Call to order Vice-Mayor Mikes called the meeting to order at 7:00 p.m. 2. Roll Call Commissioner Anton P Vice-Mayor Mikes P Commissioner Chunn P Mayor McElyea A Commissioner Flury P City Manager Pato P City Attorney Sheffel P City Clerk Stilson P A motion was made by Commissioner Anton to excuse Mayor McElyea, seconded by Commissioner Chunn. Motion carried on the following 4-0 Roll Call Vote: Commissioner Anton Y Commissioner Flury Y Commissioner Chunn Y Vice-Mayor Mikes Y 3. Discussion and consideration of approving the following items related to the Dania Beach Centennial Super Boat Grand Prix to be held July 16-18,2004 ➢ Potential cost to the City ➢ Use of the Dania Beach Pier for VIP's ➢ Sale of alcoholic beverages City Manager Pato advised the Commission that last night was the first time he received the specific information for the event. He met with the promoter on 3 occasions and last night he met with Mr. & Mrs. Carbonell and Commissioner Chunn to make sure we had a good understanding of what we could and could not do in regard to the late notice. This is what they agreed upon: no vendors would be on the beach; there would be no sale of alcoholic beverages; there will be a need to use the end of pier to set up a tent at their expense and with their own workforce; there will be beer served at no charge to VIP; there is no need for added security because they will provide their own staff, and they will contact the operator of the pier to make sure the pier stayed open for regular business and did not harm, financially or otherwise, the operation of the pier. City Manager Pato also asked that any costs the City incurs for any unforeseen event would be reimbursed to the City, such as the availability of a Fire EMS Unit on site for a Minutes of Special Meeting I Dania Beach City Commission Super Boat Grand Prix Wednesday,July 14,2004—7:00 p.m. detail or overtime cost basis. Mr. Carbonell agreed to reimburse for these costs and the need for any additional BSO personnel if the Chief feels the crowds require additional police visibility. In addition, Mr. Carbonell provided proof of insurance to our Risk Manager. No city staff will be required or is being asked for. They anticipate moderate crowds because most spectators will be on the beach along the course. The City will be ready to react should the crowd be large and additional Police presence be required. " City Manager Pato advised a Press Conference was scheduled for tomorrow morning. Commissioner Anton asked if there was anything in writing indicating the City would be reimbursed for any of these costs, if needed. City Manager Pato responded no. Commissioner Anton asked if Mr. Carbonell was willing to agree to this on the record. Mr. Carbonell responded yes. Commissioner Anton asked why we were just hearing about this. Mr. Carbonell responded it was a long story. They have been talking to the City for a year and a half. Due to circumstances, a work session scheduled for last August never took place. They like to have everything together before obtaining Commission ® approval. He advised they dealt with the Rotary and Lions Club to get everything in place. Commissioner Chunn advised that quite a bit of effort from City residents was required to bring this event to the City. It was meant to be presented as a gift to the City, with no costs involved for the City. Mr. Carbonell remarked it is a gift to the whole City, because there are no costs to anyone; it is a free event for families to enjoy because it is a sponsor-driven event. He advised that the community has formed an organization called the Dania Beach Offshore Powerboat Association and they would like this to be a multiple year event. The course is 4 miles beginning and ending in Dania Beach. This event will have a one hour television show on Outdoor Life. He offered to film a feature on Dania Beach and place it into the show, this is what they have done with other cities. If the community wants them back, they will come back Mr. Carbonell responded to Commissioner Anton's questions that he met with the operator of the pier and has offered to compensate for any loss of revenue. Commissioner Anton asked the City Manager if we had received any complaints from the pier operator. Minutes of Special Meeting 2 Dania Beach City Commission Super Boat Grand Prix Wednesday,July 14,2004—7:00 p.m. City Manager Pato responded we received a call when he first heard about the event, but he no longer has any concerns. Commissioner Anton asked when City staff was first notified. City Manager Pato responded he first learned of the event on Saturday, July 3rd at 5:00 p.m. He remarked that he first discussed this with Mr. Carbonell about a year ago, but when they approached the Commission, the Commission chose not to support the event. That was the last time he talked to Mr. Carbonell. He did not want the Commission to be misled by the comment that it was discussed with the City. Mr. Carbonell remarked a statement was made at that time that if it did not cost the City anything, to go for it. They understood they still needed to come before the Commission for approval, and he took the blame for not bringing it forward. Vice-Mayor Mikes remarked that he is familiar with these races and they normally get tourism development funds. He remarked this is a positive event for the City because we are trying to get a marine orientation for the City. He would have liked to have seen it earlier in order to obtain more publicity. Vice-Mayor Mikes wished them well with the project. City Manager Pato asked the Fire Department to spell out their minimum requirements for Sunday. ® Deputy Chief Cassano advised that based on his discussion with Chief Land, they agreed that a standard staffing of 3 