A RESOLUTION OF THE CITY OF DANIA BEACH, APPROVING THE
VARIANCE REQUEST SUBMITTED BY TRIVIUM AT MARINA MILE, LLC,
ON BEHALF OF PROPERTY OWNER HUGH MCCAULEY FROM CHAPTER
28, "ZONING", ARTICLE 6.20, "SCHEDULE OF OFF-STREET PARKING
REQUIREMENTS"; FOR PROPERTY GENERALLY LOCATED AT THE
SOUTHEAST CORNER OF STATE ROAD 84 AND SW 26TH TERRACE,DANIA
BEACH; PROVIDING FOR CONFLICTS;.FURTHER, PROVIDING FOR AN
EFFECTIVE DATE.
WHEREAS,the Dania Beach Code of Ordinances, Chapter 28,"Zoning",Section 6.21,sets
the Off-Street parking requirements within the City of Dania Beach; and
WHEREAS, Trivium at Marina Mile, LLC, on behalf of property owner Hugh McCauley,
has applied for variance (VA-52-05) to allow 235 parking spaces (Chapter 28, "Zoning", Section
6.21, "Schedule Off-Street Parking Requirements", requires that 238 spaces be provided.); the
property is generally located at the Southeast corner of State Road 84 and SW 26`h Terrace, Dania
Beach; and
WHEREAS,the Planning&Zoning Board on September 29,2005,recommended that the
City Commission grant variance request VA-52-05 based upon the criteria set forth in section 10.13
of Article 10, of Chapter 28, "Zoning", of the Code of Ordinances of the City of Dania Beach;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF DANIA BEACH, FLORIDA:
Section 1. That that certain application VA-52-05, for a variance as described above from
requirements in Chapter 28, "Zoning", of the City of Dania Beach Code of Ordinances, a copy of
which is attached and made a part of this Resolution as Exhibit "A", is approved, subject to the
following conditions:
• I. Prior to issuance of any tree removal or relocation permit, provide a $72,524.00 bond to
cover the cost of tree replacement for trees which die within one year of relocation
(Landscape Consultant).
2. Prior to issuance of any tree removal or relocation permit, or any development permit,
provide City $49,868.50 for trees being removed from the site (Landscape Consultant).
Section 2. That all resolutions or parts of resolutions in conflict with this Resolution are
repealed to the extent of such conflict.
Section 3. That this Resolution shall be in force and take effect immediately upon its passage
and adoption.

As part of the Site Plan submittal for the Trivium at Marina Mile project (the "Project"),
the Applicant requests a variance from Section 6.200) of the City of Dania Beach Code (the
"Code") to allow a total of 235 parking spaces where the Code requires a total of 238 parking
spaces for business and professional offices for a total variance of three (3) parking spaces. The
variance is being requested in order to preserve in place a substantial mature Live Oak tree
located near the entrance to the Project. As the Tree Survey which accompanies the Site Plan
application demonstrates, the Project site contains many different species of trees of varying
quality and condition. The Applicant, through its Site Plan design, has strived to incorporate
and intermix many of the existing trees among the Key West-style office building and villas
proposed for the site. In order to properly preserve in place this significant Live Oak tree, it was
necessary to create a significant buffer between the Live Oak tree and the parking facilities.
This buffer has resulted in the loss of the parking spaces necessitating this variance. These
conditions are peculiar to the land and are a result of the Applicant's and the City Staffs desire to
preserve this tree in place. The granting of this variance will not confer any special privilege
upon the Applicant and the literal interpretation of the Code would work an unnecessary and
undue hardship. Finally, the variance requested is the minimum required to ensure the safety of
this tree and is otherwise in harmony with the general intent and purpose of the City's Code.
Based on the foregoing, the Applicant respectfully requests that the City favorably grant the
requested variance.

