A RESOLUTION OF THE CITY OF DANIA BEACH,
FLORIDA, APPROVING THE SITE PLAN REQUEST
SUBMITTED BY MOISES GORIN, ON BEHALF OF VILLAS
AT OAK HAMMOCK, LLC., FOR PROPERTY LOCATED AT
5353 SW 40T" AVENUE, DANIA BEACH; PROVIDING FOR
CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE
DATE.
WHEREAS, Section 8.4 of Article 1 of Chapter 8 of the Code of Ordinances of the
City of Dania Beach, Florida, states that a site plan is required as a condition to the
issuance of a building permit; and
WHEREAS, Moises Gorin, on behalf of Villas at Oak Hammock, LLC., has applied
for site plan approval for the proposed construction of 27 townhome units and associated
amenities, to be located at 5353 SW 40t" Avenue, Dania Beach; and
WHEREAS, the Planning & Zoning Advisory Board on June 16, 2004,
recommended that the City Commission grant the site plan request (SP-83-03), based
upon the criteria set forth in Section 8.4 of Article 1 of Chapter 8 of the Code of Ordinances
of the City of Dania Beach;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF DANIA BEACH, FLORIDA-
Section 1. That that certain application (SP-83-03) for site plan approval, a copy of
which is attached and made a part of this Resolution as Exhibit"A" is approved, subject to
the following conditions:
1) Provide a recorded copy of the unity of title prior to issuance of a building
permit.

2) Provide a recorded copy of the plat prior to the issuance of a building permit.
Plat modifications occurring subsequent to site plan approval may require
resubmission to the City Commission.
It is further noted that the original Site Plan is maintained in the office of the Community
Development Department of the City of Dania Beach.
Section 2. That based upon the criteria set forth in Section 8-4(p) of Article 1 of
Chapter 8, of the Code of Ordinances of the City of Dania Beach, all site plan approvals
shall automatically expire and become null and void unless building permits are obtained
on or before 18 months from the date of this resolution.
Section 3. That all resolutions or parts of resolutions in conflict with this resolution
are repealed to the extent of such conflict.
Section 4. That this resolution shall be in force and take effect immediately upon its
passage and adoption.

SUBJECT: SP-83-03: Request by Moises Gorin, on behalf of Villas at
Oafs Hammock, LLC., for site plan, variances and waiver
approval for the construction of 27 townhouse units for the
property located at 5353 S.W. 40th Avenue.
Site Plan
To construct 27 townhouse units and associated amenities.
Variance
1. Partial waiver of type "D" curbing around landscaped areas; landscape areas are
require 100% curbing.
2. To allow three foot wide landscape medians between units and along the west
perimeter; five feet required.
3. To allow a monument sign on a property with 214 feet of street frontage; A minimum
300 feet of street frontage is required to construct a monument sign for a
townhouse development.
Waiver
To reduce the pervious area from 40% to 36.7%.
Tree Removal
Approval of the proposed relocation of specimen trees, removal of specimen trees and
mitigation.
The subject properly currently has three (3) structures on the site that appear to be vacant.
The property is located in a residential multiple family (RM-15) zoning district and has a
Future Land Use designation of Medium (16) Residential. The property abuts a
condominium to the south, the Emerald Palms Rental Apartments to the north and west,
and single family homes located in the City of Hollywood to the east across SW 40t' Avenue.

SITE PLAN
® The applicant is proposing to construct 27 townhouse units, which is approximately 10 units per
acre. The RM-15 zoning permits a density of 38 units at 15 units per acre.
The applicant is providing the minimum number of parking spaces required. In addition, the
floor plan for each unit provides a one (1) car garage. The project will be gated with a
separate entrance for guests, providing 7 vehicle stacking spaces; 4 residential and 3 guests. A
community pool is provided with accessory restroom facilities. The project will be enclosed with
a vinyl fence on north and south, and a precast concrete wall on east and west.
Sidewalks will be provided along S.W. 40t' Avenue street frontage as well as on site. Lighting
will be added to illuminate the site. Provisions will be made to minimize light spillage onto the
adjacent residential properties.
Of 62 existing trees, 24 will remain, 9 will be relocated, 3 are to be replaced, and 26 are
proposed to be removed. A total of 117 trees (new and old) are proposed for the site; 107
trees are required. The 26 trees proposed for removal are summarized below.

The proposed site plan has been reviewed by various City departments. The Public Services
Director has determined that the information submitted by the applicant is acceptable for
this stage of the permitting process. The following outstanding issues have been identified:
1. Provide a recorded copy of the unity of title prior to issuance of building permit.
2. Provide a recorded copy of the plat prior to issuance of building permit. Plat
modifications occurring subsequent to site plan approval may require resubmission
to the City Commission.
VARIANCE
1. To partially waive the requirement for type "D" curbing around landscaped areas
(landscape areas require 100% curbing).
The applicant is requesting to waive the curbing requirement around most landscape areas.
Curbing is provided adjacent to guest parking and at the projects entrance.

