HomeMy WebLinkAboutR-2004-201 Site Plan Modification L'Originale RESOLUTION NO. 2004-201 A RESOLUTION OF THE CITY OF DANIA BEACH FLORIDA APPROVING MODIFICATIONS TO THE APPROVED SITE PLAN (SP-20-01) SUBMITTED BY DOMINIC APA, REPRESENTING VICTORIA L'ORIGINALE, INC., FOR PROPERTY LOCATED AT 212 NORTH FEDERAL HIGHWAY, DANIA BEACH; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, Section 8.4 of Article 1 of Chapter 8 of the Code of Ordinances of the City of Dania Beach, Florida, states that a site plan is required as a condition for the issuance of a building permit; and WHEREAS,Dominic Apa,representing Victoria L'Originale,has applied for a modification to the site plan (SP-20-01) relating to the reduction of landscaped area associated with the construction of a 4,500 square foot retail building and a 4,800 square foot warehouse building for property located 212 North Federal Highway, Dania Beach; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA: Section 1. That the proposed modification to site plan(SP-20-01)relating to the reduction of landscaped area associated with the proposed construction of a 4,500 square foot retail building and a 4,800 square foot warehouse building at 212 North Federal Highway, Dania Beach is approved, subject to the following conditions: (1) Installation of three planter pots, with the location to be determined by City staff, and (2) To remove the white concrete blocks and replace them with palm trees. Section 2. That based upon the criteria set forth in Section 8-4(p)of Article 1 of Chapter 8, of the Code of Ordinances of the City of Dania Beach, all site plan approvals shall automatically 1 RESOLUTION NO. 2004-201 expire and become null and void unless building permits are obtained on or before 18 months from the date of adoption of this Resolution. Section 3. That all resolutions or parts of resolutions in conflict with this Resolution are repealed to the extent of such conflict. Section 4. That this Resolution shall be in force and take effect immediately upon its passage and adoption. PASSED AND ADOPTED on November 23, 2004. .K. Federal Highway. The original site plan showed landscaping between the front building and the public sidewalk, this area is currently paved. The applicant is proposing to maintain the existing concrete slab in front of the building. ® Staff believes the original plan should be followed providing p g landscaping between the front building and the public sidewalk. The proposed landscaping will help soften the building, increase the landscaping adjacent to the public sidewalk and improve the pedestrian experience. STAFF RECOMMENDATION Denial.
