A RESOLUTION OF THE CITY OF DANIA BEACH, FLORIDA APPROVING
THE SIGN ADJUSTMENT REQUEST SUBMITTED BY MONROE UDEL
OWNER OF JAXSON'S ICE CREAM ON BEHALF OF G & G REAL ESTATE,
FROM CHAPTER 28, "ZONING", ARTICLE 28, "SIGNS", SECTION 28.160
"DOWNTOWN DANIA BEACH REDEVELOPMENT DISTRICT
REGULATIONS", FOR PROPERTY LOCATED AT. 128 SOUTH FEDERAL
HIGHWAY, DANIA BEACH; .PROVIDING FOR CONFLICTS; FURTHER,
PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the Dania Beach Code of Ordinances, Chapter 28, "Zoning", Article 28,
"Signs", Section 28.160, "Downtown Dania Beach Redevelopment District Regulations" sets the
signage criteria for zoning districts within the Downtown Redevelopment District in the City of
Dania Beach; and
WHEREAS,Monroe Udel,owner of Jaxson's Ice Cream,on behalf of the property owner G
& G Real Estate, has applied for a sign adjustment (SA-43-05) to allow:
i) an 86.7 square foot wall sign with 3.4 feet in vertical dimension(Chapter 28, "Zoning",
Article 28, "Signs", Section 28.160, "Downtown Dania Beach Redevelopment District
Regulations" permits a 37.5 maximum square foot sign with 2.5 feet in vertical
dimension); and
ii) a sign 25.5 feet in length (Chapter 28, "Zoning", Article 28, "Signs", Section 28.160,
"Downtown Dania Beach Redevelopment District Regulations" permits 15 feet);
at the property located at 128 South Federal Highway in the Downtown Dania Beach Redevelopment
District; and
WHEREAS,the Planning&Zoning Board on August 17,2005,recommended that the City
Commission approve the sign adjustment request SA-43-05 based upon the criteria set forth in
Article 28,Section 28.200. "Relief from requirements; Sign Adjustment;Variances",of Chapter 28,
"Zoning", of the Code of Ordinances of the City of Dania Beach;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF DANIA BEACH, FLORIDA:
Section 1. That that certain application SA-43-05,for a sign adjustment as described above
from requirements in Chapter 28,"Zoning",Article 28,"Signs",Section 28.160,"Downtown Dania
Beach Redevelopment District Regulations",of the City of Dania Beach Code of Ordinances,a copy
of which application i's attached and made a part of this Resolution as Exhibit "A", is approved.
Section 2. That all resolutions or parts of resolutions in conflict with this Resolution are
repealed to the extent of such conflict.
Section 3. That this Resolution shall be in force and take effect immediately upon its passage
and adoption.

VARIANCE
1. To allow an 86.7 square foot wall sign; code permits 37.5 maximum
square feet a sign.
• 2. To allow a wall sign 3.4 feet in vertical dimensio
n; code permits 2.5 feet.
3. To allow a sign 25.5 feet in length; code permits 15 feet.

The applicant is requesting variances to replace an 86.7 square foot wall sign with a
new sign containing the same square footage. The sign is located on a shopping
center setback 60 feet from the road. Maximum sign area allowed today is 1 square
foot per 1 linear foot of frontage, with a 37.5 square foot maximum area. The new
sign is equal in size to the existing sign.
PLANNING AND ZONING BOARD RECOMMENDATION
On August 17, 2005 the Planning and Zoning Board recommended approval of the
requested variance.
• STAFF RECOMMENDATION
None. Applicant shall demonstrate hardship to the City Commission.
