Call to Order Mayor McElyea called the meeting to order at 3:40 P.M. 2. Roll Call Present: Mayor: C.K. McElyea Vice-Mayor: Bob Mikes Commissioners: Bob Anton Robert Chunn Pat Flury City Attorney: Tom Ansbro City Manager: Ivan Pato Deputy City Clerk: Miriam Nasser 3. Motion to establish certification of the following "not to exceed" rates to Broward • County Property Appraiser's Office for Fiscal Year 04/05 City Attorney Ansbro explained the proposed adoptions for the Special Assessments. He listed the Stormwater, Fire Rescue, and Solid Waste assessments for the upcoming Fiscal Year. He said the issues were previously discussed in the budget presentation. He indicated the only one that changed was the Fire Rescue assessment. He stated the rates were the highest they could be and indicated these were the figures they worked from to establish the millage rate. He indicated they could be rolled back before they had the budget hearing in September. Patricia Varney, Director of Finance, indicated the rate needed to be certified by the Property Appraiser's Office by August 4, 2004. She pointed to the "Not to Exceed" fund millage rate. She stated that the low flat rate was 5.82 and the proposed millage rate was 6.39. She indicated they were recommending a 9.79 percent increase to the Property Appraiser's Office. A motion was made by Commissioner Chunn, seconded by Commissioner Anton, to confirm the MMillage Rate ($94.50 for Residential; $64.00 for Non-Residential). The motion carried on the following 5-0 roll call vote: Commissioner Anton- Yes Vice-Mayor Mikes - Yes Commissioner Chunn—Yes Mayor McElyea-Yes I� Commissioner Flury—Yes Minutes of Special Budget Meeting I Dania Beach City Commission Monday,July 26,2004 ® 3.1 Fire Assessment Rate - Adoption of Resolution A RESOLUTION OF THE CITY OF DANIA BEACH, FLORIDA, RELATING TO THE PROVISION OF FIRE RESCUE SERVICES, FACILITIES AND PROGRAMS IN THE CITY OF DANIA BEACH, FLORIDA; ESTABLISHING THE "NOT TO EXCEED" ASSESSMENT RATE FOR FIRE RESCUE ASSESSMENTS FOR THE FISCAL YEAR BEGINNING OCTOBER 1,2004; DIRECTING THE PREPARATION OF AN ASSESSMENT ROLL; AUTHORIZING A PUBLIC HEARING AND DIRECTING THE PROVISION OF NOTICE OF SUCH HEARING; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING AN EFFECTIVE DATE. City Attorney Ansbro read the Resolution title. Patricia Varney, Director of Finance, recapped the assessment. She stated that it was $94.50 for the residential and a schedule for commercial and industrial. City Attorney Ansbro indicated that it was a graduated fee assessment. Commissioner Flury asked if the formula for the commercial changed in the past year. Director Varney stated that it did not change. She stated the only change was for nursing homes because of subsidizing. • Commissioner Flury asked Deputy Fire Chief Cassano if he had the per capita figure that Vice-Mayor Mikes requested. Deputy Fire Chief Mike Cassano stated it was $262.00 per capita for Fire Rescue. City Attorney Ansbro indicated the figure was actually $287.00. Deputy Fire Chief Cassano referred to the comparison for other cities that the Commission asked for and noted that it was provided. A motion was made by Vice-Mayor Mikes, seconded by Commissioner Flury, to adopt the Fire Assessment Resolution. The motion carried on the following 5-0 roll call vote: Commissioner Anton- Yes Vice-Mayor Mikes -Yes Commissioner Chunn—Yes Mayor McElyea- Yes Commissioner Flury—Yes 3.2 Solid Waste Assessment Rate—Adoption of Resolution A RESOLUTION OF THE CITY OF DANIA BEACH, FLORIDA, RELATING TO THE COLLECTION AND DISPOSAL OF SOLID WASTE IN THE CITY OF DANIA BEACH, FLORIDA; ESTABLISHING THE NOT TO EXCEED ASSESSMENT RATE FOR SOLID WASTE SERVICE ASSESSMENTS AGAINST ASSESSED PROPERTY Minutes of Special Budget Meeting 2 Dania Beach City Commission Monday,July 26,2004 LOCATED WITHIN THE GRIFFIN ROAD ANNEXATION AREA AND THE ANNEXED AREA DESCRIBED IN CHAPTER 2000-474, LAWS OF FLORIDA, OF THE CITY OF DANIA BEACH FOR THE FISCAL YEAR BEGINNING OCTOBER 1, 2004; DIRECTING THE PREPARATION OF AN ASSESSMENT ROLL; AUTHORIZING A PUBLIC HEARING AND DIRECTING THE PROVISION OF NOTICE OF SUCH HEARING; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY;FURTHER,PROVIDING AN EFFECTIVE DATE. City Attorney Ansbro read the Resolution by title. Patricia Varney, Director of Finance, indicated that there was no rate increase. She noted that because of a City Ordinance requirement they still had to pass a "Not to Exceed" rate. A motion was made by Vice-Mayor Mikes, seconded by Commissioner Chunn, to adopt the resolution for Solid Waste Assessment. The motion carried on the following 5-0 roll call vote: Commissioner Anton- Yes Vice-Mayor Mikes - Yes Commissioner Chunn—Yes Mayor McElyea -Yes Commissioner Flury - Yes 3.3 Stormwater Rate • City Attorney Ansbro indicated a resolution was not required, only a motion to confirm the rate. He stated the rate was predicated by ERU, or Equivalent Residential Unit. Patricia Varney, Director of Finance, indicated the charge was $23.00 per ERU. City Attorney Ansbro stated that charge applies to everybody, they just have different ERU's. People will see a modest increase in their bills, but indicated that it really was not an increase. He further clarified that in the past residents used to pay as part of the association fees, for common areas, but now they will be paying directly as a proportionate share of their piece of clubhouse or common areas. Patricia Varney indicated she received calls from churches with large pieces of property where they thought they should get some credit back. Also Dania Jai Alai where they had to do an adjustment. She stated that Fred Bloetscher had corrected the problems. A motion was made by Commissioner Anton, seconded by Commissioner Flury, to confirm the stormwater rate. City Attorney Ansbro indicated the same formula would apply. He stated they would need Fernando Vazquez, Director of Public Services, to have a precise answer to the question. He indicated he would bring the information to the regular meeting. 4.
