HomeMy WebLinkAboutR-2005-163 Pari-mutuel Legislation Support RESOLUTION NO. 2005-163 A RESOLUTION OF THE CITY OF DANIA' BEACH, FLORIDA SUPPORTING LEGISLATION REGULATING PARI-MUTUEL FACILITIES BY EITHER THE STATE, BROWARD COUNTY OR BOTH IN CONJUNCTION WITH EACH MUNICIPALITY WHICH HOSTS ANY PARI- MUTUEL FACILITY WHICH INSTALLS SLOT MACHINES; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, there is one pari-mutuel facility operating within the City of Dania Beach; and WHEREAS, the City Commission understands and supports the need to regulate pari- mutuels to assure protection of the public health, safety and welfare; and WHEREAS, the municipalities in which the pari-mutuel facilities are located in Broward County are directly impacted by the activities, hours, visitors, traffic, emergency services and other demands associated with pari-mutuel operations; and WHEREAS, there is proposed legislation being presented to the Florida Legislature and Broward County Commission that would regulate the installation of slot machines in pari-mutuels in Broward County; and WHEREAS, some operating criteria pertaining to such machines are best left to the cities which host pari-mutuel facilities located within their respective jurisdictions; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA: Section 1. That the City Commission encourages the State of Florida, the Broward County Commission or both to allow the City the .flexibility to regulate the operation of slot machines in the Dania Jai-Alai pari-mutuel in certain respects such as, but not limited to, hours of operation beyond a time certain set by the State or Broward County, similar to the authority conferred by Florida Statute, Section 562.14 which empowers municipalities to regulate hours of operation of liquor establishments. Section 2. That the City may need to require its pari-mutuel to make certain improvements related to the introduction of slot machines to accommodate traffic and necessary . infrastructure, and to regulate safety, such as by means of police details and emergency services, as well as the number of vehicles that are to be allowed access to the site, such as taxis and other commercial vehicles which may cause congestion. Section 3. That the City requests that the State and the Broward County Commission set regulatory standards, but allow for the municipalities which host pari-mutuels to legislate to promote the public health, safety and welfare of its citizens, to prescribe standards and regulations related to slot machines suited to the needs of the affected municipality, such as those matters mentioned above in Section 2. Section 4. That the City Manager shall transmit a copy of this Resolution to the appropriate entities and persons. Section 5. That all resolutions or parts of resolutions in conflict with this Resolution are repealed to the extent of such conflict. Section 6. That this Resolution shall be in force and take effect immediately upon its • passage and adoption. PASSED and ADOPTED on October 11, 2005.