Providing a curb in all landscape medians would reduce the 3 foot wide landscape median
® by 1 foot, resulting in a 2 foot wide median, further reducing the percentage of pervious
area provided.
Curbing is intended to protect landscaping from vehicle encroachment. The areas that will
experience the heaviest vehicle traffic and areas where guests will park will have type "D"
curbing protecting the adjacent landscape areas. In addition, because this site has several
mature trees on site, the installation of type"D"curbing in many cases would encroach into
the root system and damage the existing trees.
Staff recommends approval.
2. To allow landscape medians between units and along the west perimeter to be 3 feet
wide (Five feet required).
The applicant is preserving several existing trees and the surrounding landscape areas to
protect the tree's root and canopy area. As a result, the landscape islands are reduced
accordingly. In addition, the applicant is using the landscape median to delineate parking
for each unit, providing a median separation for every 2 parking spaces.
Staff recommends approval.
3. To allow a monument sign on a property with 214 feet of street frontage (A minimum
300 feet of street frontage is required to construct a monument sign for a
townhouse development).
The Zoning Code allows monument signs for properties with a minimum of 300' of street
frontage; the subject property has 214 feet of street frontage. The proposed monument
sign is necessary to identify the entrance of the development and will improve image of the
SW Ott' Avenue corridor. In addition, a project identification sign would promote feelings of
pride and ownership in a community, the same way neighborhood identification signs do.
Staff recommends approval of the requested variance provided the sign does not exceed 6
feet in height and 10 foot wide.
WAIVER
The applicant is requesting to provide 36.7% of the property as pervious area. Article 19 of
the City's Zoning Code requires 40% of the residential sites to be pervious to effectively
provide for the drainage of stormwater. The Code also states the following:
"Upon demonstration by an applicant that ... special conditions resulting from
the design of existing facilities or surrounding land uses are present, the City
Commission may permit variation from the impervious area standards, subject
to the following limitations:
a. Variation from the impervious requirements shall be proportional to
. mitigating design improvements provided in excess of the minimum required
engineering and landscaping standards.

If a variation is granted, the impervious area shall not exceed 85% for industrial
uses, 80% for commercial uses and 70% for residential uses."
The Public Services Director (see attached) has determined that the information provided by
the applicant is consistent with the mitigating improvements suggested in the Zoning Code
and recommends approval of the waiver. The Public Services Director also recommends the
applicant provide the utilization of paving blocks wherever possible to promote groundwater
percolation.

The City Landscape Consultant recommend the applicant provide $60,800.00 to the City of
Dania Tree fund for the proposed removed trees or add nine 8 DBH Florida Grade # 1 Live
Oak trees to site. Based on the site plan, there is only sufficient room to add three 8" Live
Oaks.
PLANNING AND ZONING ADVISORY BOARD RECOMMENDATION

Approve provided a dedication of $60,800.00 is made to the City of Dania Tree fund for the
proposed removed trees prior to building permit, add nine 8" to 9" DBH Florida Grade # 1
Live Oak trees to site prior to issuance of a certificate of occupancy, or any combination of
money and/or trees to be identified on a signed and sealed landscape plan prior to issuance
of building permit.
STAFF RECOMMENDATION
SITE PLAN:
Approval subject to site plan conditions discussed above.
VARIANCE:
1. Curbing: Approve.
2. Landscape median: Approve.
3. Monument sign: Approve sign measuring 6 feet in height and 10 foot wide.
WAIVER
The Public Services Director recommends approval, subject to the applicant providing
further groundwater recharge by promoting the utilization of paving blocks, location of
paving blocks to be determined by Public Services Director prior to issuance of a building
permit.
TREE REMOVAL
Option 1: Provide a dedication of$60,800.00 ($6,755 per tree X 9 trees) to the City of Dania
Beach Tree fund for the trees to be removed; or
Option 2: Plant three Live Oak trees and provide $40,530 ($6,755 X 6 trees) to the City of
Dania Beach Tree fund for the trees to be removed.

Site Plan
1. Building elevations do not match the floor plan and site plan for the 7 unit
buildings. Please Modify. -The site plan, building elevations, and floor plans
have been modified and are now consistent on Sheets AS-001, A-101,A-102, A-
103, A-201, A-202, and A-203.
2. Provide recorded copy of the plat prior to this project being scheduled for a
Commission Agenda (Planning). -This information is in process.
3. Provide color rendering of all sides of building and wall (Planning). This
information has been added to the Package.
4. Recommended the proposed Magnolia trees be "little jem(landscape). —This
recommendation has been revised on sheets L-1, L-2

Also the 6 comments below are the latest engineering comments I received for this project, dated 5-10-
04. Based on these comments and others, we will most likely be recommended continuance of the site
plan request until we received written verification from you that these items have been addressed.
1. Submitted landscape plan is lacking an irrigation plan in accordance with Dania
Beach Code Chapter 8, Sec. 8-4 (Public Services).
2. Drawing 3 of 9 Drainage Structure description showing no slope, plan
description showing slope of 0.67%, please clarify (Public Services).
3. Proposed site is located in 316 Utilities Analysis Zone of Broward County Office
of Environmental Services. Design, size, location and connection of proposed lift
station to existing sanitary sewer must be approved (stamp) by Environmental
Engineering Office of OES (Public Services).
4. Location of backflow prevention devises must be shown on the drawings. It is
required by the City Code Sec. 27-9 & the Florida Administrative Code 62-
555.360 that a backflow prevention device be installed on all supply line services
(Public Services).
5. All meters shall be furnished and installed according to Sec. 27-9 of the City
Code (Public Services).
6. Variance can be considered if engineer provides pre flows & post flows (Public
Services).

Clarification to Landscape Comment by Bill tesauro

Dear Manny:
Bill Tesauro "recommended" I change the Sweet Bay Magnolia trees
in my design to Magnolia "Little Jem" . I called and talked to
Bill. He agreed to leave my choice the Sweet Bay because of
my concerns for wet conditions.
He said at the"time of planting" if the trees were high enough
out of the swale he might again request changing them to his
• "suggested" verity "Little Jem" . He promised me though that
he would approve my plant choice for this submittal.
