A RESOLUTION OF THE CITY OF DANIA BEACH, FLORIDA, APPROVING THE
REQUEST SUBMITTED BY PETER CRESCITELLI FORAN EXTENDED APPROVAL
OF A PREVIOUSLY APPROVED VARIANCE (RESOLUTION 2002-052), WHICH
EXPIRED ON APRIL 24, 2004; PROPERTY LOCATED 510 SW 2ND AVENUE;
PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, on April 23, 2002, the City Commission approved a variance request by
Peter Crescitelli from Chapter 16, Mobile Living Units, Sec. 16-2. "Conditions for Parking
at a Residence", for property located at 510 SW 2nd Avenue, Dania Beach; and
WHEREAS, the City Commission approved the request for two years, to allow a
recreational vehicle trailer up to 30 feet in length be stored adjacent to the west lot line,
subject to the applicant connecting a 6 foot fence with the existing fence and a shadowbox
gate to the alley and along SW 2nd Avenue, to shade the shed and recreational vehicle;
and
• WHEREAS, Mr. Peter Crescitelli is requesting that a permanent variance be granted
to allow the recreational vehicle trailer to remain at the site;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF DANIA BEACH, FLORIDA:
Section 1. That the request for a permanent variance request is hereby approved,
subject to the following conditions:
1) Applicant to plant 12 foot high Travelers Palms, spaced 10 feet apart the length
of the existing slab. Landscaping to be completed within a period of 30 days.
2) Applicant to remove two rows of red bricks.
3) Variance granted to applicant will not be transferred if property sold.
Section 2. That all resolutions or parts of resolutions in conflict with this resolution
are repealed to the extent of such conflict.

passage and adoption.

RE: Variance Request to Permit the Storage of a Motor Home
in Excess of 24 Feet at a Residence
Property Zoned RD-6000 - Located At 510 SW 2nd Avenue

This item was continued from May 12 to May 25 at the request of the City Commission.
Chapter 16 of the City Code allows .unoccupied motor homes (recreational vehicle) to
be parked alongside residences provided the length of the motor home does not exceed
24 feet.
The property owner was cited in 2002 for parking a motor home that exceeds 24 feet
in length. The vehicle is stored in the rear yard of the home (see "cross-hatched" area
in attached sketch) adjacent to the west lot line. The front yard of the home is SW 2"
Avenue. The applicant subsequently applied for a variance.
In March, 2002, the Planning and Zoning Advisory Board recommended approval for a
recreational vehicle (up to 30 feet in length) adjacent to the west lot line behind the
leading edge of the home facing SW 6' Street.
In April, 2002, the City Commission approved the variance for two years, subject to
installation of a six foot shadowbox fence (See attached Resolution 2002-052). The
applicant complied with these conditions. The applicant is reapplying for the same
variance, which expired April 23, 2004.
STAFF RECOMMENDATION
None. The City Code provides no guidelines for evaluating this type of variance
request. The decision to grant or deny this type of variance is a neighborhood level
determination to be made after considering the input of the applicant and other
affected parties.

WHEREAS, the Dania Beach Code of Ordinances, Chapter 16, Mobile Living Units, Section
16-2, sets the conditions for parking at residences in the City of Dania Beach; and
WHEREAS, Peter Crescitelli has applied for a variance (VA-04-02)to permit the storage of
a motor home in excess of 24 feet, property located at 510 SW 2"d Ave., Dania Beach; and
WHEREAS, the Planning &Zoning Board on March 20, 2002, recommended that the City
Commission grant variance request VA-04-02 based upon the criteria set forth in section 10.13 of
Article 10, of Chapter 28, Zoning, of the Code of Ordinances of the City of Dania Beach;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF
DANIA BEACH, FLORIDA:
Section 1. That that certain application VA-04-02, for a variance as described above (from
requirements in Chapter 16, Mobile Living Units), a copy of which is attached as Exhibit "A" is
• approved for two years, to allow a recreational vehicle trailer up to 30 feet in length to be stored
adjacent to the west lot line, subject to the applicant connecting a 6 foot fence with the existing
fence and a shadowbox gate to the alley and along SW 2"d Avenue, to shade the shed and
recreational vehicle.
Section 2 . That all resolutions or parts of resolutions in conflict with this resolution are
repealed to the extent of such conflict.
Section 3. That this resolution shall be in force and take effect immediately upon its passage
and adoption.

I oppose the extension of the variance to allow the recreational vehicle to
stay where it is at 510 S.W. 2 Avenue because it is right beside my bedroom
window. If it goes in or out while we are sleeping, it awakens us and it
sounds like we are in a war zone.
If we are in our back yard, and it is started up, we have to smell all the
fumes from it. It has taken away our privacy. It seems much higher being
on the concrete pad that it sits on. If someone is inside it, they can look right
down on us, over our fence. On several occasions, we have had laundry
hanging on our outside clothesline and the hired help have gotten our
laundry wet and soiled from the mildew and dust from the recreational
vehicle while washing it. When I said something to the guy, he just
laughed.
When the first variance was approved on April 23, 2002, I was under the
impression that it would be parked near the alley. I had no problem with
that because it would not have bothered me. I have lived in my home since
1975 and feel that I should be able to enjoy my retirement years without the
aggravation the recreational vehicle has caused me the past three years.

hews. Dania sets these laws and don't follow them with everyone,certain
people can get away with anything. Look at the recreational vechicle at
214 S.W.6" St..'These vechicles are an eye sore. 'There is nothing beaut-
iful about this. Look at the residence at 214,not only is the house disgust-
ing and the yard out of control,it is ashamed that you have this disgusting
eye sore, and all the other neighbors keep their houses and yards nice. It
amazes to be seen that the city won't do anything about this. 'These two
houses have back alley access to their property,if they can keep these vech-
icles at their property,then they need to go in the back of their homes where
they aren't an eye sore. Dania has code enforcements,follow them,and it is
time to clean up the residence at 214 S.W. 6" St..
