RESOLUTION NO. 2005-182 A RESOLUTION OF THE CITY OF DANIA BEACH, APPROVING THE VARIANCE REQUEST SUBMITTED BY JOCELYN LUMMIS, PROPERTY OWNER, FROM CHAPTER 28, "ZONING", FOR PROPERTY GENERALLY LOCATED AT 809 NW IOTH AVENUE, IN THE CITY OF DANIA BEACH; PROVIDING FOR CONFLICTS;FURTHER,PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the Dania Beach Code of Ordinances, Chapter 28, "Zoning", Article 4, "District Regulations" and Article 5 "Supplementary Lot Regulations" set the lot, yard and bulk regulations for the City of Dania Beach; and WHEREAS, Jocelyn M. Lummis, has applied for a variance (VA-58-05) to allow the following: 1. To allow a 21 foot front setback; (Chapter 28,Zoning, Article 4, Schedule of Lot, Yard and Bulk regulations—requires a 25 foot setback.) 2. To allow mechanical equipment to be located in the "required side yard", (Chapter 28, Zoning, Article 5.31(c), requires mechanical equipment to be located in the rear yard.) • for property located at 809 NW 10`"Avenue, Dania Beach; and WHEREAS,the Planning&Zoning Board on October 19,2005,recommended that the City Commission grant variance requests VA-58-05,based upon the criteria set forth in section 10.13 of Article 10, of Chapter 28, "Zoning", of the Code of Ordinances of the City of Dania Beach; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA: Section 1. That that certain application VA-58-05, for the variances described above from requirements in Chapter 28, "Zoning", Article 4, "District Regulations" and Article 5 "Supplementary Lot Regulations",of the City of Dania Beach Code of Ordinances,a copy of which application is attached and made a part of this Resolution as Exhibit "A", is approved. • Section 2. That all resolutions or parts of resolutions in conflict with this Resolution are repealed to the extent of such conflict. Section 3. Currently there is one a/c unit on the north side of the house. The current, noisy a/c unit will not support the additional square footage of the proposed second story. In order to maintain energy efficiency for the residence once the second story is added, it will be necessary to replace the single older, noisy a/c unit with two quieter, more energy efficient a/c units on the north side of the house. Due to a pre-existing in ground pool (which I did not build or cause to be built), the area where the a/c units can be placed is limited to the north side of the house. Moving the new a/c units to another area will create an excessive financial burden. The set back will remain at approximately 5 feet(see site plan)with no further encroachment into the side yard. I will continue to maintain the vegetative sound barrier I planted previously. Personally, I am extremely sensitive to noise and desire the quiet enjoyment of my home; hence I desire the replacement of the current older, noisy unit with quieter a/c units in order to increase the quiet enjoyment of my home. The newer a/c units tend to be smaller, more energy efficient, and quieter than their older counterparts. Incorporating the quieter a/c units with the vegetative sound barrier will enable my neighbors to benefit from a better quality of the quiet enjoyment of their homes. I believe that this requested variance does fall within the general intent and purpose of Chapter 28, Zoning, and that this variance will not be injurious to the area involved;but, will in fact be beneficial to the public welfare not only for the reasons i stipulated above,but because the overall project will increase the property values in this area of Dania Beach. Structural setback variance: There is a pre-existing portico type flat roof over a portion of the circular driveway. At this point any repairs to the existing, leaky flat roof would only be temporary in nature; in order to maintain the highest degree of safety and wind resistance, the roof and its support columns need to be replaced with a new, wind resistant, sloped roof. Currently, the roof extends 3'4" into the now required 25' setback(see site plan). I am requesting a variance in order to replace the old, leaky flat roof with a new hurricane friendly, sloped metal roof(see front elevation of schematic elevations — E). The new roof and required supporting columns would not further encroach on the existing setback of 21'8"; the new, hurricane friendly roof would simply replace the leaky, old flat roof. The proposed second story addition project incorporates this hurricane friendly, sloped, metal roof as to be aesthetically pleasing. The majority of the homes on NW 101h Avenue enjoy a roof over a portion of their driveway. Many of these roofs are setback less than 25' from the property line. Some of the homes have garages with are considerably closer than 25' to the property line. Without this zoning variance I would not be able to enjoy the same covered driveway many of my neighbors enjoy. I did not build the circular driveway or cause it to be built. The requested variance is the minimum required to replace the roof. The grant of this variance will be in harmony with the general intent and purpose of Chapter 28,Zoning. The applicant has indicated that the proposed portico will have the same width as the existing. Because all new construction must meet current setbacks, a variance is required in order to issue a permit. 2. To allow mechanical equipment to be located in the required side yard, code requires mechanical equipment to be located in the rear yard. The applicant is also proposing to replace an existing air conditioning unit located on the north side of the house with 2 new units. Mechanical equipment can be located in side yards if: • (1) a minimum side yard setback (seven feet) is provided, or (2) the existing unit is being replaced by a new unit in the same location.
