HomeMy WebLinkAboutO-2003-005-A Amending future land use element to create the LAC land use classification ORDINANCE NO. 2003-005-A- AN ORDINANCE OF THE CITY OF DANIA BEACH, FLORIDA, AMENDING THE FUTURE LAND USE ELEMENT OF THE DANIA BEACH COMPREHENSIVE PLAN TO CREATE THE LOCAL ACTIVITY CENTER ("LAC") LAND USE CLASSIFICATION; PROVIDING FOR ADOPTION PURSUANT TO SECTION 163.3184, FLORIDA STATUTES; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City desires to amend its Comprehensive Plan Future Land Use Element to create the land use classification for "Local Activity Center" ("LAC"); and WHEREAS, in conjunction with the creation of the land use classification, the City proposes to amend the City of Dania Beach Future Land Use Map to designate on the Future Land Use Map a Local Activity Center as applicable to a portion of the City's downtown; and WHEREAS, the City of Dania Beach Planning and Zoning Board, sitting as the • Local Planning Agency, held a duly advertised public hearing on January 22, 2003, and determined that the proposed amendment is consistent with the goals and objectives of the City of Dania Beach Comprehensive Plan and therefore, recommended approval of the proposed amendment; and WHEREAS, the City Commission of the City of Dania Beach held a duly noticed public hearing on February 12, 2003, regarding the proposed amendment and determined that the amendment is in the interest of the City's public health, safety and welfare and should be adopted for transmittal to the Florida Department of Community Affairs for its review pursuant to Chapter 163, Florida Statutes. WHEREAS, on October 31, 2003, DCA raised no objections to the Amendment; and 1 ORDINANCE NO. 2003-005-A- WHEREAS, on December 8, 2003, the City Commission of the City of Dania Beach held its second public hearing on the adoption of the Amendment, involving presentations by staff, opportunities for public comment, and discussion among the Commission members; NOW THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA: Section 1. That the Future Land Use Element of the City of Dania Beach Comprehensive Plan is adopted on second and final reading to establish the land use classification of "Local Activity Center" ("LAC") as follows: e s e III. ANALYSIS REQUIREMENTS — 9J-5.006(2) • C. Land Requirements 1. Permitted uses in the City of Dania Beach Land Use Plan. t. Local Activity Center Use: The intent of the Local Activity Center land use designation is to support a balanced mix of land uses characterized by compactness, pedestrian friendly design neighborhood-scale and framed by architecture and landscape design appropriate to local history and ecology. Development patterns within Local Activity Centers shall generally reflect planning and design principles such as walkable neighborhoods oriented around the five-minute walk primary orientation toward public transit systems, a centrally located community-serving land use or land uses and greater integration of housing employment shopping and recreation at the neighborhood level. For an area to qualify as a Local Activity Center, the following criteria must ibe met: 2 ORDINANCE NO. 2003-005-A- 1. A Local Activity Center shall be a specific geographic area not exceeding 160 gross contiguous acres, unless located within an approved Chapter 163, Florida Statutes, Redevelopment Area. At such time as 75% of the originally designated Local Activity Center is developed/redeveloped an expansion to a subject Local Activity Center up to 100% may be proposed. 2. The density and intensity of land uses permitted within a proposed Local Activity Center shall be specified in the Dania Beach Land Use Element. 3. Uses proposed within a Local Activity Center shall include residential uses and park land and/or open space. One or more other uses such as commercial, civic, institutional, or employment-based activity shall also be included within a Local Activity Center. 4. Park land must reflect no net loss of acreage of existing and designated parks within the proposed Local Activity Center. Park and open spaces land may include squares, greenbelts greenways and playgrounds; ill-defined residual areas such as buffers and berms, for purposes of this criteria are not considered park land or open space. 5. To address proposed residential density above what is yielded by the present land use designations, the City shall first utilize at least 75% of available "flexibility units" and "reserve units" from the flexibility zone where the Local Activity Center is located before an increase in density is requested via the land use plan amendment process. A proposed Local Activity Center located within an approved Chapter 163 Florida Statutes Redevelopment Area is exempt from this criteria. 6. A proposed Local Activity Center must have a geographic configuration of appropriate depth end frontage to support the location of uses in a manner oriented around the five- minute (i.e. quarter-mile) walk. Multiple nodes of activity oriented around the five-minute (i.e. quarter-mile) walk may be included within one Local Activity Center. 