HomeMy WebLinkAboutR-2004-212 First Baptist Church RESOLUTION NO. 2004-212 A RESOLUTION OF THE CITY OF DANIA BEACH, FLORIDA, APPROVING THE REQUEST FOR MODIFICATIONS TO SITE PLAN SP-07-03,APPROVED ON JULY 27, 2004, SUBMITTED BY RICHARD AUSTIN AS THE AGENT REPRESENTING THE FIRST BAPTIST CHURCH OF DANIA HOLDING COMPANY, INC., FOR PROPERTY LOCATED AT 201 EAST SHERIDAN STREET, DANIA BEACH; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, Section 8.4 of Article 1 of Chapter 8 of the Code of Ordinances of the City of Dania Beach, Florida, states that a site plan is required as a condition for the issuance of a building permit; and WHEREAS, Site Plan SP-07-03 was approved by Resolution 2004-124 on July 27, 2004, for the construction of a house of worship and associated parking lot for property located 201 East Sheridan Street, Dania Beach; and • WHEREAS, Richard Austin as the agent representing the First Baptist Church of Dania Holding Company,Inc.,is requesting to modify the approved landscape plan for site plan SP-07-03 by replacing the 22 foot Royal Palms with 12 to 14 foot tall Royal Palms with 6 foot of gray wood; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA: Section 1. That the proposed modification to the landscape plan for site plan SP-07-03 as specified in the recital clauses above, is approved, subject to the following conditions: 1) Sable Palms on south side of SE 15th Street to have 6' gray wood, height to be determined by staff. 2) Royal Palms at 6' gray wood, height to be determined by staff. 3) Foxtails Palms at 6' gray wood, height to be determined by staff. Section 2. That based upon the criteria set forth in Section 84(p)of Article 1 of Chapter 8, of the Code of Ordinances of the City of Dania Beach, all site plan approvals shall automatically expire and become null and void unless building permits are obtained on or before 18 months from the date of adoption of this Resolution. Section 3. That all resolutions or parts of resolutions in conflict with this Resolution are repealed to the extent of such conflict. Section 4. Inc., for a site plan modification for the property located at 201 E. Sheridan Street. The subject property includes two parcels located at the northeast corner of Sheridan Street and SE-2 Avenue and is zoned Commercial (C-2). The majority of the church parking is located at the northeast corner of S.E. 15th Street and S.E. 2nd Avenue. On July 27, 2004 the City Commission approved the site plan and variances for this project. The project is currently under construction. The approved site plan shows 22 foot high Royal Palms with six feet of gray wood. 9 Y These Royals cost $900.00 - $1000.00 per tree installed. The applicant wishes to plant 12 — 14 feet tall Royal Palms. The City's Landscape consultant has advised staff that a 12 - 14 foot Royal Palm would have only 2 - 3 feet of gray wood. These Royals cost approximately $200.00 per tree. The City Landscape Code recommends that all Palms, regardless of species, provide a minimum or 6 feet of gray wood. STAFF RECOMMENDATION As per the landscape code, staff recommends that any Royal Palms provide a minimum of 6 feet of gray wood. Please note the City Commission has the discretion to permit substitute palms (with six feet of gray wood) or Royal Palms with less than six feet of gray wood. • RESOLUTION NO. 2004- 124 • A RESOLUTION OF THE CITY OF DANIA BEACH, FLORIDA, APPROVING THE SITE PLAN REQUEST SUBMITTED BY JOHN BARTLEY, AGENT FOR THE FIRST BAPTIST CHURCH OF DANIA HOLDING, CO., INC., FOR PROPERTY LOCATED ON THE EAST SIDE OF SE 2ND AVENUE BETWEEN SHERIDAN STREET AND SE 14T" STREET, DANIA BEACH; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. That that certain application (SP-07-03 )for site plan approval, a copy of which is attached and made a part of this Resolution as Exhibit "A" is approved. We understand that smaller trees not only survive better but grow better once their root system is,established. We would ask for the consideration of the commission to reduce the height of the requested 22 Royal Palms from 22' O.A/8' CT. to the originally requested height of 12 to 14' O.A/6' CT. We, of course, are also looking at the difference in cost. Not only the cost of the trees but also the cost of much larger equipment to transport and plant the trees.
