A RESOLUTION OF THE CITY OF DANIA BEACH, FLORIDA APPROVING
THE VARIANCE REQUEST SUBMITTED BY RANDI RAPP ON BEHALF OF
PROPERTY OWNER BRYAN JAHODA, FROM CHAPTER 28, "ZONING",
ARTICLE 4,"DISTRICT REGULATIONS","SCHEDULE OF LOT,YARD AND
BULK REGULATIONS", FOR VACANT PROPERTY LOCATED ON SW 3RD
STREET BETWEEN SW 2ND AVENUE AND SW 4TH AVENUE, IN THE
MODELO PARK SUBDIVISION, IN THE CITY OF DANIA BEACH;
PROVIDING FOR CONFLICTS;FURTHER,PROVIDING FOR AN EFFECTIVE
DATE.
WHEREAS, the Dania Beach Code of Ordinances, Chapter 28, "Zoning", Article 4,
"District Regulations", sets the lot, yard and bulk regulations for the City of Dania Beach; and
WHEREAS, Randi Rapp on behalf of the property owner Bryan Jahoda, has applied for a
variance (VA-35-05) to allow for the construction of a single family home on a 40 foot wide lot
(Chapter 28,Article 5,Section 5.15(b), "Zoning","Schedule of Lot,Yard and Bulk Requirements"
provides that a minimum of 50 feet of width is required to build a single family home on a single lot
of record held in separate ownership as of August 28, 2001);the subject property is located on SW
3`d Street between SW 2nd Avenue and SW 41" Avenue in the Modelo Park Subdivision, Dania
Beach; and
WHEREAS,the Planning&Zoning Board on August 17,2005,recommended that the City
Commission grant variance request VA-35-05, based upon the criteria set forth in section 10.13 of
Article 10, of Chapter 28, "Zoning", of the Code of Ordinances of the City of Dania Beach;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF DANIA BEACH, FLORIDA:
Section 1. That that certain application VA-35-05, for a variance as described above from
requirements in Chapter 28,"Zoning",Article 4,"District Regulations","Schedule of Lot,Yard and
Bulk Regulations", of the City of Dania Beach Code of Ordinances, a copy of which application is
attached and made a part of this Resolution as Exhibit "A", is approved, subject to the following
condition: the applicant, on behalf of herself and any and all subsequent owners, agrees that a
Declaration of Protective Covenants running in favor of the City shall be recorded at her expense,in
the Broward County Public Records,to provide that the City may,upon reasonable advance notice to
the property owner or occupant(s), inspect the property and its improvements to confirm for code
enforcement purposes that the property is lawfully being used as a single-family home and not as a
duplex or any other multi-residential use.
Section 2. That all resolutions or parts of resolutions in conflict with this Resolution are
repealed to the extent of such conflict.
Section 3. That this Resolution shall be in force and take effect immediately upon its passage
and adoption.

AFFIDAVIT OF ROD A. FEINER, ESQ.
BEFORE ME,the undersigned authority,personally appeared ROD A.FEINER,ESQ.,who,
after first being duly sworn, deposes and states as follows:
1. My name is Rod A.Feiner,I am over the age of 18 and this Affidavit is based on my
personal knowledge.
2. I am an attorney licensed to practice law in the State of Florida and have been
admitted to practice law in the State of Florida since 1994. For the last ten (10) years I have
® specialized in land development law and transaction real estate law. As part of my duties and
responsibilities I have been responsible for the examination of title to parcels of real estate and have
rendered opinions of title and given chains of title information to lenders, clients and to
governmental entities.
3. I am also a licensed title insurance agent for Attorneys' Title Insurance Fund and
Commonwealth Land Title Insurance and, in my capacity as a title insurance agent, am responsible
for the examination of title and issuing both Title Insurance Commitments and Title Insurance
Policies.
4. I have examined the title history for the following described real property: Lot 9,
Block 4,Modelo Park, according to the Plat thereofrecorded in Plat Book 14,Page 10 of the Public
Records ofBroward County, Florida (hereinafter referred to "the Property"). Title to the Property
is currently vested in Bryan Jahoda and Randi Rapp is a contract purchaser of the Property.

5. The Property was established as a legally existing lot of record in 1929 by virtue of
the Plat being recorded in said year.
6. In 1979 the Property was owned by Bryson Lovejoy and at no time during his
ownership of the Property did Mr. Lovejoy own either of the adjacent lots of record, being Lot 10
or Lot 8 of Block 4, Modelo Park, to the Property.
7. In 1979 Bryson Lovejoy conveyed the Property to Eleanor Jackson. At no time
during her ownership of the Property did Ms. Jackson own any of the lots adjacent to the Property.
8. In 1983 Eleanor Jackson conveyed the Property to Wayne Mersereau. At no time
during his ownership of the Property did Mr.Mersereau own any of the lots adjacent to the Property.
9. In 1986 Wayne Mersereau conveyed the property to Orlando Catala. At no time
during his ownership of the Property did Mr.Mersereau own any of the lots adjacent to the Property.
10. In 2002 Orlando Catala conveyed the property to the current owner Bryan Jahoda.
At not time during his ownership of the Property did Mr. Catala own any of the lots adjacent to the
Property.
11. Mr. Jahoda does not own either of the adjacent lots of record,being Lot 10 or Lot 8
of Block 4, Modelo Park, to the Property.
12. The Property has been a separate lot of record and had a separate ownership since,
minimally, 1979.
13. The date of adoption of the Code section for which the variance which is the subject
• of this proceeding is sought was first enacted in 1985, which is after the Property was a separately
owned and legally existing lot of record.