7. Seventy-five percent (75%) of the land within a Local Activity Center must be located within a quarter-mile of mass transit or multi-modal facilities or are included within an adopted • plan to be located within a quarter-mile of mass transit or 3 ORDINANCE NO. 2003-005-A- multi-modal facilities upon buildout of the Local Activity • Center. Convenient access shall be provided to mass transit, community shuttle or multi-modal facilities where such facilities are in place or planned to be in place at the time the Local Activity Center is proposed. Where such facilities are not in place or planned to be in place at the time of proposal, the City shall provide design standards in the Land Use Element for a Local Activity Center that ensure that the Primary priority is a safe, comfortable and attractive pedestrian environment that will allow for convenient interconnection to transit, will reduce the number of automobile trips internally and will ultimately support an integrated multi-modal transportation system. 8. A proposed Local Activity Center shall demonstrate consistency with the goals, objectives and policies and other requirements of the Land Use Element. 9. An interlocal agreement between the City and Broward County shall be executed no later than six months from the effective date of the adoption of a Local Activity Center which provides that monitoring of development activity and enforcement of permitted land use densities and intensifies • shall be the responsibility of the City. REQUIREMENTS FOR FUTURE LAND USE GOALS, OBJECTIVES AND POLICIES OBJECTIVE XXV. • Encourage compact development reflecting characteristics which include a mixture of community-serving uses such as commercial, office, employment, civic and institutional, recreation and open space and residential, characterized by an efficient infrastructure, close-knit neighborhoods and sense of community, preservation of natural systems, promotion of pedestrian circulation and convenient access to mass transit facilities through the establishment of a Local Activity Center land use category_. Policy 25.1 Local Activity Centers shall support the location of uses in a manner oriented around the five-minute (i.e., quarter-mile)walk. Multiple nodes of activity oriented around the five-minute (i.e., quarter mile) walk may be included within one Local Activity Center. Policy 25.2 Local Activity Centers shall support the location of uses and internal circulation such that pedestrian mobility is a priority. All land uses in a Local Activity Center shall be directly assessed via pedestrian ways, and accessible to existing or future alternate public transportation modes, including bicycle and transit. Policy 25.3 Park land and/or open space that is accessible to the public shall be included as a functional component within a Local Activity Center. • 5 ORDINANCE NO. 2003-005-A- ' Policy 25.4 Housing opportunities shall be included as a functional component within a Local Activity Center. Policy 25.5 Encourage affordable housing opportunities in Local Activity Centers throuqh various mechanisms such as the utilization of "affordable housing units." The direction of public housing program funds into the Local Activity Center, reduced lot size for dwelling units construction of zero lot line and cluster housing, vertical integration of residential units with non-residential uses, the allowance of accessory dwelling units, or through other mechanisms proven effective in increasing the affordable housing stock. Policy 25.6 Promote the rehabilitation and use of historic buildings within Local Activity Centers. Policy 25.7 The City shall adopt design guidelines that incorporate pedestrian and bicycle paths and greenways to accomplish fully-connected routes to all destinations within the Local Activity Center. The paths should be spatially defined by buildings, trees and lighting, and should incorporate designs which discourage high speed traffic. Policy 25.8 The City shall ensure convenient access to mass transit or multi- modal facilities within Local Activity Centers. Policy 25.9 The City's community shuttle shall serve the residents and employees within the proposed Local Activity Centers. Policy 25 10 The City shall adopt local design quidelines that require transit shelters in the Local Activity Center to provide safe and comfortable service and to encourage transit usage. Policy 25.11 The City shall promote development of key intersections or major transit stops to create modes of development within a Local Activity Center. Policy 25.12 The City shall review existing zoning and land development regulations and adopt changes necessary to implement the Local Activity Center land use designation by 2004. Section 2. That the City Commission authorizes the City Manager to transmit the Future Land Use Element amendment to the state agencies as required by Section 163.3184, Florida Statutes. 