A RESOLUTION OF THE CITY OF DANIA BEACH
FLORIDA, APPROVING THE SITE PLAN REQUEST
SUBMITTED BY RONALD TOMIECEK, ON BEHALF OF
EQUAL SIX CORP. FOR PROPERTY LOCATED AT 600
PHIPPENM/AITERS ROAD, DANIA BEACH; PROVIDING
FOR CONFLICTS; FURTHER, PROVIDING FOR AN
EFFECTIVE DATE.
WHEREAS, Section 8.4 of Article 1 of Chapter 8 of the Code of Ordinances of the
City of Dania Beach, Florida, states that a site plan is required as a condition to the
issuance of a building permit; and
WHEREAS, Ronald Tomecek, on behalf of Equal Six Corp., has applied for site
plan approval for the proposed construction of two (2) industrial buildings and associated
parking at 600 Phippen/Waiters Road; and
WHEREAS, the Planning &Zoning Board on February 18, 2004, recommended that
the City Commission grant the site plan request (SP-64-03), based upon the criteria set
forth in Section 8.4 of Article 1 of Chapter 8 of the Code of Ordinances of the City of Dania
Beach;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF DANIA BEACH, FLORIDA:
Section 1. That that certain application (SP-64-03) for site plan approval, a copy of
which is attached and made a part of this Resolution as Exhibit"A", is approved, subject to
the following conditions:
i) Staff requires the site plan be modified to allow only permitted uses allowed in the
IR Zoning District. These uses include storage, warehouse, cabinet, carpenter,
furniture, plumbing, electrical, air conditioning, engraving, glass or home.
improvement shop within a completely enclosed building, offices, excluding medical
0 and dental offices, showroom use, excluding retail sales.

ii) Maximum height of hedge to be 4' to match fence height.
iii) Have condominium documents specify uses allowed.
It is further noted that the original Site Plan is maintained in the office of the Community
Development Department of the City of Dania Beach.
Section 2. That based upon the criteria set forth in Section 8-4(p) of Article 1 of
Chapter 8, of the Code of Ordinances of the City of Dania Beach, all site plan approvals
shall automatically expire and become null and void unless building permits are obtained
on or before 18 months from the date of this resolution.
Section 3. That all resolutions or parts of resolutions in conflict with this resolution
are repealed to the extent of such conflict.
Section 4. That this resolution shall be in force and take effect immediately upon its
passage and adoption.

SUBJECT: SP-64-03: Request by Ronald Tomecek, on behalf of Equal
Six Corp. for site plan approval to construct two (2) industrial
buildings and associated parking and variance to allow a four
(4) foot high picket fence with five (5) foot columns, located
at the 600 block of Phippen/Waiters Road (Lot 6, Block 1
College Tract, first addition and all of Tract '"G" College Tract,
third addition).
Site Plan:
Construction of two (2) industrial buildings and associated parking.
® Variance:
Allow a four (4) foot high picket fence with five (5) foot columns, maximum
allowed is four (4) feet, at front of property adjacent to Pippen/Waiters Road.
The applicant is proposing to construct two (2) industrial buildings on vacant
property located on Phippen/Waiters Road. The property has residential uses to the
north, south and west. The FEC railroad track is adjacent to the east. The property
is zoned Restricted Industrial (I-R) and has a Future Land Use designation of
Industrial. The IR zoning for this property has been in effect for 22 years.
The applicant has met with area residents who attended the Planning and Zoning
Advisory Board meeting to discuss the proposed development.
SITE PLAN
The applicant meets or exceeds minimum development requirements, including
landscaped buffers, pervious area and setbacks. The site is required to have a 30%
pervious area; the applicant is providing 33%. The applicant also exceeds the
minimum front, side and rear building setbacks. Further, the applicant provides a
25 foot greenbelt along Phippen Road, where only 10 feet is required. The applicant
also complies with parking based on industrial restricted and office uses.
® The City's Public Services and Fire Marshall staff have reviewed the applicant's
request and have found the project consistent with all code requirements.
VARIANCE
The applicant proposes a four (4) foot picket fence with five (5) foot columns along
Phippen/Waiters Road frontage. The Code allows fences in the front yard to be a
maximum of four (4) feet. The picket fence will be painted to match the buildings.
PLANNING AND ZONING ADVISORY BOAR® RECOMMENDATION
SITE PLAN
On February 18, 2004 the Planning and Zoning Advisory Board recommended
approval provided the applicant meet with the Homeowners association prior to the
City Commission meeting to review the development and to make a
recommendation regarding the fence height.

of the variance request.

the information provided on sheets 1 of 5 and 2 of 5 prepared by the
architect. Therefore the require parking differs. Please clarify use.

® 1. Indicate the minimum required 5' landscape buffer width along the north

property line next to the proposed dumpster wall and pad.
2. Provide a minimum 6' tall wall or fence and another one tree per 40 linear
feet along all the adjacent perimeter properties that have residentially
zoned or used property. Note: This refers to the front portion of the north
side and the rear portion of the south side where the residential uses are.
3. Indicate and label the proposed 2' tall berm along Phippen Road on the
engineering plans and cross section detail. Note: The proposed berm
slope must be at 3 to1 and the swale area must at least 4 to 1.
Additionally, please advise why a berm is proposed along the east
property line next to the wall on the engineering plans and not on the
landscape plans. Lastly, revise the Type D curbing to 5" high at the
parking overhangs and move the proposed meters so the proposed palms
can be planted.
4. Provide a detail of the required 8' tall masonry wall with colors and any
embellishments. Also, provide a note that all wall heights shall be
measured from the adjacent sidewalk.
5. Indicate/label all existing and proposed easements on the landscaping
plan. Also, obtain written approval from the utility easement holder if any
proposed landscaping, fences or walls are in the easements. Lastly, since
this is so close to the railroad ROW, please obtain a letter from the
• railroad providing how close a tree can be to their ROW.
6. Provide a minimum of 6' of wood for all the proposed palms. Additionally,
add one more Green buttonwood tree to the entry area between the
Green buttonwood and Silver buttonwood trees. Lastly add Jasmine by
the Orange Geiger trees to make it continuous and block the retention
area.
7. Revise the conceptual engineering plans to show all the buffers and
retention area cross sections to determine if any conflicts are between the
proposed landscaping. All landscape buffer areas require a flat level grade
planting area. Also, all retention areas must have a 4 to 1 slope.
8. Provide an additional 3 more trees to meet the tree mitigation requirement
of 6 trees above the code requirement. NOTE: This does not include the
additional trees required in comment #2. Also, obtain written approval
from the Public Works Director on the proposed relocations of the existing
Queen palms located in the street swale area.
