HomeMy WebLinkAboutR-2005-176 Forest View Modified Site Plan 11-08-05 RESOLUTION NO. 2005-176 40 A RESOLUTION OF THE CITY OF DANIA BEACH, FLORIDA, APPROVING MODIFICATIONS TO THE APPROVED SITE PLAN SUBMITTED BY ELIAS MITRANI, MANAGING PARTNER FOR STIRLING LLC (FOREST VIEW ESTATES),FOR PROPERTY GENERALLY LOCATED AT THE NORTHWEST CORNER OF STIRLING ROAD AND SW 35TH AVENUE, DANIA BEACH; PROVIDING FOR CONFLICTS;FURTHER,PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, Section 8.4 of Article 1 of Chapter 8 of the Code of Ordinances of the City of Dania Beach, Florida, states that a site plan is required as a condition to the issuance of a building permit; and WHEREAS, Elias Mitrani, Managing Partner for Stirling LLC., has applied for modifications to the site plan approved by Resolution 2005-001, relating to the proposed construction of 31 single family homes known as Forest View Estates,for property generally located • at the northwest corner of Stirling Road and SW 35'h Avenue, Dania Beach; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA: Section 1. That the proposed modifications to the site plan (SP- 27-04), for property generally located at the northwest corner of Stirling Road and SW 351" Avenue, Dania Beach is approved, subject to the following conditions: 1) That homes would be garage to garage only. 2) That the installation of air conditioning units and pool pumps in the interior side yard area will be allowed. Section 2. That based upon the criteria set forth in Section 8-4(p) of Article 1 of Chapter 8, of the Code of Ordinances of the City of Dania Beach, all site plan approvals shall automatically expire and become null and void unless building permits are obtained on or before 18 months from the date of this resolution. Section 3. That all resolutions or parts of resolutions in conflict with this Resolution are repealed to the extent of such conflict. Section 4. That this Resolution shall be in force and take effect immediately upon its passage and adoption. On January 11, 2005 the City Commission approved a Rezoning, Variances and Site Plan for this project. On September. 14, 2004 the City Commission approved a 31 lot gated single family subdivision consisting of eight custom home lots and 23 non-custom homes. The applicant dedicated a 12,389 square foot area for public park purposes at the northeast corner of the site. • The applicant is now requesting a site plan modification to increase the ho use size for up to 23 of the non-custom homes. There is no change in lot size or street configuration. The original plan shows 23 long and narrow house models, identified by the applicant as an `I' model providing 2,887 square feet of air conditioned space. In most cases, the minimum distance between non-custom homes was 25 feet. The revised plan shows 23 lots with a mix of house models, including: (a)Three 'I' models (2,858 s.f., 3,162 s.f., and 3,666 s.f), and (b)Three 'L' models (ranging from 3,463 s.f. to 4,129 s.f.) The net effect of the new, larger models is that the distance between buildings will be reduced from 25 feet to 10 feet for up to 23 of the non-custom homes. Staff has requested the applicant provide building elevations of the new homes. The applicant has indicated that the pervious area for each lot will not be less than 40% for the 23 perimeter lots, including pools, decks and patios. • STAFF RECOMMENDATION At the City Commission's discretion. That that certain application (SP-27-04) for site plan approval, a copy of which is attached and made a part of this Resolution as Exhibit "A", is approved, subject to the following conditions: 1) Applicant to provide a recorded landscape easement (south 15 feet of site), accepted by the City Attorney, prior to issuance of a building permit. 2) Applicant to provide a performance bond, in the amount of$311,000.00, prior to issuance of the tree removal permit, to assure replacement of trees which do not survive preservation or relocation. 3) Applicant to provide $206,160.00 in payment to the Tree Preservation Trust Fund prior to issuance of a tree removal permit. 4) Applicant to provide a recorded copy of the plat to staff prior to issuance of a building permit. 5) Applicant to provide a recorded unity of title to staff prior to issuance of a building permit. It is further noted that the original Site Plan is maintained in the office of the Community Development Department of the City of Dania Beach. Section 2.
