HomeMy WebLinkAboutR-2004-078 Zoning in Progress CRA area RESOLUTION NO. 2004-078 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, INVOKING ZONING IN PROGRESS; DECLARING THAT THE CITY IS CONSIDERING AMENDING ITS LAND DEVELOPMENT REGULATIONS TO CONSIDER AMENDMENTS TO THE REGULATION OF USES IN THE COMMUNITY REDEVELOPMENT AREA AND WITHIN ONE HALF MILE ADJACENT TO THE COMMUNITY REDEVELOPMENT AREA; PROVIDING FOR POSTING OF NOTICE; PROVIDING FOR CONFLICTS; FURTHER PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City Commission of the City of Dania Beach, Florida (the "City") desires to review the existing city land development regulations (the "regulations") to determine if there is a need to amend the regulations related to uses in the City's Community Redevelopment Area and areas within one half mile of such Area to address the applicability of the regulations to such uses as public assembly, educational, institutional and related uses; and WHEREAS, the City Commission wishes to direct staff to start developing regulations for Commission review and adoption; and WHEREAS, the City wishes to place all parties on notice that it is considering amending its regulations and that projects of parties who are considering development projects in the City Community Redevelopment Area and areas within one half mile of such Area will be reviewed for compliance with such changes as of the effective date of this Resolution; BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA: Section 1. Recitals. The above recitals are true and correct and are incorporated by reference. Section 2. Zoning in Progress. The City declares that City staff shall immediately review and recommend appropriate amendments to the City zoning and land development regulations to address the development of uses in the Community Redevelopment Area and areas within one half mile of such Area, including public assembly, educational, institutional, and related uses. The proposed amendments to the regulations, if adopted, will amend the City Code of Ordinances. Parties who contemplate the development of properties in the Community Redevelopment Area and areas within one half mile of such Area will be reviewed, as of the effective date of this Resolution, for compliance with the provisions of the proposed amendments to the regulations. All affected property owners are placed on notice that any application for development filed after the effective date of this Resolution within the City Community 1 RESOLUTION NO. 2004-078 Redevelopment Area and areas within one half mile of such area shall be subject to • review pursuant to the requirements of the proposed amendments to the regulations. Zoning in progress shall be in effect for three months, unless extended by the City Commission. Section 3. Public Notice. A copy of this Resolution shall be posted at City Hall. Section 4. That all resolutions or parts of resolutions in conflict with this resolution are repealed to the extent of such conflict. Section 5. That this resolution shall be in force and take effect immediately upon its passage and adoption. PASSED AND ADOPTED on April 27th, 2004. C.K. This is intended to give the Community Development Department sufficient time to address the need, if any, for new or revised land development regulations for land uses such as those involving public assembly, educational, institutional and related uses which exist or may wish to locate within the locale. This is ready for City Commission consideration and adoption at its April 27, 2004 regular City Commission meeting. 566.028 TJA:slw Attachment
