SPECIAL MEETING
ABATEMENT HEARINGS
J U LY 8, 2003
1. Call to order
The meeting was called to order by Mayor Anton at 5:40 p.m.
2. Roll Call:

3. ABATEMENT REQUESTS:
3.1 Request by St. Joseph Wesleyan Methodist Church for abatement of
Case #1276 for property located at 421 NW 3rd Terrace.
A motion was made by Commissioner Flury, seconded by Vice-Mayor McElyea, to
accept the Code Enforcement Board's recommendation to abate the lien to $500.00 to
be paid within 60 days. The motion passed on the following 5/0 roll call vote:

3.2 Request by Julio Rosario, for abatement of CEB 01-0112 for property
located at 251 SW 8t" Street.
A motion was made by Commissioner Flury, seconded by Commissioner Chunn, to
accept the Code Enforcement Board's recommendation to abate the lien to $2,000.00 to
be paid within 60 days. The motion passed on the following 5/0 roll call vote:

3.3 Request by Castella Williams, for abatement of CEB 01-0091 for property
located at 723 SW 6t" Street.
Castella Williams presented further information relating to the purchase of the property
and improvements that have been made to the property.
Commissioner Chunn recommended abating the lien to $1,200.00 based on Ms.
William's efforts to upgrade the property and her statements that she was not aware of
the.notices.
A motion was made by Commissioner Flury, seconded by Commissioner Mikes, to abate
the lien to $1,500.00 to be paid within 90 days. The motion passed on the following 4/1
roll call vote:

3.4 Request by Jovan and Radinka Solic, for abatement of CEB 00-0420 for
property located at 1401 SE 2"d Avenue.
A motion was made by Commissioner Flury, seconded by Vice-Mayor McElyea, to
accept the Code Enforcement Board's recommendation to abate the lien to $10,000.00
• to be paid within 90 days. The motion passed on the following 410 roll call vote with
Commissioner Chunn out of the room.

3.5 Request by Robert D. Derector & Co., for abatement of CEB 98-0201 for
property located at 775 Taylor Lane.
Attorney Hipler was present to explain that Robert Derector, owner of the marina, had
sense passed away and that improvements have been made to the property under new
management.
A motion by Commissioner Mikes, seconded by Mayor Anton, after passing the gavel, to
abate the line to $20,000 failed on a 2/3 roll call vote.
A motion was made by Commissioner Flury, seconded by Commissioner Chunn, to
abate the lien to $15,000.00 to be paid within 60 days. The motion passed on the
following 3/2 roll call vote:

3.6 Reconsideration of Jeff Bartlett's request for abatement of CEB 00-0476
• for property located at 242 SW 12 Street.
Attorney Michael Cirillo explained that in January the City Commission abated the lien
from $81,000 (recommended abatement to $40,700 by Code Board) to $20,000 with the
condition that a fence be installed and that the fence has been installed and the property
is in compliance with code.
Representative Tim Ryan, Special Counsel for the City on Code issues, explained that
Mr. Bartlett was not notified of a second hearing to confirm his fine because the Statute
did not require notice . However, he pointed out that an opinion of the 2"d. District Court
of Appeals states that notice is required for these types of code hearings and the opinion
may, in the future, be transferred to the 4th District Court of Appeals. And, although, he
felt the City could win the case if it went to court, he recommended that the City settle
the legal issue for$10,000 to be paid by July 20 as agreed by the petitioner.
A motion was made by Commissioner Flury, seconded by Commissioner Chunn, to
abate the lien to $10,000 to be paid by July 20. The motion passed on the following 5/0
roll call vote:
