RESOLUTION NO. 2006-198 A RESOLUTION OF THE CITY OF DANIA BEACH, APPROVING THE VARIANCE REQUEST SUBMITTED BY HOLD-THYSEEN, INC. MANAGEMENT COMPANY REPRESENTING PROPERTY OWNER JANIE M. COBB,V.P.,CABOT II,INC.,FROM CHAPTER 28,"ZONING",ARTICLE 5.60, "WALLS,HEDGES AND FENCES",FOR PROPERTY LOCATED AT 2200 SW 45TH STREET, IN THE CITY OF DANIA BEACH; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. WHEREAS,the Dania Beach Code of Ordinances,Chapter 28,"Zoning",Article 5.60,sets the regulations for walls, fences and hedges in the City of Dania Beach; and WHEREAS,Hold-Thyseen,Inc.,Management Company representing property owner Janie M. Cobb,V.P. Cabot Il,Inc.has applied fora variance (VA-71-06)to allow the installation of a 12 foot wall with barbed wire associated with tenant requirements for Toyota Tsusho America,Inc.,for property located at 2200 SW 451h Street, Dania Beach (where a 6 foot wall is otherwise permitted, without the use of barbed wire); and WHEREAS,the Planning&Zoning Board on October 18,2006,recommended that the City Commission grant variance request VA-71-06, based upon the criteria set forth in section 10.13 of Article 10, of Chapter 28, "Zoning", of the Code of Ordinances of the City of Dania Beach; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA: Section 1. That that certain application VA-71-06, for a variance as described above from requirements in Chapter 28, "Zoning", Article 5.60, "Walls, Fences and Hedges", of the City of Dania Beach Code of Ordinances, a copy of which application is attached and made a part of this Resolution as Exhibit "A", is approved with the following condition: 1) Applicant provides a black vinyl coated fence.(Planning and Zoning Advisory Board) Section 2. That all resolutions or parts of resolutions in conflict with this Resolution are repealed to the extent of such conflict. Section 3. PROPERTY INFORMATION ZONING: Commercial (C-3) LAND USE DESIGNATION: Industrial (1) The applicant is in the process of renovating the property to accommodate a new tenant, Toyota Tsusho America, Inc. VARIANCE There is an existing 6 foot wall surrounding the loading bays adjacent to the building. The applicant is requesting to install 2 feet of chain link fencing on top of the wall with an additional 2 feet of barbed wire. The Zoning code allows a maximum 6' wall. The applicant states that US Customs and Homeland Security require the proposed fence in order to protect containers coming and going from Port Everglades. The tenant in our building, Toyota Tsusho America, Inc, is required by US Customs and Homeland Security to provide a secured perimeter fence at least 8' tall with barb wire to protect incoming and outgoing containers from being tampered with prior to unloading at the building or delivery to the port for shipping. Please see attached specifications from Department of the Treasury regarding the guidelines for perimeter security. In addition, we have provided a site plan showing the fenced area and location of additional 2' of chain link fence and barb wire. An existing 6' high concrete block perimeter fence already exist and the plans call for adding additional 2' of chain link fence to top of concrete wall. 2. The tenant, Toyota Tsusho. America, Inc. has the requirement for additional fence height to provide security per US Custom and Homeland Security specifications. 3. The variance is solely to meet the requirements of US Custom and Homeland Security for cargo being received and shipped from the port. 4. If the applicant doesn't receive this variance, the tenant will be unable to conduct business at this location as they will not meet US Customs and Homeland Security requirements for a secured perimeter location. 5. As outlined in the US Treasury specifications, this is minimum requirement to obtain a US Customs licenses to store and ship cargo from the port. 6. The fence is a matter of security and will protect the local inhabitants from person who could assess the cargo for illegal or harmful acts. We are attempting to provide occupancy for Toyota Tsusho America by November 15, 2006 and any help that can be provided to meet this date would be greatly appreciated. In order to authorize any variance from the terms of this chapter, the city commission must and shall find: a (a) That special conditions and circumstances exist which are peculiar to the land, structure or building involved and which are not applicable to other lands,structures or buildings in the same zoning district; (b) That the special conditions and circumstances do not result from the actions of the applicant; (c) That granting the variance requested will not confer on the applicant any special privilege that is denied by this chapter to other lands, buildings or structures in this same zoning district; (d) That literal interpretation of the provisions of this chapter would deprive the applicant of rights commonly enjoyed by other properties in the same zoning district under the terms of this chapter and would work unnecessary and undue hardship on the applicant; (e) That the variance granted is the minimum variance that will make possible the reasonable use of the land,building or structure; (f) That the grant of the variance will be in harmony with the general intent and purpose of this chapter, and that such variance will not be injurious to the area involved or otherwise detrimental to the public welfare. In granting any variance, the city commission may prescribe appropriate conditions and safeguards in conformity with this chapter.Violation of such conditions and safeguards,when made a part of the terms under which the variance is granted, shall be deemed a violation of this chapter. The city commission may prescribe a reasonable time limit within which the action for which the variance is required shall be begun or completed or both;however,no time limit for same shall exceed one year from the date such variance is granted and approved by the city commission, unless said one year limit is extended by the city commission after a written application for such extension is filed with the building and zoning department by the affected party. Under no circumstances, except as permitted above, shall the city commission grant a variance to permit a use not generally or by special exception permitted in the zoning district involved or any use expressly or by implication prohibited by the terms of this chapter in the zoning district. No nonconforming use of neighboring lands, structures or buildings in the same zoning district and no permitted use of lands,structures or buildings in other zoning districts shall be considered grounds for the authorization of a variance. 10.14. REFERRAL TO PLANNING AND ZONING BOARD. Each application for a special exception or variance shall be referred to the planning and zoning board for advisory comment; except that variances for lot frontage and lot size for property located within the officially designated community development block grant redevelopment target area shall be heard directly by the city commission.
