A RESOLUTION OF THE CITY OF DANIA BEACH, FLORIDA, APPROVING THE
REQUEST SUBMITTED BY BONNIE MISKEL, OF RUDEN-MCCLOSKY, REPRESENTING
ROBERT FILENI (INTER-PRO INVESTMENT GROUP INC.), REQUESTING A SIX MONTH
EXTENSION OF THE PREVIOUSLY APPROVED SPECIAL EXCEPTION (SE-19-03
APPROVED BY RESOLUTION 2003-140)ASSIGNING UP TO 300 FLEXIBILITY UNITS TO
CONSTRUCT UP TO A 300 UNIT MULTI-FAMILY MIXED USE DEVELOPMENT AT THE
NORTHEAST CORNER OF US 1 AND DANIA BEACH BOULEVARD ALONG WITH THE
PROPERTY LOCATED BETWEEN NE 1ST AVENUE AND NE 1ST COURT ON THE NORTH
SIDE OF DANIA BEACH BOULEVARD; PROVIDING FOR CONFLICTS; FURTHER,
PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the Dania Beach Zoning Code provides that mixed-use
residential/commercial is allowed as Special Exception Use in C-2 zoning districts with the
allocation of flex units; and
WHEREAS, On May 27, 2003 the City Commission approved special exception
request SE-19-03, assigning up to 300 flexibility units for six (6) months to the property
located at the northeast corner of US 1 and Dania Beach Boulevard along with the property
located between NE 1st Avenue and NE 1st court on the north side of Dania Beach
Boulevard; and
WHEREAS, at the end of the six month period, Inter-Pro Investment Group Inc.was
required to demonstrate, to the satisfaction of the City Commission, that they have made
sufficient progress to extend the flex allocation for an additional six months; and
WHEREAS, Interpro Investment Group Inc. is hereby requesting a six month
extension of time for the special exception request SE-19-03 approval and flex allocation.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF DANIA BEACH, FLORIDA:
Section 1. That the request for an extension of time for application SE-19-03
approved by resolution 2003-140, for a Special Exception Use to construct up to a 300 Unit

Multi-Family Mixed Use Development located at the northeast corner of US 1 and Dania
• Beach Boulevard along with the property located between NE 1st Avenue and NE 1st
Court on the north side of Dania Beach Boulevard, located within a C-2 (Commercial)
zoning district is conditionally approved for the property identified in Exhibit "A."
Section 2. That the flex allocation confers no vested rights or entitlements with
respect to building design, building height, setbacks, density, required parking, or
landscaping beyond what is allowed or required under the existing zoning.
Section 3. That special exception approval to allocate up to 300 flex units is
extended to August 1, 2004, subject to the applicant completing all of the following items-
1. The City Attorney shall confirm that the applicant has a sufficient ownership interest in all
special exception/flex allocation lots to develop and build the entire project. Staff reserves
the right, based on the opinion of the City Attorney, to require that all lots be consolidated
under a single corporate entity by unity of title, said unity of title to be approved by the City
Attorney by May 1, 2004.
2. Applicant shall submit a detailed site plan package, including but not limited to, building
elevations, parking structure plans, and public right-of-way and landscape improvement,and
provisions for providing adequate water flow, including but not limited to booster pumps, by
May 1, 2004.
3. Applicant shall submit a graphic presentation of perspective views of the completed project
superimposed upon the existing as-built physical environment and street pattern adjacent to
the project by May 1, 2004.
4. The applicant's attorney shall submit, by May 1, 2004, documentation that Robert Fileni,
individually or in a corporate capacity, for all lots included within this project, understands
and agrees to the following the following conditions.
(a) The flex allocation confers no vested rights or entitlements with respect to building
design, building height, setbacks, density, required parking, or landscaping beyond what
is allowed or required under existing C-2 zoning.
(b) Due to the size and scale of the project, certain issues must be addressed before the
flex allocation can be made permanent. These include, but are not limited to, density,
building height, setbacks, design, and architecture.
(c) Pending approval of the Local Activity Center land use plan amendment, the City
Commission reserves the right to substitute LAC units for 100% of the flex units
allocated to this project. Please note that LAC units require the payment of student
station fees in lieu of county school impact fees.

