A RESOLUTION OF THE CITY OF DANIA BEACH, APPROVING THE SIGN
ADJUSTMENT REQUEST SUBMITTED BY VICTORIA L'ORIGINALE,FROM CHAPTER
28, ZONING, ARTICLE 28, SIGNS, SECTION 28.160 DOWNTOWN DANIA BEACH
REDEVELOPMENT DISTRICT REGULATIONS, FOR PROPERTY LOCATED AT 212
NORTH FEDERAL HWY., DANIA BEACH; PROVIDING FOR CONFLICTS; FURTHER,
PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the Dania Beach Code of Ordinances Chapter 28 Zoning, Article 28, Signs,
Article 28, Signs, Section 28.160 Downtown Dania Beach Redevelopment District Regulations sets
the signage criteria for zoning districts within the Downtown Redevelopment District in the City Of
Dania Beach; and
WHEREAS, Domenico Apa owner of Victoria L'Originale, has applied for a sign adjustment
(SA-33-04) to allow 2 signs on an internal wall in the Downtown Dania Beach Redevelopment
District for property located at 212 North Federal Hwy., Dania Beach; and
WHEREAS, the Planning & Zoning Board on June 16, 2004, recommended that the City
Commission approve the sign adjustment request SA-33-04 based upon the criteria set forth in
Article 28, Section 28.200. "Relief from requirements; Sign Adjustment;Variances", of Chapter 28,
Zoning, of the Code of Ordinances of the City of Dania Beach;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF
DANIA BEACH, FLORIDA:
Section 1. That that certain application SA-33-04, for a sign adjustment from Chapter 28
Zoning,Article 28, Signage, Section Sign Regulations, a copy of which is attached as Exhibit"A" is
approved, with the condition that the applicant identifies when the pole sign is removed.
Section 2 . That all resolutions or parts of resolutions in conflict with this resolution are
repealed to the extent of such conflict.
Section 3. That this resolution shall be in force and take effect immediately upon its passage
and adoption.

SUBJECT: SA-33-04: Request by Domenic Apa, on behalf of Victoria
L'Original, for a sign adjustment for the property located at
212 N. Federal Highway.
Sign Adjustment
To allow 2 signs on an internal wall, 1 sign permitted on street frontage only.
This property is in the process of being renovated. On May 28, 2002 the City
Commission approved a sign adjustment to allow the construction of a monument
• sign to replace the existing pole sign.
APPLICANT'S REQUEST:
To install 2 wall signs; 1 facing the internal driveway north of the building and 1
facing the internal south property line. However, the north and south elevations
of the building do not face a roadway.
ALLOWED BY CODE:
One wall sign per street frontage only. This property has street frontage along
North Federal Highway, therefore 1 wall sign is permitted on the west building
elevation.
The Zoning Code allows the City Commission to grant sign adjustments within
the Downtown Dania Beach Redevelopment District if there is a hardship other
than those imposed by City Ordinance or the applicant and if the design
standards of the district are not compromised.
The applicant is proposing the sign on north building elevation to be 25 s.f. in size
and the sign on the south building elevation to be 6.25 s.f. in size, for a total sign
area of 31.25 s.f. The Zoning Code allows a maximum sign areas of 32 s.f.,
therefore the request does not exceed the square footage allowed for one sign.
The proposed location of the wall signs, on the north and south building elevations
would provide maximum visibility to motorists traveling on Federal Highway.
A sign located on the west building elevations, which is permitted by code, would
not be adequately viewed by motorist because of a 5 foot (approximately) building
setback.
The following items were identified as part of the Community Development staff
review:
1. Provide sign detail, including materials, methods of illumination and method
of attachment prior to building permit issuance.
2. Identify when the pole sign will be removed.
