Call to Order: Mayor Anton called the meeting to order at 4:47 p.m. 2. ROLL CALL: Present: Mayor: Bob Anton Commissioners: Robert Chunn Pat Flury Bob Mikes City Attorney: Thomas Ansbro City Manager: Ivan Pato City Clerk: Charlene Johnson Absent: Vice Mayor: C.K. McElyea (excused) A motion was made by Commissioner Mikes, seconded by Commissioner Chunn, to excuse Vice Mayor McElyea as his wife is ill. The motion passed on the following 4/0 roll call vote: Commissioner Chunn-yes Commissioner Mikes-yes Commissioner Flury-yes Mayor Anton-yes 3. Motion to establish certification of the following "not to exceed" rates to Broward County Property Appraiser's Office for fiscal year 03/04: • Millage Rate —Motion to confirm rate. Commissioner Mikes did not agree that the departmental transfers were legitimate and made a motion to approve the same millage rate of 6.39. The motion died for lack of a second. A motion was made by Commissioner Chunn, seconded by Commissioner Flury, to approve a 6.59 "not to exceed" millage rate with the understanding that staff will go back and review areas of the budget to reduce the millage rate even lower. Commissioner Mikes stressed the importance of placing financial burden on developers and not on tax payers. The motion passed on the following 3/1 roll call vote: Commissioner Chunn-yes Commissioner Mikes-no Commissioner Flury-yes Mayor Anton-yes • Fire Assessment Rate-Adoption of Resolution A RESOLUTION OF THE CITY OF DANIA BEACH, FLORIDA, RELATING TO THE PROVISION OF FIRE RESCUE SERVICES, FACILITIES AND PROGRAMS IN THE CITY OF DANIA BEACH, FLORIDA; ESTABLISHING THE MINUTES 1 JULY 24, 2003 SPECIAL MEETING • "NOT TO EXCEED" ASSESSMENT RATE FOR FIRE RESCUE ASSESSMENTS FOR THE FISCAL YEAR BEGINNING OCTOBER 1, 2003; DIRECTING THE PREPARATION OF AN ASSESSMENT ROLL, AUTHORIZING A PUBLIC HEARING AND DIRECTING THE PROVISION OF NOTICE OF SUCH HEARING; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING AN EFFECTIVE DATE. City Attorney Ansbro read the title of the resolution. A motion was made by Commissioner Chunn, seconded by Mayor Anton, after passing the gavel, to adopt the Resolution and a "not to exceed" Fire Assessment rate of$90.00. The motion failed on the following 2/2 roll call vote: Commissioner Chunn-yes Commissioner Mikes-no Commissioner Flury-no Mayor Anton-yes Mayor Anton called a 5 minute recess: A motion was made by Commissioner Mikes, seconded by Commissioner Chunn, to adopt the Resolution and a "not to exceed" Fire Assessment rate of$91.00. The motion passed on the following 4/0 roll call vote: Commissioner Chunn-yes Commissioner Mikes-yes Commissioner Flury-yes Mayor Anton-yes Solid Assessment Rate—Adoption of Resolution A RESOLUTION OF THE CITY OF DANIA BEACH, FLORIDA, RELATING TO THE COLLECTION AND DISPOSAL OF SOLID WASTE IN THE CITY OF DANIA BEACH, FLORIDA; ESTABLISHING THE NOT TO EXCEED ASSESSMENT RATE. FOR SOLID WASTE SERVICE ASSESSMENTS AGAINST ASSESSED PROPERTY LOCATED WITHIN THE GRIFFIN ROAD ANNEXATION AREA AND THE ANNEXED AREA DESCRIBED IN CHAPTER 2000-474, LAWS OF FLORIDA, OF THE CITY OF DANIA BEACH FOR THE FISCAL YEAR BEGINNING OCTOBER 1, 2003; DIRECTING THE PREPARATION OF AN ASSESSMENT ROLL; AUTHORIZING A PUBLIC HEARING AND DIRECTING THE PROVISION OF NOTICE OF SUCH HEARING; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; FURTHER, PROVIDING AN EFFECTIVE DATE. City Attorney Ansbro read the title of the resolution. Director Varney confirmed that the garbage collection rate is currently $233.99 and that BFI will not have the increase rate calculated until August. Based on previous trend, BFI indicated that it is around 1 to 1.5%, therefore, staff is proposing a 1.44% increase to $236.76. This increase is only allowed on the disposal rate and not on the recycling services according to the contract. A motion was made by Commissioner Mikes, seconded by Commissioner Chunn, to adopt the Resolution and a "not to exceed" Solid Waste Assessment rate of$236.76. • The motion passed on the following 4/0 roll call vote: MINUTES 2 JULY 24, 2003 SPECIAL MEETING • Commissioner Chunn-yes Commissioner Mikes-yes Commissioner Flury-yes Mayor Anton-yes • Stormwater Water Assessment Rate —Motion to confirm rate: City Attorney Ansbro advised that a resolution was not required for the Stormwater Assessment program. Director Varney advised that a resolution was not needed and that the Broward County Property Appraiser's Office will handle the first notice to the property owners. She agreed with Commissioner Flury that a small portion of the revenues would be used for debt service. A motion was made by Commissioner Flury, seconded by Commissioner Chunn, to confirm the "not to exceed" Stormwater Rate of$23.00 per ERU. The motion passed on the following 4/0 roll call vote: Commissioner Chunn-yes Commissioner Mikes-yes Commissioner Flury-yes Mayor Anton-yes 4. Adjournment.
