A RESOLUTION OF THE CITY OF DANIA BEACH, APPROVING A
VARIANCE FOR WALL SIGN AS SUBMITTED BY SHELLEY EICHNER
OF CALVIN GIORDANO AND ASSOCIATES REPRESENTING NAC
INVESTORS, LLC, FROM CHAPTER 28, ZONING,ARTICLE 28.095, FOR
PROPERTY GENERALLY LOCATED AT THE "VILLAS AT HARBOR
ISLES" ON THE WEST SIDE OF RAVENSWOOD ROAD AT
GULFSTREAM WAY, DANIA BEACH; PROVIDING FOR CONFLICTS;
FURTHER, PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the Dania Beach Code of Ordinances, Chapter 28, Zoning, Article 28
Signs, Section 28.095 sets the signage regulations for Residential multi-unit complexes or
communities in the City of Dania Beach; and
WHEREAS, Shelley Eichner of Calvin Giordano and Associates, representing NAC
Investors, LLC, has applied for a variance (VA-82-03) to allow an entry wall sign
approximately 10 feet high. Chapter 28, Article 28.095 (2) states that the height of the wall
section bearing the sign shall not exceed eight (8) feet. Property generally located at the
Villas at Harbor Isles on the West Side of Ravenswood Road at Gulfstream Way, Dania
Beach; and
WHEREAS, the Planning & Zoning Board on February 18, 2004, recommended
approval of the variance request based upon the criteria set forth in Chapter 28, Zoning,
Article 28, Signs, Section 28.095 of the Code of Ordinances of the City of Dania Beach;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF DANIA BEACH, FLORIDA:
Section 1. That that certain application VA-82-03, from requirements in Chapter
28 Zoning, is approved.
Section 2. That all resolutions or parts of resolutions in conflict with this resolution
are repealed to the extent of such conflict.
Section 3. That this resolution shall be in force and take effect immediately upon its
passage and adoption.

Calvin Giordano requests a variance for the wall height at Griffin Lakes
Ravenswood. In order to authorize any variance from the terms of the City code, the city
commission must and shall find: -------
A. That special conditions and circumstances exist which are peculiar to the land,
structure or building involved and which are not applicable to other lands,
structures or buildings in the same zoning district;
Applicant states that the topographic conditions on the subject property
are different than in the surrounding area. The older developed areas are
basically at the same grade as the adjacent roadways and sidewalks. Due
to engineering design requirements and permit regulations, the subject
area lies 2 feet lower than the grade at Ravenswood Road. This causes the
look of the entry wall/signs to look"squatty." In order to create a normal
aesthetically pleasing entry that is not out of scale, an additional 2 feet of
height is necessary on the columns only. By only increasing the height of
the columns,the perceived mass of the current wall will be reduced.
B. That the special conditions and circumstances do not result from the actions of
the applicant'
Applicant states that the request is a result of engineering and permitting
regulations, specifically related to surface water management
requirements (elevations).
C. That granting the variance requested will not confer on the applicant any
special privilege that is denied by this chapter to other lands,buildings or
structures in this same zoning district;
Applicant states that the request is for several columns only, does not
increase the size of the wall or sign and is not for the perimeter wall.
Applicant is unaware of any other sites in the neighborhood that
experience the same topographic issues that would necessitate a variance.
D. That literal interpretation of the provisions of this chapter would deprive the
applicant of rights commonly enjoyed by other properties in the same zoning
district under the terms of this chapter and would work unnecessary and undue
hardship on the applicant;

® to scale and not require a variance. The wall was designed and apptoyed
according to code but once constructed,the scale problem became
obvious.
E. That the variance granted is the minimum variance that will make possible the
reasonable use of the land,building or structures;
Applicant states that raising several columns 2 feet to make up the 4 foot
deficit in scale is the minimal solution to the problem and would alleviate
the need to redesign and reconstruct the wall.The elevation of the site can
not be raised the necessary 2 feet due to permit regulations (required
minimum elevations for drainage).
F. That the grant of the variance will be in harmony with the general intent and
purpose of this chapter, and that such variance will not be injurious to the area
involved or otherwise detrimental to the public welfare.
Applicant states that the proposed solution and variance will create a
much more aesthetically pleasing entry at an important intersection in
the City of Dania Beach. There is no detriment to the public health,
safety and welfare by granting the requested variance.

SUBJECT: VA-82-03: Request by Shelly Elchner, on behalf of Calvin
Giordano &Associates, Inc. for a variance to allow a entry wall sign
approximately 10 feet high (8 feet allowed) for a property located
on the west side of Ravenswood Road at Gulfstream Way (Griffin
Lakes).
On May 28, 2002 the City Commission approved a site plan for this project which included
437 townhouses. Construction on this project has begun.
The applicant is requesting a variance to allow the entry wall sign to exceed the maximum
allowable height of a wall by two (2) feet. The additional height will be utilized for the ten
(10) foot wide entrance sign only, which will result in an overall structural height of 10 feet.
Decorative iron work is incorporated in the design of the entry wall sign structure on the
sides and above the structure. The additional two (2) feet proposed will help articulate the
entrance to the project.
The applicant indicates the subject area lies two (2) feet lower than the grade of the land at
Ravenswood Road, which is a major arterial roadway. This causes the entry wall sign to
appear squatty'. In order to create an aesthetically pleasing, proportional entry, an
additional two (2) feet of height is necessary.
The plans submitted by the applicant identify a sign area of 32 square feet. The proposed
sign colors will match the colors previously approved for the project's perimeter wall.
The applicant has proposed Royal Palms, Fern Palms and Fan Palms as well as a variety of
flowering hedges and ground cover as the landscape treatment around the proposed
entrance sign.
