A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA
BEACH, FLORIDA, URGING THE FLORIDA LEGISLATURE TO ENACT
LEGISLATION REQUIRING GASOLINE SERVICE STATIONS TO PROVIDE
EMERGENCY POWER GENERATORS TO ALLOW FOR THE DISPENSING OF
FUEL AFTER DISASTERS WHICH CAUSE POWER OUTAGES;PROVIDING
FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, in light of the last two hurricane seasons, the state of Florida has sustained
significant damage from hurricanes,including the most recent storm,Wilma,which struck much of
South Florida; and
WHEREAS,among the many critically needed commodities after passage of a storm or after
any other disaster is the need for the populace to have ready access to gasoline for motor vehicles
and for generators; and
WHEREAS,if gasoline service stations were equipped with emergency power generators to
provide for the dispensing of fuel during power outages, then residents of and visitors to the state
would be able to quickly begin to recover from the devastation of a storm or other similar disaster,
because people would have the ability to seek medical help, ice, water, food and other necessities,
without having to rely on emergency resources such as police and fire assistance, and
WHEREAS,it is evident that the oil companies which conduct business in Florida have the
economic ability to provide such generators at company service stations owned and operated by
them; and
WHEREAS, such companies should be obligated to assist independent service station
operators which sell the companies' products with low cost loans or other economic incentives, to
afford the independent operators the opportunity to purchase and install their own generator
equipment; and
WHEREAS,lessons learned from the recent storm seasons dictate that the citizens should be
afforded immediate access to fuel after a disastrous event,without being compelled to wait for days
or for hours in lines, or both, to obtain such a critical commodity;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF DANIA BEACH, FLORIDA:
Section 1. That the City Commission urges the Florida Legislature to enact legislation
requiring gasoline service stations to provide emergency power generators to allow for the
dispensing of fuel after disasters causing power outages. Such legislation should require oil
companies which conduct business in the state of Florida to provide emergency power generators for
dispensing fuel at all company owned and operated gasoline service stations. Further, such
companies should be compelled to provide low interest loans or other economic incentives to enable
independent service station owners which sell the companies' products to purchase and install such
generators.
Section 2. That the City Clerk is directed to forward certified copies of this Resolution to
Governor Jeb Bush, the Broward County legislative delegation, the Florida League of Cities, the
Broward County League of Cities and each municipality in Broward County, Florida, urging each
of them to support the legislation identified above.
Section 3. That all resolutions or parts of resolutions in conflict with this Resolution are
repealed to the extent of such conflict.
Section 4. That this Resolution shall be in force and take effect immediately upon its
• passage and adoption.

7.11 RESOLUTION #2005-177
A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH,
FLORIDA, URGING THE FLORIDA LEGISLATURE TO ENACT LEGISLATION
REQUIRING GASOLINE SERVICE STATIONS TO PROVIDE EMERGENCY POWER
GENERATORS TO ALLOW FOR THE DISPENSING OF FUEL AFTER DISASTERS
WHICH CAUSE POWER OUTAGES; PROVIDING FOR CONFLICTS; FURTHER,
PROVIDING FOR AN EFFECTIVE DATE.
City Attorney Ansbro read the title of Resolution#2005-177.
Commissioner Anton requested this Resolution requiring Oil Companies to provide emergency
power generators to be sent to the State and the League of Cities. He suggested if the State did
not pass the legislation, perhaps the City should do something on a City level.
Commissioner Anton motioned to approve Resolution #2005-177; seconded by
Commissioner Bertino.
Commissioner Bertino thinks the City should pass its own ordinance for all new gas stations to
install generators and for all existing gas stations to come up to code within a five year period.
Commissioner Anton wants the State to pass the Ordinance first because it would have greater
enforcement.
The motion carried on the following 5-0 Roll Call vote:

Commissioner Bertino motioned to move forward for all new gas stations to have generators
when constructed in the City, and have everybody else come into compliance within five years;
seconded by Commissioner Anton. City Attorney Ansbro will draft an Ordinance for
Commission review.
