RESOLUTION NO. 2004-035
A RESOLUTION OF THE CITY OF DANIA BEACH, FLORIDA,
APPROVING AN AMENDMENT TO RESOLUTION NO. 2002-066
ADOPTED MAY 14, 2002, TO AMEND THE SITE PLAN REQUEST AND
VARIANCE REACTIVATION FOR THE "HILTON GARDENS INN",
SUBMITTED BY ROBERT I. MACLAREN OF OSBORNE & OSBORNE,
PA, REPRESENTING NICK ECONOMOS, OWNER, CO-ED-
ECONOMOS PROPERTIES, INC. OWNER OF PROPERTY LOCATED
NORTH OF STIRLING ROAD, ON THE EAST SIDE OF SW 18TH
AVENUE AND SOUTH OF SW 1ST STREET (80 SW 18TH AVENUE),
DANIA BEACH SUCH AMENDMENT PERTAINING TO SALES OF
ALCOHOLIC BEVERAGES FOR ON-PREMISES CONSUMPTION BY
HOTEL PATRONS; PROVIDING FOR CONFLICTS; FURTHER,
PROVIDING FOR AN EFFECTIVE DATE.
BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA
BEACH, FLORIDA:
Section 1. That certain application (SP-17-00, Resolution 2000-095) for site
• plan approval, a copy of which was attached and made a part of Resolution 2002-066
as Exhibit "A" is amended, and such Resolution is also amended, to add the following
conditions:
a) Alcoholic beverages shall not be sold, offered for sale or furnished
to any non-patron of the hotel.
b) No signage indicating that a lounge or bar exists shall be permitted
except within the building or the hotel premises, and shall only be
displayed in a manner that is visible to hotel patrons and guests.
c) No advertising in any type of media shall be permitted, which
represents that such beverages are offered for sale to non-patrons
of the hotel.

• d) No live entertainment in the restaurant, lounge or bar areas is
permitted.
Section 2. That all resolutions or parts of resolutions in conflict with this
resolution are repealed to the extent of such conflict.
Section 3. That this resolution shall be in force and take effect immediately
upon its passage and adoption.

SUBJECT: A resolution approving amending the site plan and
variance approvals for the "Hilton Gardens Inn"
pertaining to sales of alcoholic beverages for on-
premises consumption by hotel patrons (Property
located on SW 18th Avenue north of Stirling)
At the time of site plan and variance approval, the hotel developer
represented that access to dining facilities would be limited to hotel
guests (Dining areas in smaller hotels are generally limited to
complimentary guest-only breakfast). As such, no on-site parking was
• provided for the dining area during site plan review.
Applicant has only recently requested approval for an on-premises
4COP (liquor) license. While a liquor license "per se" is permitted, no
parking has been provided for a bar/restaurant intended to be open to
the general public.
Applicant has indicated that the lounge will not be open to the public
and has agreed to various conditions (see attached resolution) to that
affect. To make these conditions enforceable, the City Commission
must approve a resolution amending the site plan accordingly.
RECOMMENDATION
Approval, as per the attached resolution.
