A RESOLUTION OF THE CITY OF DANIA BEACH, APPROVING THE
VARIANCE REQUEST BY SYNALOVSKI, GUTIERREZ, ROMANIK
ARCHITECTS, INC., ON BEHALF OF STIRLING LLC., FROM CHAPTER 28,
"ZONING",ARTICLE 28,'`SIGNS",FOR PROPERTY GENERALLY LOCATED
AT THE NORTHWEST CORNER OF STIRLING ROAD AND SW 35T11
AVENUE, DANIA BEACH; PROVIDING FOR CONFLICTS; FURTHER,
PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the Dania Beach Code of Ordinances, Chapter 28, "Zoning", Article 28,
"Signs", prescribes the signage regulations for businesses within the City of Dania Beach; and
WHEREAS,Synalovski,Gutierrez,Romanik Architects,Inc.,on behalf of Stirling LLC.,the
owner of property generally located at the northwest corner of Stirling Road and SW 35t" Avenue,
Dania Beach,has applied for a variance(VA-40-05)from Chapter 28,"Zoning",Article 28,"Signs",
Section 28.095 to allow for a sign:
1) 9 feet 10 inches tall (Section 28.095 provides that entryway signs for residential
multi-unit complexes or communities are permitted a monument sign to be 8 feet
high); and
2) 18 foot overall width(Code section 28.095 allows for a 14 foot overall width); and
3) 12 foot letter width; (Code section 28.095 allows for a 10 foot letter width); and
WHEREAS,the Planning&Zoning Board on July 20,2005,recommended approval of the
variance request based upon the criteria set forth in Chapter 28, "Zoning", Article 28, "Signs",
Section 28.200 of the Code of Ordinances of the City of Dania Beach;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF DANIA BEACH, FLORIDA:
Section 1. That that certain application (VA-40-05), from requirements in Chapter 28,
"Zoning", Article 28, "Signs", is approved with the following conditions:
1) Monument sign to be installed instead of a pole sign.
2) Applicant to use best efforts to match color/design of existing Oak Ridge Sign.
Section 2. That all resolutions or parts of resolutions in conflict with this Resolution are
repealed to the extent of such conflict.
Section 3. That this Resolution shall be in force and take effect immediately upon its
passage and adoption.

SUBJECT: VA-40-05: The applicant, Synalovski Gutierrez Romanik
Architects, on behalf of the owner Stirling LLC, requests the
following variances:
1) To allow a monument sign to be 9 feet 10 inches tall (8 feet
permitted).
2) To allow a monument sign to be 18 foot overall width (14 foot
overall width permitted).
3) To allow a monument sign to have a 12 foot letter width (code
• permits 10 feet letter width).
LOCATION: Northwest corner of Stirling Road and S.W. 35 Avenue.
A site plan for this property was approved by the City Commission for the construction of 31
single family houses on January 11, 2005. The applicant is now requesting an identification
sign to be located at the intersection of Stirling Road and SW 35 Avenue.
There is an existing wall sign at the intersection identifying Hollywood Oaks and Oak Ridge.
The Forest View sign, at 9' 10", is three feet taller in order to be seen above the Oak Ridge
sign. In addition, due to this unique situation, the resulting available sign area is long and
narrow, necessitating additional variances for the width of the monument sign structure and
width of the sign area.
PLANNING AND ZONING BOARD
On July 20, 2005 the Planning and Zoning Board recommended approval of the applicant's
request with staff's recommended conditions.
STAFF RECOMMENDATION
Approval, based on applicant's hardship that the sign cannot be seen unless it is elevated
above the existing Oak Ridge wall sign, subject to the following:
• (1) Monument sign to be installed instead of a pole sign.
(2)Applicant to use best efforts to match color/design of existing Oak Ridge Sign.

Dear Ms. Church:
This correspondence shall clarify the variance requested for the proposed Forest View
Estates monument sign, located at Stirling Road and SW 35'Avenue.
1. The City allows 8'(eight feet) maximum height for monument signs. We are
proposing a new sign behind the existing monument resulting in a solution that is
r 9'-10"(nine feet, ten inches)high. The following narrative is a response to the
required variance request criteria:
(a) Because of a right of way dedication ranted to the City ty of Hollywood
and a nonexclusive perpetual access easement overlay at the corner of
Stirling Road and SW 35"Avenue, two other developments have their
monument sign on our property corner.
(b)The applicant's intent is to add a sign band above/behind the existing
monument sign compatible with the characteristics and color of the
existing. This will result in a harmonious piece of architecture.
(c) The granting of the variance does not confer the applicant any special
privilege. The proposed solution is the only alternative in order to place
signage at the existing corner monument sign. Said sign is on our property
and respects all the other requirements of the code.
(d)The applicant has had negotiations with the owner of the existing sign
(Oakridge/Hollywood Oaks Master Homeowner's Association)with no
positive results. Other than the height variance, the proposed sign offers a
solution that is compatible with the code.