6 ORDINANCE NO. 2003-005-A- Section 3. That the City Commission authorizes the City Manager to transmit the • amendment to the City's Future Land Use Element to the Broward County Planning Council for recertification. Section 4. That the effective date of this Future Land Use Element amendment shall be after the completion of the comprehensive plan amendment review process under Chapter 163, Florida Statutes, including the second reading and adoption of the amendment by the City Commission and, subsequently, the date a final order is issued by the Florida Department of Community Affairs finding the amendment to be in compliance in accordance with Chapter 163, Florida Statutes; or the date a final order is issued by the Administration Commission finding the amendment to be in compliance in accordance with Chapter 163, Florida Statutes. Over the last nine months, staff has obtained the preliminary approval of all these agencies. Recently, DCA indicated a letter of no objection. Pending City Commission approval on December 8, the amendment must receive final approval of the County Commission (December 2003), South Florida Regional Planning Council (January-February 2004), and the Broward County Planning Council (February-March 2004). CURRENT LAC FUTURE LAND USE The proposed LAC area currently contains 157 acres. As indicated below, most of the proposed LAC land consists of property with a "Commercial" or "Commercial Recreation" Land Use. The latter category is the existing Jai ® Alai Fronton and surrounding parking area. For purposes of determining maximum development under existing land use categories, the following assumptions were made: 20% of gross acreage for commercial properties is deducted for road right-of-way. ® Maximum allowable height is three stories. Maximum allowable developable floor area (commercial and • industrial areas) is 50% of the lot area (Floor Area Ratio = 0.5). ® Dania Beach Jai-Alai has a maximum capacity of 6,000 people. Other uses within the LAC amendment area will remain and are not considered in the public facilities analysis. Based on the above assumptions, the estimated maximum development under existing future land use categories is as follows. Community Facility 4.7 53,000 s . ft. 1 Residential Units 0.0 0.0 1 PROPOSED LAC AREA MAP DESIGNATIONS Instead of restricting each parcel of land within the LAC to a specific use, the proposed LAC land use would establish maximum development potential based on the density and square footage of different types of uses. Site-specific regulations (use and area requirements) would be addressed by the zoning code. 2 { • Proposed Local Activity Center Use Intensity Residential 2,465 total units* 2,165 high rise units 200 garden units 100 townhouse units Hotel 640 rooms* Commercial 500,000 square feet Recreation and Open Space 9.5 Conservation 0.6 Community Facility 4.7 *2,800 dwelling units and 800 hotel rooms were originally proposed by the City. City staff reduced this to 2,465 dwelling units and 640 hotel rooms in response traffic concerns raised by the Broward County Planning Council.- The mix of high-rise, garden apartments, and townhouse units was based on recommendations from Henry Iler and Associates (CRA Consultant) and Leigh Robinson Kerr and Associates. While the establishment of a new 2,465 unit pool is substantial, it amounts to an area-wide average density of 16 units per acre. Meadowbrook, the Danians, and the Sheridan Beach Club Apartments (located west of Publix on Sheridan) were built at 25 to 35 units per acre. If the LAC unit pool is not approved, new residential projects will be subjected to the lengthy and uncertain county land use plan amendment { process. The LAC unit pool creates a "reservoir of units" available to be assigned on a site-specific basis based upon the merits of each individual project. CONSULTANT IMPACT ANALYSIS Technical analysis by Kerr and Associates indicates adopting the LAC as proposed would result in the following impacts. Please note this is a comparison of maximum development under current comprehensive plan vs. maximum development under the proposed LAC plan. 1) The LAC would result in fewer vehicle trips as compared with the current Future Land Use Plan for the LAC area. 0 i 3 The Broward Planning Council, using a more conservative estimate of allowed development under the current land use plan, indicated traffic would increase based on 2,800 dwelling units and 800 hotel rooms. County staff recommended limiting the LAC to 2,465 dwelling units and 640 hotel rooms (Commercial would remain at 500,000 square feet). County staff analysis indicates that the "downsized LAC" would increase total traffic by 144 vehicle trips per day above the currently allowed development potential of 35,947 vehicle trips per day. This is an increase of less than 1%. 2) The LAC would generate less solid waste than the current Future Land.Use Plan for the LAC area. No objection from Broward County Planning Council staff. 3) The LAC would generate additional students, although the number of students varies considerably (between 50 and 299 students) depending on which standard is used. In order to satisfy the concerns of the Broward County Planning Council, the Broward County Commission, and the South Florida • Regional Planning Council concerning school capacity, the city was asked to impose an approximate $1,700.00 to $2,100.00 per unit school impact fee upon LAC high rise units. Current high rise school impact fees, which are expected to increase, are $452.00 per unit. City staff was informed that agreeing to these higher impact fees were necessary in order to get the support of the School Board, a prerequisite to obtaining Planning Council staff approval. City Staff agreed to this arrangement, but requested that the School Board set aside a portion of the fees-for---schools in Dania Beach. Total school fees from 2,465 units are expected to exceed $4,000,000.00. School Board staff agreed to use best efforts, but would not commit to a set dollar figure for Dania Beach schools. Both the Broward County Planning Council staff, as well as some members of the Planning Council, recommended that a certain portion be set aside specifically for Dania Beach schools. 4) The LAC would generate additional demand for water and sewer service. Former Public Services Director Mike Sheridan has previously indicated there is sufficient water and sewer capacity to accommodate the LAC amendment. i 3� 4 PLANNING AND ZONING ADVISORY BOARD RECOMMENDATION Approval. Summaryof Florida Department of Community(fairs Comments October 20, 2003 The Department of Community Affairs has no objection to the proposed amendment. V. Planning Council Staff Filial Recommendation November 10, 2003 Consistent with the Planning Council's transmittal recommendation of June 26,2003, which was to approve the amendment and direct the Planning Council staff to work with the City of Dania Beach on the implementation and monitoring of the Local Activity Center, including impacts to public schools, we have coordinated with the City of Dania Beach staff and acknowledge their effort to address impacts to public schools to the satisfaction of the Broward County School Board. In this regard, the City staff has offered several voluntary commitments which the School Board staff indicates would "serve to mitigate the number of anticipated students." The School Board staff requests that the voluntary commitments made by the City Manager be implemented through a legally enforceable mechanism, such as a tri-party interlocal agreement. The Dania Beach City Manager has agreed to a tri- party interlocal agreement as requested by the School Board staff, with the understanding that the LAC amendment will proceed on its current time schedule. In this light, Planning Council staff recommends that the proposed amendment to the Broward County Land Use Plan be approved, recognizing the City of Dania Beach City Manager's voluntary commitment on behalf of the City to address impacts to public schools,and with the further recommendation that approval be conditioned on the execution of a legally enforceable mechanism to the satisfaction of Broward County regarding the implementation of the student station fee as represented by the Dania Beach City Manager and the School Board staff;and recognizing that the City will not issue building permits for"Local Activity Center" authorized dwelling units until the execution and implementation of the legally enforceable mechanism. See Attachments 10, 11, 12 and 13. As Planning Council staff believes that this amendment will serve as an example for future development proposals,we believe additional fees collected should be utilized to address schools impacted by the amendment. Therefore, we strongly recommend that the above referenced legal mechanism to enforce student station fees address the Dania Beach City Manager's request that the School Board allocate a portion of the i collected student station fees to schools located in the City of Dania Beach. It is our understanding that currently, impact fees are allocated to four zones in Broward County,not necessarily to schools impacted by a proposed development. To allocate fees to a school outside of those impacted by the amendment would not serve to mitigate the same. - 4 - PROPOSED AMENDMENT PC 03-6 APPLICANTS STATED REASON FOR THE AMENDMENT The applicant states: "The Dania Beach Downtown Local Activity Center is proposed to contain a mix of land uses that promote a compact, urban neighborhood land use pattern. A small conservation area is located in the amendment site. The acreage of conservation uses may be expanded in the future but there will be no net loss of recreation and open space as a result of this amendment. Inclusion of parks and open space is one of the principles used to guide the preparation of the City's Downtown Redevelopment Plan. The City proposes the inclusion of new open space through the creation of greenways, new parks and pedestrian- friendly streetscapes. The proposed greenway system will connect mixed-use areas into surrounding residential neighborhoods and other activity nodes in the downtown area and throughout the City. City Hall, the City's police station, a fire station, the Chamber of Commerce and a post office are all located within the amendment areas to provide the neighborhood with essential community facilities. A