HomeMy WebLinkAboutR-2004-057 Terminating fire Dispatch Services-Hollywood RESOLUTION NO. 2004-057 A RESOLUTION OF THE CITY OF DANIA BEACH, FLORIDA, • AUTHORIZING THE CITY MANAGER TO DELIVER A LETTER TO THE CITY OF HOLLYWOOD TERMINATING THAT CERTAIN "AGREEMENT BETWEEN CITY OF HOLLYWOOD AND CITY OF DANIA BEACH PROVIDING FOR COOPERATIVE DISPATCH CENTER", EXECUTED ON MARCH 29, 1999; AUTHORIZING THE CITY MANAGER TO EXECUTE ANY AND ALL DOCUMENTS NECESSARY TO CONTRACT FOR DISPATCHING SERVICES THROUGH BROWARD COUNTY; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City of Dania Beach entered into an "Agreement between City of Hollywood and City of Dania Beach Providing for Cooperative Dispatch Center" for provision of Fire Rescue dispatch service on March 29, 1999 (copy attached); and WHEREAS, the City of Hollywood has now entered into an inter-local agreement with Broward County providing for "Common Communications" via Motorola Print-track CAD, effective July 1, 2004, which communications equipment will be located at the combined Hollywood Fire-Rescue Station 74/Dania Beach Fire-Rescue Station 93, and WHEREAS, extensive technical, reviews, automatic aid feasibilities, vehicle and station notification devices (ZETRON) and all other required methodologies and technologies have been fully evaluated for seamless transition; and WHEREAS, the Broward County Sheriff's Office has been recognized as a national leader in dispatching fire-rescue and emergency services, with all 65 dispatchers certified as "Medical Priority Dispatchers"; and WHEREAS, the City Manager has determined that it is in the best interest of the City of Dania Beach to terminate the above described agreement with the City of Hollywood and contract with Broward County for dispatching services; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA: Section 1. That pursuant to Paragraphs 9 and 10 in that certain "Agreement Between City of Hollywood and City of Dania Beach Providing for Cooperative Dispatch Center" executed on March 29, 1999, (copy attached) the City Manager is authorized to 1 RESOLUTION NO. 2004-057 deliver a notice of termination of the agreement to the City of Hollywood, effective July 1, 2004 at 8:00 am. Section 2. The City Manager is further authorized to execute any and all documents necessary to contract for dispatching services through Broward County, and the effective date of such documents must ensure that there will be no lapse in dispatching services for the City of Dania Beach. The City Attorney shall review and approve any such documents before they are executed on behalf of the City. Section 3. That all resolutions or parts of resolutions in conflict with this resolution are repealed to the extent of such conflict. Section 4. That this resolution shall be in force and take effect immediately upon its passage and adoption. PASSED and ADOPTED this on March 23, 2004. C.K. ANSBRO CITY AT ORNEY 2 RESOLUTION NO. 2004-057 AGREEMENT • between CITY of HOLLYWOOD and CITY of DANIA BEACH Providing for COOPERATIVE DISPATCH CENTER This is an Agreement by and between the City of Hollywood, a municipal corporation of the State of Florida, its successors and assigns, hereinafter, "Hollywood", and the City of Dania Beach, a municipal corporation of the State of Florida, its successors and assigns, hereinafter "Dania Beach". WHEREAS, the City of Hollywood is currently operating a Fire Dispatch Center (hereinafter "Dispatch Center") for the purpose of providing radio dispatch services to the City of Dania Beach Fire Rescue Department; and WHEREAS, an Interlocal Agreement was originally entered into in October of 1979, whereby the City of Dania Beach, among others, agreed to pay a proportionate share of the operational costs of the Center in exchange for dispatching services; and • WHEREAS, the Cities of Hollywood and Dania Beach have operated under that agreement and subsequent renewals up to the present time; and WHEREAS, the previous agreements have expired and the Cities are desirous of entering into a new Interlocal Agreement for the continued provision of these services; and WHEREAS, the City of Dania Beach has made provision for the necessary payment in its current fiscal year budget and will continue to do so in the future pursuant to the terms of this agreement; and WHEREAS, the City of Hollywood agrees to operate the Dispatch Center during the duration of this Agreement; and WHEREAS, it is in the best interests of the citizens of Hollywood and Dania Beach that the Cities enter into this Agreement; NOW, THEREFORE, in consideration of the mutual terms and conditions, promises, • covenants and payments hereinafter set forth, Hollywood and Dania Beach agree as follows: 1. The above recitals are true and correct and are incorporated herein by reference. 