. (d) Applicant shall include language in the condominium documents disclosing the status of
the south runway extension.
Section 4. That all resolutions or parts of resolutions in conflict with this resolution
are repealed to the extent of such conflict.
Section 5. That this resolution shall be in force and take effect immediately upon its
passage and adoption.

SUBJECT: SE-19-03: Bonnie Miskel, Ruden-McClosky, representing
Robert Fileni (Inter-Pro Investment Group Inc.), requests
an extension of a previously approved Special Exception
assigning 300 flexibility units to construct up to a 300
Unit Multi-Family Mixed Use Development.
Property located at the northeast corner of US 1 and
Dania Beach Boulevard along with the property located
between NE 1st Avenue and NE 1st court on the north
side of Dania Beach Boulevard.
On May 27, 2003 the City Commission approved a special exception
assigning 300 flexibility units for six (6) months to the above referenced
properties. At the end of the six month period, Inter-Pro was required to
demonstrate, to the satisfaction of the City Commission, that they have
made sufficient progress to extend the flex allocation for an additional six
months.
The applicant has made only limited progress since May and unresolved
issues remain. However, some of the issues are beyond the applicant's
control (FDOT position on Dania Beach Boulevard improvements) and
staff primary objective is obtaining a quality development at this key
location. As such, staff will support an extension until August 1, 2004,
subject to applicant addressing the following conditions by May 1, 2004.
1. The City Attorney shall confirm that the applicant has a sufficient
ownership interest in all special exception/flex application lots to
develop and build the entire project. Staff reserves the right, based
on the opinion of the City Attorney, to require that all lots be
consolidated under a single corporate entity by unity of title.
2. Applicant shall submit a detailed site plan package, including but

required under existing C-2 zoning.
(b) The submission of the preliminary site plan and trafficway
waiver is required to grant vested rights to develop this property
beyond what is allowed existing C-2 zoning.
(c) Due to the size and scale of the project, certain issues must be
addressed before the flex allocation can be made permanent.
These include, but are not limited to, density, building height,
setbacks, design, and architecture.
(d) Pending approval of the Local Activity Center land use plan
amendment, the City Commission reserves the right to
substitute LAC units for 100% of the flex units allocated to this
project. Please note that LAC units require the payment of
student station fees in lieu of county school impact fees.
STAFF RECOMMENDATION
Approval of Special Exception until August 1, 2004, subject to applicant

WHEREAS, the Planning&Zoning Board on April 23, 2003, recommended that the
City Commission grant the Special Exception request, based upon the criteria set forth in
Chapter 28, Zoning, Article 6, Supplementary Use Regulations, Section 6.40, Special
Exception Uses, of the Code of Ordinances of the City of Dania Beach.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF DANIA BEACH, FLORIDA:
Section 1, That certain application SE-19-03, for a Special Exception Use to
construct up to a-300 Unit Multi-Family Mixed Use Development located at the northeast

Enclosed please find the Development Application for Inter-Pro Investment Group, Inc.
Inter-Pro Investment Group, Inc. ("Applicant") is the owner of various parcels that constitute the
northeast comer of the intersection of U.S. Federal Highway and Dania Beach Boulevard.
Applicant seeks to develop the parcels into a mixed-use project comprised of retail and
residential uses ("Project"). Applicant is seekin the assi
units for the site. r3 gnment of three hundred (300) flex
The Project area has a present land use of Commercial with a zoning designation of"C-
2". The current Project area consists of three (3) two (2) story buildings, a three (3) story
building,a one(1)story building, and three(3) asphalt pavement parking areas.
The Applicant intends to develop the site with a ten (10) story condominium with retail
uses on the first floor and structured parking to serve the development.
Applicant has retained Victor Yue with Dorsky, Hodgson Partners, one of South Florida's
most notable mixed-use architects and designer of several other mixed-use projects throughout
the region. Applicant intends to revitalize this portion of the City of Dania Beach, which serves
as a vital lynchpin to any urban redevelopment.
Subsequent to this request, the Applicant will also be seeking site plan approval, and a
supplemental application for abandonment of certain alleyways and right-of-way. A preliminary
site plan is attached for your convenience. We recognize the importance of this main
intersection and the owner/applicant will work closely with staff to make the northeast corner the
cornerstone of any future redevelopment in the City.
