A RESOLUTION OF THE CITY OF DANIA BEACH, FLORIDA,
APPROVING A REQUEST FOR MODIFICATION TO THE FLEX UNIT
ALLOCATION, BY MKN INVESTORS LLC, TO ASSIGN THIRTY SIX
(36) FLEX UNITS IN LIEU OF THE THIRTY SIX (36) AFFORDABLE
HOUSING UNITS PREVIOUSLY ASSIGNED TO THE GRIFFIN LAKES
PLAT ON MAY 28, 2002; THE PROPERTY IS LOCATED WEST OF
RAVENSWOOD ROAD, SOUTH OF GRIFFIN ROAD, EAST OF SW 24T"
AVENUE AND NORTH OF SW 51 COURT, DANIA BEACH; PROVIDING
FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, by separate ordinance, the City Commission rezoned the property
known as the "Griffin Lakes Plat" from T-1 (Trailer Park) and T-1A (Mobile Home Park)
to RM (Multifamily Residential) (legally described on Exhibit "A"), assigning a
combination of 72 reserve and/or affordable housing units to the Plat; and
WHEREAS, the applicant previously had requested the assignment of 36
affordable housing flex units and 36 reserve units; and
® WHEREAS, The applicant now requests permission to substitute 36 flex units in
lieu of 36 affordable housing flex units, with no change in reserve units.
BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA
BEACH, FLORIDA:
Section 1. That the City Commission approves a plat note change to
accommodate the substitution of 36 flex units in lieu of 36 affordable housing flex units
with no change in reserve units.
Section 2. That the foregoing whereas clauses are hereby ratified and
incorporated.
Section 3. That all ordinances or parts of ordinances and all resolutions or
parts of resolutions in conflict with this resolution are repealed to the extent of such
conflict.

Section 4. That this resolution shall be in force and take effect immediately
upon passage and adoption.

REQUEST: Modification of the Flex Unit Allocation (36 flex units in lieu of 36
affordable housing flex units)
LOCATION: West of Ravenswood Road, south of Griffin Road, east of
SW 24th Avenue, and North of SW 51st Court
PROPERTY SIZE: 35.58 gross acres (33.62 net acres)
• In 2002, the former Griffin Lakes Mobile Home Mobile Home Park was rezoned to from
T-1 (allowing 355 mobile homes) to R-M (allowing 427 townhouse units). In order to
allow the additional 72 units required by the zoning change, the City Commission
approved the allocation of 36 reserve units and 36 affordable housing flex units. The
project is well under construction.
At the time of initial site plan submission, the applicant had requested that 36 units of
the 427 unit project be designated as available to parsons who qualify for affordable
housing. The applicant has since submitted documentation that of the 200+ contracts
submitted, no buyer has qualified with the income requirements of affordable housing.
As such, the applicant has requested the permission to modify flex unit allocation from
36 affordable flex units to 36 flex units.
Based on the 2000 Census, the median home value in Dania Beach was $114,000. This
means that half the homes were valued at less than $114,000. Also in 2000, the
median rent in the city was $679 per month and rental units constituted 42% of the
occupied housing units.
The city figures are less than the county-wide median home value ($128,000) and
county-wide median monthly rent ($1,246 per month). County-wide, 31% of occupied
• units were rental units.

Based on the 2000 Census, the city provides its fair share of affordable housing, and
more affordable housing on a percentage basis than many cities in Broward County.
As such, staff supports the flex modification to allow 36 flex units. Harbour Villas
provides market rate housing for working families and individuals, fulfilling a city as well
as county-wide need.
Please note that there is no net change in density. The project remains as approved at
427 townhouses.

SUPPORT STATEMENT FOR GRIFFIN LAKES REZONING APPLICATION
REQUEST TO ELIMINATE THE AFFORDABLE HOUSING DESIGNATION
MAY 27, 2004
Despite concerted efforts to inform potential buyers of the availability to purchase an
"affordable" townhouse unit, no customer has either taken advantage of the opportunity
or qualified for the program.
While it was the intent to offer newly constructed affordable units in this area of Dania
Beach, the 36 units set aside could easily have been sold as regular units, helping to fund
subsequent units and required site improvements. With no sales, that funding source does
not exist. Even as all the regular units are sold and occupied, the affordable units could sit
empty for some time. Without the 36 sales, this could possibly jeopardize the ability to
close out the project with the Broward County Office of Environmental Services (OES).
OES is holding back the final 52 meters (and hence the City can not issue those
certificate of occupancies). The final pavement and other improvements must be done
prior to the final release being approved by OES. All but the 52 meters represents the
88% occupancy level. If the 36 units are added to this deficit, the occupancy level is
79%. Typically, the final lift of asphalt is applied when the project reaches 90-95%
occupancy, in order to reduce potential damages between this time and 100% occupancy.
Of the 200 + contracts that have been signed, no buyer qualified with the income
requirements of affordable housing. Nor have we turned away a buyer due to an inability
to qualify for a loan. The market town homes are in demand and all of the buyers to date
have qualified for the market units. There are a number of HUD and HFA monies
available for single-family purchases. Those resources are not only available, the dollars
applied for last year rolled over into this year's cycle due to a lack of interest or use by
qualified buyers. Although there is a lack of supply for low and very low income
housing, there is not the same demand for the moderate housing such as the 36 units.
Since the approval of Griffin Lakes, another project, Sheldon Plat, has been approved by
the City of Dania Beach that will offer "affordable" single-family units. The Sheldon
project is across Griffin Road from Griffin Lakes, behind the Sheldon Mobile Home
Park. It is not known whether this is a contributing factor to the situation at Griffin Lakes,
but the Sheldon units are intended for low or very low income buyers.
