HomeMy WebLinkAboutR-2004-010 Release of Easement Dania Distribution RESOLUTION NO. 2004-010 RESOLUTION OF THE CITY OF DANIA BEACH, FLORIDA, RELEASING THE EASEMENTS ACCEPTED BY RESOLUTION NO. 2003-225, DANIA DISTRIBUTION CENTRE, LTD., A FLORIDA LIMITED PARTNERSHIP FOR PROPERTY LOCATED BETWEEN WEST DANIA BEACH BOULEVARD AND SW 1ST STREET; PROVIDING THAT ALL RESOLUTIONS OR PARTS OF RESOLUTIONS IN CONFLICT WITH THIS RESOLUTION ARE REPEALED TO THE EXTENT OF SUCH CONFLICT; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, on November 26, 2002, the Dania Beach City Commission approved the Dania Distribution Center site plan, with no access to Dania Beach Boulevard; and WHEREAS, On July 8, 2003 the City Commission approved the vacation of the existing 30' road right-of-way (SW 12th Avenue Extended) along the east side of the plat which was previously granted by the Stirling Industrial Park Plat (Plat Book 131, Page 49 BCR); and WHEREAS, On September 23, 2003 the City Commission of the City of Dania Beach Florida approved a dedication of a right turn lane and corner cord for the Dania Distribution project in order to receive County plat approval (Recorded November 17, 2003, OR BK 36439 Pages 1555-1558); and WHEREAS, it has been determined that the granting of these easements are of no use of to the City, since they lead to a street that no longer exists (SW 12th Avenue between SW 1st Street and Dania Beach Boulevard) and that the applicant is now requesting the City to release the easement establishing the right turn lane on Dania Beach Boulevard. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA: 1 RESOLUTION NO. 2004-010 Section 1. That the request by Craven Thompson & Associates, Inc., to release an easement establishing the right turn lane on Dania Beach Boulevard for the property generally located at the southwest corner of Dania Beach Boulevard and SW 12th Avenue Extended is hereby approved. Section 2. That the proper City officials are authorized to execute a release of the easement. Section 3. That all resolutions or parts of resolutions in conflict with this resolution are repealed to the extent of such conflict. Section 4. La rence Leeds, ICP, Director SUBJECT: VC-29-03: Request by Craven Thompson & Associates, Inc., to release easements establishing a right turn lane and corner cord on Dania Beach Boulevard for the property generally located at the southwest corner of Dania Beach Boulevard and SW 12th Avenue Extended (Applicant: Dania Distribution Center) On September 23, 2003 the City Commission approved the dedication of a right turn lane and corner cord for the Dania Distribution project. Both the turn lane and corner cord are located on the south side of Dania Beach Boulevard and the west side of vacated SW 12th Avenue. The applicant indicated the dedication was initially necessary in order to obtain county plat approval. Plat approval is a prerequisite to obtaining building permits to commence construction. Because the easements are of no use to the City, and since they lead to a street that does not exist (SW 12th Avenue between SW lst Street and Dania Beach Boulevard), the applicant is requesting the City unilaterally release the easements.