SUBJECT: SP-28-05/VA-52-05: The applicant, Triviurn at Marina Mile,
LLC, on behalf of the property owner, is requesting a
delegation request to amend the Ingress/egress points, a
variance to reduce the required parking and site plan
approval for the construction of office space for property
located at the southeast corner of State Road 84 and SW 26
Terrace.
DELEGATION REQUEST
To change the non-vehicular access line on State Road 84 and amend the
plat note to allow full ingress and egress from SW 26 Terrace.
VARIANCE
To allow 235 parking spaces; 238 spaces are required.
SITE PLAN
To allow the construction of 59,427 square feet of office space with associated
parking and gated entrance.
PROPERTY INFORMATION
ZONING: Commercial (C-3)
FUTURE LAND USE DESIGNATION: Commercial
The subject property is located at the southeast corner of State Road 84 and SW 26
Terrace on a property with a significant oak hammock. The propose project will
provide 59,427 square feet of office space while preserving much of the existing tree
canopy.
DELEGATION REQUEST
The applicant is requesting to close the non-vehicular access line (NVAL) on State
Road 84, so no access points can be located on the north end of the property. The
applicant is also requesting to be allowed full ingress and egress movement at the
access point on SW 26 Terrace, which is currently permitted for only right turns only.
VARIANCE
The applicant has worked closely with the City's Landscape consultant in order to
preserve as many trees as possible on the site. In order to preserve a 50" caliber
Live Oak, the Landscape Consultant recommended prohibiting parking spaces
around the tree. As a result, some parking spaces were eliminated, necessitating the
variance to reduce the number of parking spaces. Because this variance is the
minimum about reasonable necessary, staff is in support of this request.
SITE PLAN
The property is located on the south east comer of State Road 84 and SW 26
Terrace. To the east is an existing motel; to the west is the Broward PBA. The
applicant is proposing one entrance on SE 26 Terrace. The project is being
proposed with 8 buildings, all with a Caribbean/Key West style architectural.
The applicant has agreed to provide 24-hour security personnel on site. The
Broward Sheriffs Office has responded "As long as he (the applicant) hires and
maintains adequate security officers to patrol the property 24 hours a day, this would
be acceptable". Please note that the City cannot enforce applicant's commitment to
provide 24 hour security.
LANDSCAPE CONSULTANT REVIEW
There are 163 existing trees on site. Of these, 11 are to remain, 71 trees will be
relocated and 81 trees (including 31 Laurel Oaks) will be removed. No live oaks will
be removed. Applicant is providing new equivalent replacement vegetation
throughout the site.
SITE PLAN REVIEW COMMENTS
Please note the following interdepartmental review comments:

NOTICE IS HEREBY GIVEN that a public hearing will be held before the City Commission on
Tuesday, October 25, 2005 at 7:00 p.m., or as soon thereafter as possible, in the City Commission
Room, Administrative Center, 100 West Dania Beach Blvd., Dania Beach, Florida 33004, for the
purpose of hearing any comments which might be made to the following requests:
VA-52-05 - Applicant Trivium at Marina Mile, LLC, on behalf of the property owner Hugh
McCauley, is requesting a variance to reduce the required parking to allow 235 parking
spaces; (Chapter 28 Zoning, Article 6.20, "Schedule of Off-Street Parking Requirements",
requires that 238 spaces be provided.) Property is located at the southeast corner of State
Road 84 and SW 26 Terrace.
SP-28-05 - To allow the construction of 59,427 square feet of office space with associated
parking and gated entrance.
Legally described as all of Parcel "A", "84/95 Plat", according to the map or plat thereof, as
recorded in Plat Book 142, Page 12, public records of Broward County, Florida.
Copies of the proposed petition are available for viewing in the Community Development Department,
100 West Dania Beach Blvd., Dania Beach, Florida between the hours of 8:00 a.m. and 4:00 p.m.,
Monday - Friday. Interested parties may appear at the public hearing and be heard with respect to
the proposed petition.