SUBJECT: VA-35-05: The applicant, Randi Rapp on behalf of the
property owner Bryan Jahoda, is requesting a variance for
the construction of a single family home on Lot 9, Block 4
of Modelo, Park.
VARIANCE
To allow the construction of a single family home on a 40 foot wide lot (50 foot
width permitted for a lot of record held in separate ownership)
The subject property is a 40 foot wide recorded lot extending from SW 3`d Terrace to
SW 3`d Street. This parcel, as well as on other lots nearby along SW 3 Street, SW 3
Terrace and SW 3 Place, were all platted as 40 foot wide lots.
The subject property is a platted lot of record and is zoned RD-8000. RD-8000
requires a 60 foot lot width to build a single family house, or a 50 foot width if the
house is to be built on a single "lot of record" in separate ownership.
The two homes immediately to the east of the subject property are built on 40 foot
lots, the home to the west is on a larger lot. There is no vacant land to the east or
west of the property that can be combined with the subject property to create a
larger, conforming lot.
In 1988, the City Commission granted a variance to build a single family home on
this same parcel (See attached minutes). That variance was never acted upon and
has since expired.
PLANNING AND ZONING BOARD RECOMMENDATION
The Planning and Zoning Board recommended approval of the requested variance
by a 3-2 vote.

1. This is the first review of the complete application for this projected. Incomplete
information was previously provided, therefore additional review and comment by
staff may be necessary.
2. Code allows a maximum curb cut to be no more that 30% of the width of the lot.
Provide driveway dimensions.
3. Zoning Code requires 3 parking spaces per single family home, at least 2 must be
located externally. Revise plan accordingly.
4. All mechanical equipment must be located at the rear of the structure. Revise

The Proposed Single Family Residence is to be located at Southwest 3rd Street,Modelo Park,Dania Beach,
® Florida.The Project complies with all the criteria found in the Planning and Development Code of
Ordinances for the City of Dania Beach,Article 10 Section 10.13(Variances).
A. That special conditions and circumstances exist which are peculiar to the land,structure
or building Involved and which are not applicable to other lands,structures or buildings
In the same zoning district.
The Site is located in the RD-8000 Zoning District.The minimum lot width for this district is
80' and the Property is only 40'wide.This is not unusual for this area as adjacent residential
sites are also 40'wide.
B. That the special conditions and circumstances do not result from the actions of the
applicant.
The vacant property could almost be considered an infill property,as it is a vacant parcel
abutting other single-family residences of roughly the same lot size.The area was subdivided
prior to the zoning designation of RD-8000.
C. That granting the variance requested would not confer on the applicant any special
privilege that is denied by this chapter to other lands,buildings or structures in this
same zoning district.
The Owner of the Property would like to build a single-family residence.All of the height and
lot coverage requirements will be adhered to.This will only enhance the present community
and serve the same purpose as the surrounding properties.
D. That literal interpretation of the provisions of this chapter would deprive the applicant
of rights commonly enjoyed by other properties in the same zoning district under the
terms of this chapter and would work unnecessary and undue hardship on the applicamt.

The literal interpretation would not allow the property Owner or anyone to build on the
property as the lot width does not conform to the present zoning designation.
E. That the variance granted Is the minimum variance that will make possible the
reasonable use of the land,building or structure.
The variance request on the lot width is the minimum variance required to develop the land.
No other variances are being requested on this Project.
F. That the grant of the variance will be In harmony with the general Intent and purpose of
this chapter,and that such variance will not be Injurious to the area Involved or
otherwise detrimental to the public welfare.
Granting the variance still supports the general intent of the Code of Ordinances and Article
10.There would be no detrimental effect on the community or the City of Dania Beach,but
rather this Project would enhance the street in filling the vacant lot in the community.

NOTICE IS HEREBY GIVEN that a public hearing will be held before the City Commission, Tuesday,
September 13, 2005 at 7:00 p.m., or as soon thereafter as possible, in the Dania Beach City Commission
Room, Administrative Center, 100 West Dania Beach Blvd., Dania Beach, Florida 33004, for the purpose of
hearing any comments which might be made to the following request:
VA-35-05 - Variance request by Randi Rapp on behalf of the property owner Bryan Jahoda for vacant property
located on SW 3rd Street between SW 2nd Avenue and SW 4th Avenue, in the Modelo Park Subdivision. The
request is to allow the construction of a single family home on a 40 foot wide lot. (Chapter 28, Article 5,
Section 5.15 (b), Zoning, Schedule of Lot, Yard and Bulk Requirements indicate that a minimum of 50 ft. of
width is required to build a single family home on a single lot of record held in separate ownership.)
Property is legally described as Lot 9, Block 4, "Modelo Park", according to the plat thereof as recorded in plat
book 14, page 10 of the public records of Broward County Florida.
