HomeMy WebLinkAboutR-2004-047-addendum to interlocal agreement MPO RESOLUTION NO. 2004-047 ® A RESOLUTION OF THE CITY OF DANIA BEACH, FLORIDA, AUTHORIZING THE PROPER CITY OFFICIALS TO EXECUTE AN ADDENDUM TO THE EXISTING INTERLOCAL AGREEMENT PERTAINING TO THE CREATION OF THE BROWARD COUNTY METROPOLITAN PLANNING ORGANIZATION (THE"MPO"); PROVIDING FOR CONFLICTS; FURTHER PROVIDING FOR AN EFFECTIVE DATE. BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA: Section 1. That the proper City officials are authorized to execute an Addendum to the existing Interlocal Agreement pertaining to the creation of the Broward County Metropolitan Planning Organization (the"MPO"), to allow for the addition of the name of the City of Dania Beach to the list of participant municipalities in Broward County which are new members of the MPO. Section 2. That all resolutions or parts of resolutions in conflict with this resolution are repealed to the extent of such conflict. • Section 3. This Addendum to the Interlocal Agreement for the Creation of the Broward County Metropolitan Planning Organization adds the cities of Coconut Creek, Cooper City, Dania Beach, Hillsboro Beach, Lauderdale-by-the-Sea, Lazy Lake, Lighthouse Point, Pembroke Park, Sea Ranch Lakes, Weston and Wilton Manors as signatories to the Interlocal Agreement recorded in OR Book 30444, Page 1278. 2. The cities of Coconut Creek, Cooper City, Dania Beach, Hillsboro Beach, Lauderdale-by-the-Sea, Lazy Lake, Lighthouse Point, Pembroke Park, Sea Ranch Lakes, Weston and Wilton Manors agree to be subject to the terms and conditions of the Interlocal Agreement recorded in OR Book 30444, Page 1278. 3. The membership of the Broward County Metropolitan Planning Organization has been reapportioned in accordance with Section 339.175(2)(c)., Florida Statutes and the Governor of the State of Florida has been duly notified of such reapportionment. 4. The municipal membership of the Broward County Metropolitan Planning Organization as reapportioned in accordance with Section 339.175(2)(c)., Florida Statutes is as set forth on Table 1. 0. All notices, demands and correspondence to the above cities required or provided for pursuant to the Interlocal Agreement recorded in OR Book 30444, Page 1278 shall be addressed as set forth within Table 2. 6. Broward County hereby agrees to record this Addendum in the public records of Broward County. In each district, in order of population, an alternate voting member(s) is authorized to vote when the regular voting member(s) from the same district is not present. If no alternate from the district is present, any alternate municipal member may sit in place of the absent voting member. A voting member may relinquish his or her seat during a meeting to an alternate in the same district on matters pertaining to the alternate city. Y From- Jennifer Schaufele, Staff Direc r Re. MPO Reapportionment k � As you know, the MPO has encountered some problems with reapportionment. ' However, work has progressed and I am happy to report FDOT agrees that the Broward County MPO has met the statutory requirements to reapportion. While your city signed a proposed "Second Amendment" to the Interlocal " Agreement, FDOT now concurs that all that is actually necessary to attend to "updating" the Interlocal Agreement is an addendum adding the signatures of the new MPO representatives and alternates (Coconut Creek, Cooper City, Dania f , Beach, Hillsboro Beach, Lauderdale-By-The-Sea, Lazy Lake, Lighthouse Point, Pembroke Park, Sea Ranch Lakes, Weston, and Wilton Manors). We have attached the addendum for your city's review and signature. Appointees T , x from the cities listed above may participate in the February 12, 2004 meeting of the MPO as shown below, assuming cities sign and return the addendum to .00 p.m., Wednesday, February 11, 2004.
