of 2 parking spaces. The building is located
on the south lot line, prohibiting a monument sign south of the building. The US 1
building setback is 4.87 feet, less than the 5 foot sign setback required by code.
Based on intersection vision restrictions, 0' building south lot line setback next to the
south lot line, and the 4.87 building setback on US 1, there appears to be a legal
hardship to grant a variance to the standard monument sign. Also, applicant proposes
less sign area than allowed by code.
Wall Sign: Staff has no objection to applicant's 'de minimus' (Less than 2 sq. ft.)
variance request.
PLANNING AND ZONING BOARD RECOMMENDATION
On July 20, 2005 the Planning and Zoning Board recommended approval of the
applicant's request with staff's recommendations.
STAFF RECOMMENDATION
• Approval of both variances, subject to monument sign base to be beige-colored stucco
finish to match the building and sign cabinet to consist of white letters with teal
background.
