HomeMy WebLinkAboutR-2004-034 Courtyard by Marriott Amendment to Reso 2002-094 RESOLUTION NO. 2004-034 A RESOLUTION OF THE CITY OF DANIA BEACH, FLORIDA, APPROVING AN AMENDMENT TO RESOLUTION NO. 2002-094 ADOPTED JUNE 25, 2002, TO AMEND THE SITE PLAN REQUEST ORIGINALLY SUBMITTED BY GUNSTER-YOAKLEY & STEWART, P.A., FOR THE COURTYARD BY MARRIOTT HOTEL, FOR PROPERTY LOCATED NORTH OF THE BASS PRO SHOPS, 200-220 GULFSTREAM WAY AND THE IGFA MUSEUM, 230 GULFSTREAM WAY, DANIA BEACH, SUCH AMENDMENT PERTAINING TO SALES OF ALCOHOLIC BEVERAGES FOR ON-PREMISES CONSUMPTION BY HOTEL PATRONS; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA: Section 1. That certain application (SP-23-02) for site plan approval, a copy of which was attached and made a part of Resolution 2002-094 as Exhibit "A" is amended, and such Resolution is also amended to add the following conditions: a) Alcoholic beverages shall not be sold, offered for sale or furnished to any non-patron of the hotel. b) No signage indicating that a lounge or bar exists in the hotel shall be permitted except within the building or the hotel premises, and shall only be displayed in a manner that is visible to hotel patrons and guests. c) No advertising in any type of media shall be permitted, which represents that such beverages are offered for sale to non-patrons of the hotel. 1 RESOLUTION NO. 2004-034 • d) No live entertainment in the restaurant, lounge or bar areas is permitted. Section 2. That all resolutions or parts of resolutions in conflict with this resolution are repealed to the extent of such conflict. Section 3. Leeds, AICP, Director Date February 18, 2004 Community Development Department City Manager Date CITY OF DANIA BEACH COMMUNITY DEVELOPMENT DEPARTMENT STAFF REPORT DATE: February 24, 2004 TO: Ivan Pato, City Manager FROM: Laurence Leeds, AICP, Director SUBJECT: A Resolution Amending the Site Plan and Variance Approvals for the "Courtyard Marriot (Bass Pro)" - �---- - pertaining to the Sale of Alcoholic Beverages for On premises Consumption by Hotel Patrons At the time of site plan and variance approval, the hotel developer represented that access to dining facilities would be limited to hotel guests (Dining areas in smaller hotels are generally limited to complimentary guest-only breakfast). As such, no on-site parking was provided for the dining area during site plan review. Applicant has only recently requested approval for an on-premise 2COP (beer/wide) license. While a liquor license "per se" is permitted, no parking has been provided for a bar/restaurant intended open to the general public. Applicant has indicated that the lounge will not be open to the public and has agreed to various conditions (see attached resolution) to that affect. To make these conditions enforceable, the City Commission must approve a resolution amending the site plan accordingly. RECONYMENDATION Approval, as per the attached resolution. i� Za,c L 0/6)