2. The City of Hollywood shall provide all radio dispatch services to the Parties herein. 3. All F.C.C. and F.A.A. licenses and permits of the parties will be in the name of the City of Hollywood except licenses and permits for mobile and hand-held radios belonging to the respective parties. 4. The City of Hollywood shall hold the title to the equipment of Dispatch Center. 5. The City of Hollywood shall be responsible for the hiring, training and discharging of employees working in the operation of Dispatch Center. 6. Each party shall be responsible for custody and maintenance of all mobile, portable or hand-held radios used by its officers. 7. All costs of operating and maintaining Dispatch Center shall be paid initially by the City of Hollywood, if not covered by gift or grant, subject to the following requirements: A. The costs of Dispatch Center shall include but not be limited to, the following items: cost of operating, maintaining, installing and replacement of base and repeater stations, antennas, towers, and transmission lines; spare parts and • subsystems; insurance; dispatcher benefits and salaries; dispatch center supplies and material; depreciation of all common use equipment; all costs of collecting overdue, prorata shares of the parties herein, including, but not limited to, court costs and reasonable attorneys' fees; and such other costs as may be agreed to by the parties. B. Payments shall be made by Dania Beach annually as follows: 1. On or before January 1, 2000, Dania Beach will pay $70,400 On or before January 1, 2001, Dania Beach will pay $73,920 On or before January 1, 2002, Dania Beach will pay $77,616 On or before January 1, 2003, Dania Beach will pay $81,497 On or before January 1, 2004, Dania Beach will pay $85,572 On or before January 1, 2005, Dania Beach will pay $89,850 2. Thereafter payment shall increase by 5% per annum and shall be remitted to the City of Hollywood on or before the 1st of January of each year. 8. The terms of this agreement shall become effective by and between the signatory parties, upon the signing of either the City Managers or Mayors of the respective municipalities making up the parties herein and shall continue in force and effect, until terminated pursuant to the Agreement's terms. 9. It is understood and agreed by the parties that this contract may be terminated by either party at any time, with or without cause, upon no less than sixty (60) days written notice to the other party. 10. Whenever either party desires to give notice unto the other, it must be given by written notice, sent by certified United States mail, with return receipt requested, addressed to the party for whom it is intended, at the place last specified, and the place for giving of notice shall remain such until it shall have been changed by written notice in compliance with the provisions of this paragraph. The Broward Sheriff's Office will insure that all requirements for automatic aid and mutual aid are met. Fire records will be available under a county-wide licensing agreement with Sun Pro Fire Reporting Software. • The responsibility for providing these services by BSO would go into effect on July 1, 2004. If any delays occur during the installation of the Motorola radio system at Hollywood, transition will take place at the earliest mutually agreeable date after July 1, 2004. The Broward Sheriff's Office Fire Rescue Division will assist Dania Beach in determining the necessary alerting and computer equipment required for CAD connections and records management to meet the cutover date. In addition to BSO Fire Rescue unit, dispatch services are also currently provided to 10 municipal departments to form an effective network for the coordination of emergency services response. This service will be provided at no cost to the City of Dania Beach under the regional communications plan. The City would have the option, at any time to terminate the dispatch services provided upon providing written notice to the Sheriff.
