HomeMy WebLinkAboutR-2004-044-Extending Charter Review Board RESOLUTION NO. 2004-044 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, EXTENDING THE EXISTENCE OF THE CITY CHARTER REVIEW BOARD CREATED PURSUANT TO RESOLUTION NO. 2003-048; PROVIDING FOR CONFLICTS; FURTHER PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City Commission determined that there is a need to investigate the possibility of making certain changes in the City of Dania Beach Charter; and WHEREAS, the City Commission adopted Resolution No. 2003-048, which established a Charter Review Board; and WHEREAS, the City of Dania Beach Charter Review Board will automatically dissolve ten months after its creation unless its existence is extended; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA: Section 1. That the City of Dania Beach Charter Review Board is hereby extended until June 1St, 2004. Section 2. That all resolutions or parts of resolutions in conflict with this resolution are repealed to the extent of such conflict. Section 3. That this resolution shall be in force and take effect retroactively to January 25t", 2004. PASSED AND ADOPTED on March 9, 2004. AN SBRO CITY ATTORNEY 1 RESOLUTION NO. 2004-044 RESOLUTION NO. 2003-048 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, CREATING A CITY CHARTER REVIEW BOARD; PROVIDING FOR THE APPOINTMENT OF MEMBERS, POWERS AND DUTIES OF THE BOARD, AND FOR BOARD RECOMMENDATIONS; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City Commission has determined that there is a need to investigate the possibility of making certain changes in the City of Dania Beach Charter; and WHEREAS, the City Commission is desirous of receiving input from the citizens of the City of Dania Beach regarding proposed changes, and; WHEREAS, the City Commission has determined the need for an Advisory Board to function in this liaison capacity; and r WHEREAS, the City Commission has the authority to amend the Charter in a number of respects in accordance with the provisions of Florida law; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA: Section 1. That the City Charter Review Board is hereby established. The composition and function of the Charter Review Board are as follows: a) There shall be a Charter Review Board appointed by the members of the City Commission and the Board shall consist of ten (10) members. The Mayor and each Commissioner shall appoint two (2) members. The terms of the members shall commence upon their appointments and shall terminate upon the acceptance by the City Commission of the Board's Report, or as otherwise provided below. 1 RESOLUTION NO. 2003-048 b) Each person selected to serve on the Board shall meet the criteria and • serve in accordance the provisions contained in Part Xl, Article 3, Section 1 of the City Charter. Any vacancy occurring shall be filled by the appointing member of the City Commission for the remainder of the Board member's unexpired term. All members of the Charter Review Board shall be electors of the City. c) The powers and duties of the Charter Review Board shall consist of advising the City Commission of the areas of the current City Charter in need of change, and advising of specific changes as recommended by a majority vote of the City Charter Review Board. The recommendations of the Board, whether informal or formal and whether upon majority vote or in the course of discussion, shall be of advisory nature only and shall not be binding upon the City Commission. The Charter Review Board shall be empowered to conduct a comprehensive study of all phases of the Charter. The ® . Board shall submit its report of recommendations to the City Commission within 10 months from the date of appointment of the last member of the Board. d) Each appointed board member shall serve at the pleasure of the Commissioner appointing him or her and shall remain on the board until removed by the Commissioner who appointed him or her or, until such time as the appointing Commissioner no longer holds office. e) Board members shall serve without compensation but may receive necessary expenses as approved by the Commission and supported by proper documentation. f) The Commission, from time to time, may appoint advisors to the Board. 2 RESOLUTION NO. 2003-048 Section 2. That recommendations of the Board shall be made within 10 months ® from the date of appointment of the last member of the Board, at which time the Charter Review Board will automatically be dissolved unless extended by resolution of the City Commission. Section 3. That all resolutions or parts of resolutions in conflict with this resolution are repealed to the extent of such conflict. Section 4. That this resolution shall be in force and take effect immediately upon its passage and adoption. PASSED AND ADOPTED ON MARCH 25, 2003.
