A RESOLUTION OF THE CITY OF DANIA BEACH, APPROVING THE
VARIANCE REQUEST SUBMITTED BY PASTOR JUAN G. CUEVAS,
REPRESENTING MARANATHA HOUSE MINISTRIES, FROM CHAPTER
28, ARTICLE 6, "OFF-STREET PARKING REQUIREMENTS", FOR
PROPERTY LOCATED AT 56 NORTH FEDERAL HIGHWAY, DANIA
BEACH; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN
EFFECTIVE DATE.
WHEREAS, the Dania Beach Code of Ordinances, Chapter 28, Article 6, sets the
Off-Street Parking requirements for the City of Dania Beach; and
WHEREAS, Pastor Juan G. Cuevas, representing the Maranatha House Ministries,
has applied for a variance (VA-03-04) to operate retail and assembly room uses with 25
parking spaces where 53 spaces are required, for property located at 56 North Federal
Highway, Dania Beach; and
WHEREAS, the Planning and Zoning Advisory Board recommended approval of
variance request VA-03-04 on March 17, 2004, based upon the criteria set forth in section
10.13 of Article 10, of Chapter 28, Zoning, of the Code of Ordinances of the City of Dania
Beach;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF DANIA BEACH, FLORIDA:
Section 1. That that certain application VA-03-04, for a variance as described above
(from requirements in Chapter 28, Article 6 Off-Street Parking Requirements), a copy of
which is attached as Exhibit"A" is approved for a period of one year, subject to the meeting
use being restricted to the following hours:
Monday-Saturday: After 7:00 p.m.
Sunday: All day

iSection 2 . That all resolutions or parts of resolutions in conflict with this resolution
are repealed to the extent of such conflict.
Section 3. That this resolution shall be in force and take effect immediately upon its
passage and adoption.

SUBJECT: The applicant, Pastor Juan G. Cuevas of Maranatha
Douse Ministries, requests,a variance to operate retail
and assembly room uses with 25 parking spaces (52
spaces required) at 56 North Federal Highway.
The City Commission continued this item from the April 27, 2004 meeting to the May
12, 2004 meeting.
The applicant is currently using retail space for assembly room purposes.
Based on the best available information, the assembly room occupies 3,000
square feet. The assembly room is located on the first floor of an existing two
story retail building located on the east side of Federal Highway north of
Dania Beach Boulevard.
25 parking spaces are provided on site. Existing uses, including the
assembly room, require 53 parking spaces.
In August 2002, the City Commission approved assembly room use
pursuant to a parking appeal for this same retail space. The City
Commission, in granting the appeal, stipulated that the assembly room use
be limited to "On the Boards Playhouse," which is no longer in business at
this location.
STAFF RECOMMENDATION
Approval, subject to the following:
1) Meeting room use limited to the following hours: After 7:00 pm
Monday-Saturday and all day Sunday.
2) In addition to on-site parking, property owner shall provide at least
five additional dedicated off-street parking spaces abutting NE 1 St
Avenue within 300 feet of the site. Unity of title connecting both
parcels to be completed and recorded within 60 days of approval or
assembly room use to be discontinued.
Please note similar conditions were also included in the On the Boards
Playhouse parking appeal staff report.

Dear Planning and Zoning,
We are writing you,to explain the motives for asking for this variance. Maranatha House Ministries is a
church,which began as a prayer group in an apartment. We understand our roll in the community as a place
where the whole family can benefit from. We have seen the potential this city has to become a more
wholesome,and safer place to be in. As part of our vision and mission statement,which is to bring hope
and purpose to this,.our generation. This is a ministry that is able and willing to go hand in hand with you,
e City o Dania,to bring out the best in them.
With this in mind,we are not asking for any special privileges. We are not asking you to change any
• structure nor add parking spaces. Never in our right mind would we purposely disrespect or disturb our
neighbors. The only thing we ask is for you to grant us permission to use the already existing parking
spaces that are there. We are just beginning and there are only about 5 to 10 members,and the total of
parking spaces we use on Sundays is approximately 4.
So what happens when we grow? You may ask. As any type of business the goal is to grow,which we
eventually will.It's in our plans to carpool and get a church van to service our surrounding neighbors when
this occurs. Our plead and our prayer is that you consider this as important as it is to us. May God bless
you as you hear our heart. We are looking forward to build abetter community together.
