HomeMy WebLinkAboutR-2005-178 CRA Acquisition of Real Property by Gift or Eminent Domain RESOLUTION NO. 2005-178 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, AUTHORIZING THE ACQUISITION OF CERTAIN REAL PROPERTY AS DESCRIBED BY THE DANIA BEACH COMMUNITY REDEVELOPMENT AGENCY BY GIFT, PURCHASE OR EMINENT DOMAIN; PROVIDING FOR CONFLICTS, FURTHER, PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City Commission of the City of Dania Beach, Florida, made certain findings and declarations as set forth in Resolution No. 2001-15, adopted June 26, 2001, the "Resolution of Necessity", as required by Chapter 163, Florida Statutes; and WHEREAS, the City Commission of the City of Dania Beach, Florida established by the adoption of Ordinance No. 2002-032 (adopted on June 25, 2002), the "Dania Beach Community Redevelopment Agency" to, among other things, cause to be prepared a Community Redevelopment Plan; and WHEREAS, the Dania Beach Community Redevelopment Agency approved the Community Redevelopment Plan and submitted the Plan to the City Commission of the City of • Dania Beach for approval, which Plan was approved pursuant to Resolution No. 2002-163, adopted on September 24, 2002; WHEREAS, pursuant to Section 163.370(l)(e)(2) and Section 163.375, Fla. Stat., and Broward County Resolution 2004-423, the Dania Beach Community Redevelopment Agency possesses the power to acquire by gift, purchase or eminent domain any real property within the Community Redevelopment Area; and WHEREAS, Section 163.370(1)(e)(2), Fla. Stat., further provides that a community redevelopment agency may not exercise any power of eminent domain unless the exercise has been specifically approved by the governing body of the municipality which established the agency; and WHEREAS, the City Commission has determined that the property described below, contained within the Community Redevelopment Area, constitutes a slum or blighted area, in which there is a shortage of housing affordable to residents of low or moderate income, including the elderly, and in which the rehabilitation, conservation or redevelopment, or a combination thereof, of such area or areas, including, if appropriate, the development of housing which • residents of low or moderate income, including the elderly, can afford, is necessary in the interest of the public health, safety, morals or welfare of the residents of the City of Dania Beach; and WHEREAS, the City Commission finds that there are, within the property described below, conditions detrimental to the sound growth of the City of Dania Beach, or which impair or arrest the growth of the City, and present conditions and uses detrimental to the public health, safety, morals and public welfare; contain defective or inadequate street layout; contain lots faulty in relation to their size, adequacy, accessibility or usefulness; unsanitary and unsafe conditions; deterioration of site and other improvements; inadequate and outdated building density patterns; and other deteriorated or hazardous conditions; and WHEREAS, the City Commission has considered the financial feasibility, social and economic impacts, long term benefits, and other factors relevant to the proposed acquisition and redevelopment of the property described below; and WHEREAS, the Community Redevelopment Agency has retained consultants, conducted studies of the CRA area, obtained appraisals of the property described below and solicited input from residents during public meetings; and • WHEREAS, the City Commission of the City of Dania Beach, Florida, desires to approve or authorize the acquisition of the property hereinafter described by the Dania Beach Community Redevelopment Agency by gift, purchase or eminent domain; NOW, THEREORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, AS FOLLOWS: Section 1. That the above WHEREAS clauses are ratified and confirmed as being true and correct and are made a specific part of this Resolution. Section 2. That the Dania Beach Community Redevelopment Agency is authorized to acquire fee simple title by gift, purchase or eminent domain that certain property more specifically described as follows: PARCEL NO. 1: All of Block 1 of DANIA BEACH SUBDIVISION, according to the Plat thereof, as recorded in Plat Book 8, at Page 1 of the Public Records of Broward County, Florida. 2 RESOLUTION #2005-178 • PARCEL NO. 2: All of Lot 25, and Lot 26 less the North 5 feet and less the following described property: Commencing at the Southwest corner of said Lot 26, run North 02 degrees 20' 20" West along the West line of said Lot 26 a distance of 14.88 feet to the POINT OF BEGINNING; thence continue along the West line of said Lot 26 a distance of 24.12 feet to the Northwest corner of said Lot 26; thence North 87 degrees 49' 32" East along the North line of said Lot 26 a distance of 64.10 feet to the beginning of a curve concave southerly and having a tangent bearing of South 87 degrees 49' 32" West through said point; thence Westerly along said curve having a central angle of 03 degrees 13' 42.1" and a radius of 630.10 feet an arc distance of 35.50 feet to a point of compound curvature; thence Southwesterly along said compound curve having a central angle of 20 degrees 18' 17.5" and a radius of 46.44 feet an arc distance of 16.46 feet to a point of compound curvature; thence Southwesterly along said compound curve having a central angle of 66 degrees 37' 52.1" and a radius of 21.00 feet an arc distance of 24.43 feet to the POINT OF BEGINNING; in Block 1 of ESKILSEN'S ADDITION TO THE TOWN OF DANIA, according to the Plat thereof recorded in Plat Book "B", page 78 of the Public Records of Dade County, Florida; said lands situate, lying and being in Broward County, • Florida. PARCEL NO. 3: Lots Twenty-Three (23) and Twenty-Four (24) of Block One (1) of ESKILSEN'S ADDITION TO THE TOWN OF DANIA, according to the Plat thereof recorded in Plat Book "B", page 78, of the Public Records of Dade County, Florida; said land situate, lying and being in Broward County, Florida. PARCEL NO. 4: Lot Twenty-Two (22) of Block One (1) of ESKILSEN'S ADDITION TO THE TOWN OF DANIA, according to the Plat thereof, recorded in Plat Book `B", Page 78, of the Public Records of Dade County, Florida; said lands situate, lying and being in Broward County, Florida. PARCEL NO. 5: The North 5 feet of Lot 20 and all of Lot 21, Block 1 of ESKILSEN'S ADDITION TO THE TOWN OF DANIA, according to the Plat thereof, as recorded in Plat Book B-D, Page 78 of the Public Records of Dade County, Florida; said lands lying, situate and being in Broward County, Florida. • 3 RESOLUTION #2005-178 PARCEL NO. 6: The North 10 feet of Lot 19, and Lot 20, less the North 5 feet thereof, in Block 1 of the ESKILSEN'S ADDITION TO THE CITY OF DANIA, as recorded in Plat Book "B" at Page 78 of the Public Records of Dade County, Florida; said land situate, lying and being in Broward County, Florida. Section 3. That all resolutions or parts of resolutions in conflict with this Resolution are repealed to the extent of such conflict. Section 4. That this Resolution shall be in force and take effect immediately upon its passage and adoption.
