A RESOLUTION OF THE CITY OF DANIA BEACH APPROVING THE
VARIANCE REQUEST SUBMITTED BY GUSTAVO CARBONELL, P.A., ON
BEHALF OF RICHARD STOFF,REPRESENTATIVE/PROPERTY OWNER OF
DNC PROPERTIES, LLC, FOR PROPERTY LOCATED AT 2201 GRIFFIN
ROAD, DANIA BEACH, FROM CHAPTER 28, "ZONING", ARTICLE 6,
"SCHEDULE OF OFF-STREET PARKING REQUIREMENTS"AND ARTICLE 4,
"DISTRICT REGULATIONS", "SCHEDULE OF LOT, YARD AND BULK
REGULATIONS"; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING
FOR AN EFFECTIVE DATE.
WHEREAS, Chapter 28, Zoning, Article 6 ("Schedule of Off-Street Parking
Requirements") sets the parking requirements in the City of Dania Beach; and
WHEREAS,Chapter 28,"Zoning",Article 4,("District Regulations") sets the lot,yard and
bulk regulations for the City of Dania Beach; and
WHEREAS, Gustavo Carbonell, P.A. on behalf of Richard Stoff, representative/property
® owner of DNC Properties, LLC., has applied for a variance (VA-49-04) requesting the following:
1. To provide 6 parking spaces where 7 are required (Chapter 28, "Zoning", Article 6,
"Schedule of Off-Street Parking Requirements"); and
2. To provide a 1 foot east side setback where 10 feet is required(Chapter 28,"Zoning",Article
4 "District Regulations", "Schedule Of Lot, Yard And Bulk Regulations"),
for property located at 2201 Griffin Road, in the City of Dania Beach; and
WHEREAS,the Planning&Zoning Board on October 20,2004,recommended that the City
Commission grant variance request VA-49-04 based upon the criteria set forth in section 10.13 of
Article 10, of Chapter 28, "Zoning", of the Code of Ordinances of the City of Dania Beach;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF DANIA BEACH,FLORIDA:
Section 1. That application VA-49-04,for the variances described above,a copy of which is
attached as Exhibit"A"is approved, provided the applicant removes the existing pole sign prior to

• the issuance of any building permits.
Section 2. That all resolutions or parts of resolutions in conflict with this Resolution are
repealed to the extent of such conflict.
Section 3.That this Resolution shall be in force and take effect immediately upon its passage
and adoption.

SUBJECT: VA-49-04: The applicant, Gustavo Carbonell, P.A., on behalf
of the property owner DNC Properties, LLC, requests
variances to waive parking and side setback requirements
for a 412 square foot addition to an existing building
located at 2201 Griffin Road.
The subject property is zoned Commercial (C-2) and has a Commercial Land Use
designation. The applicant has indicated the new use will be the sale of motorcycle
accessories, parts and related boutique items. Staff has advised the applicant that
the sale, service, storage, or repair of motorcycles is prohibited in C-2 zoning.
The structure was originally built as a residence and subsequently converted to
commercial use. Previous uses of the site include a construction office and a pet
store. The site abuts a gasoline service station located to the east, Harbor Islands
townhomes to the south (across Griffin Road), a vacant commercial building to the
west and a single family home to the north.
The existing site provides zero (0) feet of landscaping adjacent to Griffin Road. The
applicant is proposing to provide a total of 8 feet of landscaped area between the
parking lot and adjacent sidewalk. When redesigning the parking lot the applicant
has added the maximum amount of landscaping reasonable. Currently there is a
pole sign located at the south east corner of the property that is prohibited by the
City's Zoning Code and must be removed.
The applicant is providing pervious area equal to 33% of the site; 30% is required.
The applicant is also meeting the 35% window area requirement for structures facing
principal arterial roadways. The addition will be 412 square feet and therefore does
not require site plan approval. However, because of site constrains two variances
are being requested.
VARIANCE 1: Provide 6 parking spaces where 7 are required.
® The existing parking configuration does not conform to toda 's regulations regarding

parking dimensions, back out area or landscape buffers. The applicant has
redesigned the parking lot to conform to the City's regulations and in the process
has lost 4 parking spaces.
The applicant is required to provide 7 parking spaces based on the square footage
of the existing building and addition. The applicant has redesigned the parking lot
and is able to provide 6 parking spaces. Redesigning the parking lot has allowed
the applicant to provide additional landscaping and safer ingress/egress onto the
site. In addition, the applicant has provided a 3 foot bump-out for the handicapped
parking space for additional back-out area 2 trees located between the parking lot
and sidewalk. Staff is requesting the removal of the existing pole sign prior to
issuance of a building permit. Based on the above discussion, staff supports the
applicant's request.
VARIANCE 2: Provide a 1 foot east side setback where 10' is required.
The existing building abuts a gasoline service station to the east (one foot setback)
and a single family house (10 foot setback) to the north. The existing building sits on
a slight angle to the property lines. The proposed addition will provide a setback
between one (1) foot and one foot seven inches (17") from the east property line.
The minimum side setback for commercially zoned property is 0 feet, or 10 feet if
any setback is provided. Because the code permits a zero foot setback and the
addition is following the line of the existing building, staff supports the applicant's
request.
PLANNING AND ZONING BOARD
On October 20, 2004 the Planning and Zoning Board recommended approval of the
requested variances subject to staffs conditions.
STAFF RECOMMENDATION
Approval of the parking and landscape variance provided the applicant removes the
existing pole sign prior to issuance of any building permits.

