A RESOLUTION OF THE CITY OF DANIA BEACH, FLORIDA,
AUTHORIZING THE PROPER CITY OFFICIALS TO EXECUTE AN
AMENDMENT TO A CONTRACT WITH MCCARTNEY CONSTRUCTION IN
CONJUNCTION WITH THE HISTORIC PRESERVATION GRANT FOR
RENOVATIONS TO THE NYBERG-SWANSON HOUSE, NYBERG-
SWANSON RESTORATION PROJECT, PHASE II; PROVIDING FOR
CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the City of Dania Beach, Florida, received a Historic Preservation Grant
in the amount of $200,000.00 and is required to provide $97,525.00 in matching funds
which was authorized and approved through Resolution 2001-136; and
WHEREAS, the City of Dania Beach has identified specific restoration needs of the
Nyberg-Swanson House through the services of Anthony Abbate Architect PA, which was
authorized and approved through Resolution 2002- 075; and
WHEREAS, McCartney Construction, through an RFP process, was awarded the
restoration and construction of the restoration project in the amount of$170,216.00; and
• WHEREAS, the City has determined that additional construction costs have been
identified due to unforeseen circumstances; and
WHEREAS, all additional costs have been justified and approved by the Florida
Bureau of Historic Preservation; and
WHEREAS, with the additional costs appropriated, all costs associated with the
restoration of the Nyberg-Swanson House, including Anthony Abbate Architect PA,
McCartney Construction or any other firm, including the City of Dania Beach, will not
exceed the original grant amount of $297,525.00;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY
OF DANIA BEACH, FLORIDA:
Section 1. That the Scope of Services in the total sum of$170,216.00 pursuant to
the contract with McCartney Construction for restoration to the Nyberg-Swanson House is
authorized to be amended to reflect an additional restoration cost not to exceed
.$79,726.13.

Section 2. That upon execution of the amendment to the agreement, the Finance
Director is authorized to appropriate the budget by the amended amount in grant revenue
and appropriate the expenditure account.
Section 3. That all resolutions or parts of resolutions in conflict with this resolution
are repealed to the extent of such conflict.
Section 4. That this resolution shall be in force and take effect immediately upon its
passage and adoption.

I have reviewed the documentation describing Change Order # 6 in the February 9,
2004 transmittal from Bonnie Temchuk, Assistant to the City Manager, City of Dania
Beach. This Change Order to the August 21, 2003 construction contract between
McCartney Construction Company and the City of Dania Beach was executed on
February 4, 2004.
It is my opinion that the work included in the Change Order (replacement of the aging
and inefficient A!C units and seriously deteriorated ductwork) is necessary to the
functionality of the rehabilitated Nyberg-Swanson House. For that reason and because
this work was unanticipated prior to the initiation of construction, it would seem to
legitimately fall within the 'contingencies" category in the approved scope of work for
Grant SC248. Therefore, I recommend that Change Order #6 be approved for
expenditure of grant funding.

i have reviewed additional documentation provided by Ms. Bonnie Temchuk of the City
of Dania Beach on October 8, 2003 and December 9, 2003 relative to the August 27,
2003 Agreement between the City and McCartney Construction (Construction
Agreement). Based on the referenced additional documentation, the Construction
Agreement appears to be in full compliance with the provisions of the Historic
Preservation Grant Award Agreement for Grant No. SC248.

This is in response to your request for review of Change Orders 1, 2 and 3 to the
approved construction contract for this project. The purpose of this review is to ensure
that these changes to the approved project remain consistent with the approved scope
of work contained in the Historic Preservation Grant Award Agreement for Grant No.
SC248 and with the recommended approaches to rehabilitation set forth in The
Secretary of the Interior's Standards for Rehabilitation and Guidelines for Rehabilitating
Historic Buildincgs (Standards and Guidelines).
1 have reviewed the December 1, 2003 and November 7, 2003 payment requests and
supporting documentation submitted to the grantee by McCartney Construction for
Phase II of the Nyberg-Swanson House. Each of the three change orders is described
in detail in the supporting documentation. After reviewing referenced documentation, it
is my opinion that each of the three change orders was necessary for successful project
completion, and that all associated work was consistent with the approved scope of
work for Grant No. SC248 and in conformance with the Standards and Guidelines.
A facsimile copy of this memorandum has been provided to the grantee on this date.

I have reviewed the documentation provided for Change Orders 4 and 5 to the
.approved construction documents for Phase II of the Nyberg-Swanson House project.
After a recent telephone conversation with Mr. Ken Koch of the City of Dania Beach and
receipt, on February 2, 2004, of drawings from Mr. Koch clarifying the plan amendments
prescribed by Change Order 5 (drawings A1.3R and A2.1 R, dated October 15, 2003), it
is my opinion that both Change Orders are consistent with the approved scope of work
for Grant No. SC 248 and are consistent with the recommended approaches to
rehabilitation set forth in The Secretary of the Interior's Standards for Rehabilitation and
Guidelines for Rehabilitating Historic Buildings.

Dear Ms. Slade:
Enclosed, please find Change Order#6 regarding the air conditioning. When the air conditioning systems
were installed in the building (approximately 1992), there were no ducts installed to service the enclosed
back porch area in the crawl space beneath the first floor. When the air conditioning contractor who is
working on this restoration project checked in the crawl space for the feasibility of installing these two now
necessary ducts, he discovered that the existing duct system in place was deteriorating. The system is
comprised of round metallic/plastic ducting, an item normally installed in enclosed places such as ceiling
plenums. These ducts also have been attacked by"critters and vermin" that are able to get into the crawl
space. Both the contractor and the building inspection division agree that this ductwork should be
replaced with a new system that is appropriate for the location, one that is fabricated metal ducting which
will also include the two new ducts to service the enclosed porch area.
The contractor also recommends replacing the two package a/c units, which are over 10 years old.
These units have been repaired on a more frequent basis over the past two years (Freon loss, units
freezing up, refrigerant replacements on a regular basis). With the restoration taking place, we feel it is
necessary to keep the new elements in a constant temperature setting, which will provide longevity to the
overall project.
This change order is considered by the contractor as well as the City of Dania Beach as an overall
requirement for the restoration of this building. Therefore, we request your approval of Change Order#6.
