HomeMy WebLinkAboutR-2004-091 VA-18-04 Griffin Lakes RESOLUTION NO. 2004-091 A RESOLUTION OF THE CITY OF DANIA BEACH, APPROVING A VARIANCE FOR WALL SIGN AS SUBMITTED BY SHELLEY EICHNER OF CALVIN GIORDANO AND ASSOCIATES REPRESENTING MKN INVESTORS, LLC, FROM CHAPTER 28, ZONING, SECTION 29.10 PERVIOUS AREA REQUIREMENTS, AND CHAPTER 26, VEGETATION, SECTION 26-53(H), FOR PROPERTY GENERALLY LOCATED AT THE "VILLAS AT HARBOR ISLES" ON THE WEST SIDE OF RAVENSWOOD ROAD AT GULFSTREAM WAY, DANIA BEACH; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the Dania Beach Code of Ordinances, Chapter 28, Section 29, sets the pervious area requirements for the City of Dania Beach; and WHEREAS, the Dania Beach Code of Ordinances, Chapter 26, Vegetation, Section 26- 53(H), sets the irrigation coverage requirements for the City of Dania Beach; and WHEREAS, Shelley Eichner of Calvin Giordano and Associates representing MKN Investment, LLC, has applied for a variance (VA-18-04) as follows: 1) To allow 37% pervious area in order to allow the installation of rear yard/court yard patios for up to 427 townhouse units. Chapter 28,Zoning, Section 29.10 Pervious Area • Requirements, requires that 40 percent of the land area remains pervious. 2) To waive the requirement for 100%irrigation coverage requirement by allowing individual backyard and courtyard areas to be non-irrigated. Chapter 26, Vegetation, Section 26- 53(h). Plant material and installation requirements state that all irrigation systems shall be designed to have a minimum of one hundred (100) percent coverage with a one hundred (100) percent overlap. WHEREAS, the Planning & Zoning Board on April 21, 2004, recommended that the City Commission: 1) Grant the variance request to allow 37% pervious area; (Chapter 28, Zoning) 2) Deny the variance request to waive the 100%irrigation coverage; (Chapter 26,Vegetation) based upon the criteria set forth in Section 10.13 of Article 10, of Chapter 28, Zoning, of the Code of Ordinances of the City of Dania Beach; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA: Section 1. That that certain application VA-18-04, for a variance as described above (from requirements in Chapter 28, Zoning and Chapter 26, Vegetation), a copy of which is attached as 1 RESOLUTION NO. 2004- 091 Exhibit "A" is approved, subject to the following conditions: 1) Rear courtyard paver patios must have permeable bases; and 2) The 100 percent irrigation coverage requirement is waived by allowing individual backyard and courtyard areas to be non-irrigated,with a requirement by association documents to be individually irrigated. Section 2 .That all resolutions or parts of resolutions in conflict with this resolution are repealed to the extent of such conflict. Variance: 1) 37% pervious area (40% required) in order to allow the installation of rear yard/court yard patios for up to 427 townhouse units. 2) Waive the 100% irrigation coverage requirement by allowing individual back yard and courtyard areas to non-irrigated. On May 28, 2002 the City Commission approved a site plan for this project which included 427 townhouses. Construction on this project is ongoing. Pervious Area Variance: The applicant wishes to have the option to construct brick paver patios in the back yard of linear townhouse units and in the courtyards of the back-to-back townhouse units. Assuming all 427 unit owners avail themselves of the patio option, total pervious over the 34 acre site would be reduced by 1.07 acres. This reduces pervious area to 37.5% (40% is required by City Code as was indicated on the approved site plan). Staff directed the applicant to obtain confirmation from the Public Services Director that reducing pervious area from 40% to 37 1/2 % will have no impact to the flood routing and storage of the drainage system. Staff is still waiting for the applicant to complete this task. Irrigation Variance: Chapter 26, Vegetation, Section 26-53(h) requires all irrigation systems to provide 100% coverage for all landscape areas. This includes any and all landscaping within a condominium development. The applicant seeks to eliminate the irrigation system in the back yards of the linear town homes and in the courtyards of the back-to-back town homes. The applicant states that requiring irrigation in those areas will deprive the homeowner of enjoying their personal outdoor space at their leisure since the times of irrigation would be controlled by the master association. The back yards and courtyards of each unit are designed for personal use by individual unit owners. However; if unit owners do not manually water these areas on a regular basis, the sod and plants will die. Applicant indicates that unit owners who do not maintain their personal outdoor areas will be subject to sanctions by the master association. Although the courtyards and back yards are under the control of individual unit owners, the City still has an interest in assuring the maintenance of these areas, which collectively equal nearly two acres of the site. Also, individual unit owners will be able to lease units continuously (subject to conditions) pursuant to the condominium documents. Although this is a condominium, it is likely that a minimum percentage of the 427 units will be occupied by renters. Under these Mcircumstances, staff cannot support the irrigation variance. STAFF RECOMMENDATION Pervious Area Variance: Approval, subject to a determination by the Public Services Director that the increased pervious area will have no added impact to the overall flood routing and storage. Irrigation Variance: Denial. Variance from Section 29.10—Impervious land area requirements Request to add a 10'x10' patio in the backyards of all the linear units. The total area for the patios is 0.54 acres or 100 square feet for 235 units (23,500 square feet). The permitted flood routing calculations have been revised to include the additional 0.54 acres of impervious area. The result of the analysis shows that the patios would have virtually no impact on the water management for the project. The Griffin Lakes development includes two different types of townhomes—courtyard style units and traditional linear units. The courtyard units have patio areas as part of their units. The only opportunity for the linear units to have a patio area is in the rear of the structure. The patio area for the linear units were not originally contemplated as part of the original site plan design. However, a patio is a desirable additional option for buyers. Section 29.10 of the code requires that forty(40)percent of the land area remain pervious to effectively provide for the drainage of stormwater. This section allows the city commission to permit a variation from the impervious standards where it is demonstrated that there are no negative effects from the increase in impervious area. 2.