T his narrative is in reference to a variance we are requesting for the above referenced
property. The land currently has an existing one story 1,253 s.f building. The current
building area is not sufficient in order for our client to efficiently conduct business,
therefore an additional 412 s.f of area has been proposed. With the increase in area, we
are one parking stall short of meeting the requirement; as a result we are requesting a
variance for the additional parking stall required.
We are also requesting the granting of a variance for a reduction to aft-Oin. -5ft-8"in lieu
of the 15ft-landscaped buffer that is required along the south property line abutting
Griffin Rd.
We are requesting a variance for a reduction of the required sideyard setback from 1 Oft to
1 ft-7in. along the east property line.
A variance should be considered because of the following:
(A) That special conditions and circumstances exist which are peculiar to the
land, structure or building involved and which are not applicable to
other lands, structures or buildings in the same zoning district;
This property was originally a single-family residence. This property is unique
in comparison with other C-2 zoned properties because,it was once a single-
family dwelling and was not always used for business.
The property was also originally 30ft deeper than how it is presently. Because
of the R.O.W expansion along Griffin Rd., 30ft of the property was dedicated
to accommodate the expansion of the R.O.W. Because the property lost 3Oft
Of depth along Griffin Rd, we are unable to accommodate the required 1 Oft.
landscape buffer and the required amount of parking stalls needed for this
development. The existing east wall is approximately 13in. off the east
property line. The proposed additions east wall, which is 191n. off the east

property line, is flush with the existing masonry wall in order to provide
sufficient area to conduct daily business activities.
(B) That the special conditions and circumstances do not result from the
actions of the applicant;
The property was originally occupied as a single-family dwelling. The land is
zoned C-2 and with the current zoning requirements it is extremely difficult
for the business owner to efficiently function without upgrading the building.
The property in its present stage cannot accommodate the daily activities of a
small business without some form of alteration and relief from new zoning
requirements.
(C) That granting the variance requested would not confer on the applicant
any special privilege that is denied by this chapter to other lands, buildings
or structures in this same zoning district;
By granting this variance, our client is not being granted any special privileges than
any other lands,buildings, or structures in this same zoning district. The adjacent
properties are currently business establishments. This development will also be a
business establishment. Several businesses along this corridor are also non-
conforming.
(D) That literal interpretation of the provisions of this chapter would deprive
the applicant of rights commonly enjoyed by other properties in the same
zoning district under the terms of this chapter and would work unnecessary
and undue hardship on the applicant;
This property, which was originally a home and later became a commercial use
similar to adjacent properties is non-conforming and requires consideration. The
proposed improvements will enhance the property and bring some items up to present
code such as, the handicap accessible ramp, bathroom, and doors.
(E) That the variance.granted is the minimum variance that will make
possible the reasonable use of the land, building or structure;
The variance requested is the minimum to allow a small business to function. Most of
the building area will be used for stock not accessible to the public. We do not
anticipate a tremendous amount of traffic to and from this development. The space
being added is the minimum area needed to maintain the proper amount of stock
necessary for the business to function.
(F) That the grant of the variance will be in harmony with the general
intent and purpose of this chapter, and that such variance will not be
injurious to the area involved or otherwise detrimental to the public
welfare.
Granting the variance will not be detrimental to the public or-immediate area. The
remodeling and expansion of the existing structure will have a positive impact on the
immediate area because of the following:
1- The development currently has (2) curb cuts along Griffin Rd. The curb cut to the
east is in very close proximity to the curb cut for the commercial property directly
east of this development. We are proposing a single 24ft wide curb cut along the
south west property line, with a 29ft access easement for the property to the west
of this development. This condition eliminates the possibility of having too many
curb cuts within close proximity to each other for future development of the
property to the west.
2- The south property line currently does not have any landscape buffer along
Griffin Rd. Even though we do not meet the 1 Oft landscape buffer that is required,
the proposed landscape along the south property line is a tremendous
improvement from the present condition.
3- The existing structure currently resembles an outdated single family home that
lacks curb appeal. We are proposing to enhance the south elevation with new
window treatments and architectural elements such as, stucco banding, reveals,
and color which is an improvement to the existing conditions.
4-The east wall for the proposed addition will not have any exterior openings
and will be fire rated as to not have any harmful affects on the property
directly east.
