HomeMy WebLinkAboutR-2004-141 Stirling suites plat note delegation request RESOLUTION NO. 2004- 141 A RESOLUTION OF THE CITY OF DANIA BEACH, FLORIDA, APPROVING THE DELEGATION REQUEST SUBMITTED BY BENITO IRASTORZA ON BEHALF OF B & JCM PROPERTIES, LLC. TO CHANGE THE PLAT NOTE ON THE STIRLING SUITES PLAT; PROPERTY LOCATED ON THE NORTHWEST CORNER OF 1-95 AND STIRLING ROAD, DANIA BEACH; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, Benito Irastorza on behalf of B & JCM Properties is the owner/applicant for property located on the northwest corner of 1-95 and Stirling Road known as the "Stirling Suites" Plat, (Development Management Division File No. 058- MP-02); and WHEREAS, Mr. Irastorza has requested a delegation request to amend the note on the plat from 158 hotel rooms to 201 hotel rooms. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA: Section 1. That the City Commission of the City of Dania Beach, Florida, approves the delegation request submitted by Benito Irastorza on behalf of B & JCM Properties, amending the plat note on the Stirling Suites Plat to read: From — "THIS PLAT IS RESTRICTED TO HOTEL USE - 158 UNITS." To — "THIS PLAT IS RESTRICTED TO A MAXIMUM OF 201 HOTEL ROOMS." Section 2. That all resolutions or parts of resolutions in conflict with this resolution are repealed to the extent of such conflict. Delegation Request: To amend the plat note from 158 hotel rooms to 201 hotel rooms. The subject property is zoned Industrial (IROM) and has an Industrial Land Use designation. The subject plat is currently vacant, however, a site plan has been submitted to the City and is currently under staff review for the construction of a 102 room hotel. The applicant wishes to construct two (2) hotels on the subject property. The IROM zoning district requires hotels to be constructed with at least 100 rooms. In order for the applicant to build two (2) hotels, the plat note must be amended to permit additional hotel rooms. The following comments are from Community Development: 1. Revised plat note to read "This plat is restricted to a maximum of 201 hotel rooms". 2. Revise signature sheet to include the following statement as required by Broward County, "No building permits shall be issued for the construction, expansion, and/or conversion of a building within this plat until such time as the development provides this municipality with written confirmation from Broward County that all applicable impact fees have been paid or are not due." Page 1 of 2 STAFF RECOMMENDATION Approval, provided the following items are addressed rior to this item being scheduled for the City Commission agenda. 1. Revise plat note to read ""This plat is restricted to a maximum of 201 hotel rooms". 2.
