HomeMy WebLinkAboutR-2005-128 Personal Days (civil service rules) RESOLUTION NO. 2005-128 A RESOLUTION OF THE CITY OF DANIA BEACH, FLORIDA, PERTAINING TO EMPLOYEE "PERSONAL DAYS" LEAVE; REPEALING SECTIONS 12.7 AND 12.8, PERTAINING TO "SICK LEAVE INCENTIVE" AND "PERSONAL DAYS", RESPECTIVELY, AND CREATING A NEW SECTION 12.7 CONTAINING PROVISIONS PERTAINING TO PERSONAL DAYS; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA: Section 1. That Section 12.7, "Sick Leave Incentive" and 12.8, "Personal Days" of Rule 12 of the Civil Service Administration Code of the City of Dania Beach, Florida are repealed and a new Section 12.7, to be entitled "Personal Days" is adopted to read as follows: Section 12. 7 Personal Dates. City employees (including the City Manager, City Attorney and persons in positions who report directly to the City Manager) shall be entitled to three personal days per calendar year. For the first year of employment, regular full time employees hired on or before March 1 of any year will be entitled to three (3) personal days. Employees hired between March 2 and May 31 of any year will be entitled to two (2) personal days for the first employment year. Employees hired between June 1 and September 30 will be entitled to one (1) personal day for the first employment year. Employees hired on October 1 or thereafter of any first year of employment will not be entitled to a personal day for that calendar year. Personal days consist of and are intended for use as authorized leave for religious observances, transaction of personal business or other personal reasons. Personal day leave shall be granted only upon advance approval of the employee's Department Director or the City Manager, as applicable. No payment will be made upon separation from City service for any unused personal day leave. No carry-over of personal day leave will be permitted from year to year. Section 2. That all resolutions or parts of resolutions in conflict with this Resolution are repealed to the extent of such conflict. • Section 3. That this Resolution shall be in force and take effect immediately upon its passage and adoption. The Union argued that the "sick leave incentive" has consistently been misused resulting in inaccurate accounting of sick hours. (Some employees would refrain from reporting sick time in order to "earn" a day off, while others were penalized for correctly reporting their time). The City and the Union agreed to eliminate the sick leave incentive and replace it with a third "personal day". The revision to the Civil Service code is needed to ensure policy consistency for union and non-Union employees. Without this revision, there is nothing to prevent non union members from "double dipping", earning a third personal day AND a sick leave incentive.
