MILLAGE RATE AND ASSESSEMENT FEES
DANIA BEACH CITY COMMISSION
MONDAY, AUGUST 1, 2005 - 4:00 P.M.
1. Call to Order
Mayor Castro called the meeting to order at 4:04 p.m.
2. Roll Call
Present:
Mayor: Anne Castro
Commissioners: Bob Anton
John Bertino

3. Motion to establish certification of the following "not to exceed" rates to Broward County
Property Appraiser's Office for Fiscal Year 05l06
a. Millage Rate —Motion to confirm operating rate
Commissioner Bertino motioned to confirm the Operating Millage Rate of 6.39; seconded
by Commissioner Mc Elyea. The motion was defeated on the following 2-2 Roll Call vote:
Commissioner Anton No Commissioner McElyea Yes
Commissioner Bertino Yes Mayor Castro No
Commissioner Anton motioned to confirm the Operating Millage Rate of 6.69; Mayor
Castro passed the gavel and seconded the motion. The motion was defeated on the
following 2-2 Roll Call vote:
Commissioner Anton Yes Commissioner McElyea No
Commissioner Bertino No Mayor Castro Yes
• Commissioner Anton motioned to confirm the Operating Millage Rate of 6.59; Mayor
Castro passed the gavel and seconded the motion. The motion was defeated on the
following 2-2 Roll Call vote:

The Commission discussed their reasoning for supporting their proposed Millage rates.
City Manager Pato commented we need to keep the City moving forward and he will have a
difficult time with a 6.39 Millage rate and a $200,000 contingency. He will not be able to do his
job which is the same problem two former City Managers faced. He requested support because a
$200,000 contingency is very risky, and asked for time to work on changes to bring back to the
Commission.
Commissioner Bertino motioned to confirm the Operating Millage Rate of 6.39; seconded
by Commissioner Mc Elyea. The motion was defeated on the following 2-2 Roll Call vote:

Mayor Castro suggested holding another Special Meeting on Thursday morning when Vice-
Mayor Flury would be present. Commissioner Anton indicated he may not be here because he
• needed to return to Vero Beach due to a personal family matter. Commissioners Bertino and
McElyea indicated they may not be in town to attend the meeting on Thursday.
b. Millage Rate—Motion to confirm debt service rate
Commissioner Bertino motioned to confirm the Debt Service Rate of.20 mills; seconded by
Commissioner Anton. The motion carried on the following 4-0 Roll Call vote:

4. Resolution#2005-108
A RESOLUTION OF THE CITY OF DANIA BEACH, FLORIDA, RELATING TO THE PROVISION OF FIRE
RESCUE SERVICES, FACILITIES AND PROGRAMS IN THE CITY OF DANIA BEACH, FLORIDA;
ESTABLISHING THE "NOT TO EXCEED" ASSESSMENT RATE FOR FIRE RESCUE ASSESSMENTS FOR
THE FISCAL YEAR BEGINNING OCTOBER 1, 2005; DIRECTING THE PREPARATION OF AN
ASSESSMENT ROLL; AUTHORIZING A PUBLIC HEARING AND DIRECTING THE PROVISION OF
NOTICE OF SUCH HEARING; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY;
FURTHER PROVIDING AN EFFECTIVE DATE.
• City Attorney Ansbro read the title of Resolution#2005-108.

Monday,August 1,2005—4:00 p.m.
• Commissioner Anton motioned to approve Resolution #2005-108, establishing the Fire
Rescue Assessment Rate; seconded by Commissioner Bertino. The motion carried on the
following 3-1 Roll Call vote:

5. Resolution#2005-109
A RESOLUTION OF THE CITY OF DANIA BEACH, FLORIDA, RELATING TO THE COLLECTION AND
DISPOSAL OF SOLID WASTE IN THE CITY OF DANIA BEACH, FLORIDA; ESTABLISHING THE NOT TO
EXCEED ASSESSMENT RATE FOR SOLID WASTE SERVICE ASSESSMENTS AGAINST ASSESSED
PROPERTY LOCATED WITHIN THE GRIFFIN ROAD ANNEXATION AREA AND THE ANNEXED AREA
DESCRIBED IN CHAPTER 2000-474, LAWS OF FLORIDA, OF THE CITY OF DANIA BEACH FOR THE
FISCAL YEAR BEGINNING OCTOBER 1, 2005; DIRECTING THE PREPARATION OF AN ASSESSMENT
ROLL; AUTHORIZING A PUBLIC HEARING AND DIRECTING THE PROVISION OF NOTICE OF SUCH
HEARING; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; FURTHER, PROVIDING
AN EFFECTIVE DATE.
City Attorney Ansbro read the title of Resolution#2005-109.
Commissioner Bertino motioned to approve Resolution #2005-109, establishing the Solid
Waste Assessment Rate; seconded by Commissioner Anton. The motion carried on the
• following 3-1 Roll Call vote:

6. Motion to confirm Stormwater Rate
Commissioner Anton motioned to confirm the Stormwater Assessment Rate; seconded by
Commissioner Bertino. The motion carried on the following 4-0 Roll Call vote:

Commissioner Bertino Yes Mayor Castro Yes
George Jason asked to address the Commission; he noted the Commission was at a stalemate.
He indicated he agrees with Commissioner Bertino on the 6.39; and agrees with Commissioner
McElyea that the Water Plant situation needs to be looked into. However, his understanding is
today's vote does not determine the Millage Rate, it only sets a cap. With that in mind, if
Commissioner Bertino is not present for the next meeting, he won't be able to vote for the 6.39
Millage Rate; and he would lose his point by canceling out today's meeting. He asked
Commissioner Bertino to save face and let everyone agree that it will not exceed 6.69; and then
• have the hearings and get the information needed to make a decision. This would be better than
the in-fighting which is now happening.

Commissioner Bertino responded this is not in-fighting; it is just people with differing opinions.
He thinks we would be doing the right thing by staying at 6.39 mills, and he will not change his
mind. The worst case scenario will be if Commissioner Flury comes and agrees to 6.69, then he
doesn't lose because it only sets the "not to exceed" rate; but if she agrees with 6.39, he wins.
George Jason commented that Commissioner Bertino is his voice because he is on a fixed
income and he believes the Millage Rate should stay at 6.39. But Commissioner Bertino is not
getting anywhere now, and he is losing the opportunity to have this looked at with the agreement
that it will not go beyond a certain figure. He indicated it would change the complexion of the
Commission if Commissioner Bertino was not at the next meeting. He indicated they would lose
the opportunity of having the stronger voice by setting a maximum, rather than determining the
final millage.
The City Commission set another Special Meeting for Thursday, August 4, 2005 at 12:00 p.m.
7. Adjournment
Mayor Castro adjourned the meeting at 4:46 p.m.