personnel in one rescue vehicle would be sufficient. The cost would be $1,140 ($990 personnel, $150 use of vehicle). A canopy may be used provided it does not have sides and a certificate was provided stating it was flame retardant, as well as an inspection for proper anchoring. Mr. Carbonell responded this would not be a problem, they will provide the certificate and a professional company will install the tent. Chief Cowart recommended that 2 Deputies be assigned to the beach between 10:00 a.m. and 3:00 p.m. to monitor traffic and provide crowd control, if needed. They asked Mr. Carbonell to provide private security, or volunteers, to monitor the parking area at Dania Jai Alai to insure no problems with vandalism. They also asked that no work be performed on the boats at Dania Jai Alai after 9:00 p.m. Mr. Carbonell advised they have their own security staff, as well as volunteers; and the gates will be locked after 9:00 p.m. City Attorney Sheffel remarked they were satisfying the Code requirement for Commission approval by appearing at the meeting tonight, and by satisfying the insurance requirements of the Risk Manager. City Manager Pato remarked that Mr. Carbonell offered to provide a film producer to highlight some areas of the City of Dania Beach. Mr. Carbonell advised it would be a feature, approximately one and a half minutes long, and he would provide the footage, and the rights to the footage, should the City wish to use'it for a commercial. Vice-Mayor Mikes remarked this is the type of positive exposure the City wants to receive. He wished them well. A motion was made to approve the event with all the stipulations discussed at tonight's meeting by Commissioner Chunn, seconded by Commissioner Anton. City Manager Pato asked for comments from staff. Fernando Vazquez, Public Services Director wanted to state for the record that a total of 6 employees would be needed from 6:00 a.m. to 6:00 p.m., at an overtime rate. Also, 2 vehicles, barricades and cones, cleaning equipment, and the rental of a 20-yard dumpster would be required for a cost of$3,374. City Manager Pato advised that Mr. Carbonell had volunteered to do the clean up. Victoria Lawbuck, 4701 SW 42"d Avenue, remarked that Mr. Vazquez thinks there are vendors, but there are none. Therefore there will be no need for cones. City Manager Pato remarked that we will not require any City crews. Public Services Director Vazquez withdrew his request. Motion carried on the following 4-0 Roll Call Vote: Commissioner Anton Y Commissioner Flury Y Commissioner Chunn Y Vice-Mayor Mikes Y Commissioner Flury commented that she is bothered by the way this was done. She is particularly bothered by the way our Charter reads that anyone can call for a Special Meeting and as long as 3 members are present, they can vote on anything they want. The Commission was in recess and had cancelled the Regular Meeting. She asked this be placed on the next agenda for discussion with the City Attorney so that only issues of health, welfare and the safety of the community could be dealt with at special meetings. Minutes of Special Meeting 4 Dania Beach City Commission Super Boat Grand Prix Wednesday, July 14,2004—7:00 p.m. • Vice-Mayor Mikes responded that he dealt with this 15 years ago. He changed the Charter so that 24 hours public notice was required. He stopped a prison from coming into the City because this was in the Code. He also stopped other obnoxious uses in the City because he was able to put legislation through in a Special Meeting to protect the residents of the City. He remarked that personalities need to be kept out of this. We should be looking as if this is good for the City. If you look at all the changes that have been made in the Charter in the last 15 years, almost every protection that has been put in has been by one Commissioner. This one Commissioner has taken the effort to protect the residents of this City for 15 years, and lots of luck when this Commissioner leaves in 6 months. Commissioner Flury remarked that there is no doubt that Vice-Mayor Mikes has made improvements in the Charter, but that does not mean that something from 15 years ago can't be improved upon. She thinks that he could do it better than anybody and would like him to take a look at it to see if it leaves the Commission vulnerable. Vice-Mayor Mikes remarked it cuts both ways. To be able to call a meeting to deal with an emergency, the Body has to be able to respond to a particular situation. We can look to see if we can make it better, but this project would have gone forward with or without the approval of the City. He agreed there are changes that need to be made to the Charter. Commissioner Chunn remarked that during the meetings with the Police and Fire . Departments, it was decided that if the City would support this event the Fire Department said they would not charge Mr. Carbonell if funds were in the budget. This will bring thousands of dollars of publicity to the City. He wondered if the Commission would be in favor of supporting what the Fire Chief had initially said. City Manager Pato remarked he never heard the Fire Chief say that to him. Commissioner Chunn responded that the City Manager was not at the meeting. He would not tell a lie about it. City Manager Pato did not suggest that Commissioner Chunn lied. He re-stated that he did not know about the conversation or that the Chief was inclined to waive the costs. Vice-Mayor Mikes suggested we wait until the Mayor returns and we have a full Commission. At that time we will know the true cost of the event and the Commission can decide if they want to refund the fees. He remarked that most cities do offer some kind of sponsorship. He would be willing to entertain this at the next meeting. 4.