number of historic structures located within the amendment area provide community identity for the neighborhood. These historic structures will be protected and enhanced through local land development regulations. To complete the neighborhood fabric, a mix of residential, commercial and hotel uses are proposed." PLANNING CONSIDERATIONS • I. Existing Uses and BCLUP Designations Adjacent to the Amendment Site A. Public Services and Facilities Adequate potable water and sanitary sewer facility capacity, drainage, solid waste services, and park and recreation acreage will be available to serve the proposed designation_ See Attachment 1_ The proposed amendment will increase traffic on the regional roadway network by approximately 144 vehicle trips per day_ See Attachment 2. The proposed amendment will not significantly impact the operating conditions of the regional roadway network. The Broward County School Board staff report of June 13, 2003, states that the amendment as proposed will generate 277 additional students into District schools. The report further states that the public schools serving the amendment site are currently under-capacity. However,projected enrollment beginning in 2003/04 school year indicates that Dania Elementary School will be over-capacity. The subject amendment is projected to generate 161 additional elementary school students. See Attachment 3. The Broward County Emergency Management Agency reviewed the proposed amendment for impacts on hurricane evacuation times. Their report states the subject amendment site is located within a designated hurricane evacuation zone for a ' Category 3 or higher storm_However,the proposed project will not have a significant impact in diminishing the level of service of the designated hurricane evacuation routes nor the current capacity of the County's emergency shelters_ See Attachment 4. III. Natural and Cultural Resource Impacts Broward County Department of Planning and Environmental Protection(DPEP)and Broward County Office of Urban Planning and Redevelopment(OUPR)coordinated review indicates that Natural Resource Areas,Local Areas of Particular Concern, or Urban Wilderness Inventory sites do not exist on or in the immediate vicinity of the proposed amendment site. See Attachment 5. i - 6 - PROPOSED AMENDMENT PC 03-6 III. Natural and Cultural Resource Impacts (continued) The DPEP field review indicates that no wetlands are located within the boundaries of the amendment site. The proposed land use designation is not expected to have a negative impact on wetland resources. The Broward County Historical Commission (BCHC) report states that the amendment.site contains a number of historic sites eligible for both local and National Register of Historic Sites designation. The BCHC notes that an updated historic sites survey should be conducted by a qualified historic preservation consultant hired by the City to inventory the extent of those resources prior to redevelopment and land use plans implementation. See Attachment 6. IV. Consistency with BCLUP Goals Obeectives and Policies The proposed amendment furthers the following goals, objectives and policy of the Broward County Land Use Plan: Goal 1.00.00 Provide residential areas with a variety of housing types and densities offering ® convenient and affordable housing opportunities to all segments of Broward County's population while maintaining a desired quality of life and adequate public services and facilities. Objective 10.01.00 Encourage the use of innovative land development regulations and techniques, for both residential and non-residential development in order to promote planned communities and activity centers designed foi efficient use of public services and facifities Policy 10.01.01 Encourage the use of mixed land use development regulations in those areas where compatible mixed land use patterns currently : exist or are planned. Objective 14.01.00 Develop and implement land use programs to encourage redevelopment activities within identified blighted and deteriorating areas. I i PROPOSED AMENDMENT PC 03-6 IV. Consistency with BCLUP Goals Objectives and Policies (continued) Goal 17.00.00 Direct growth to identified urban infill, urban redevelopment and downtown revitalization areas within Broward county in order to discourage urban sprawl, reduce development pressures on rural lands, maximize the use of existing public facilities .and centralize commercial, governmental, retail, residential and cultural activities. The proposed amendment has not demonstrated consistency with the following objective and policy of the Broward County Land Use Plan: Objective 8.07.00 Ensure through the future land use planning process that public elementary and secondary education facilities will be available to meet the current and future needs of Broward County's school population. ® Policy 8.07-01 Broward County and its local governments shall consider the individual and cumulative impacts of land use plan amendments on existing and planned public elementary and secondary education facilities. Other Pertinent Information (continued) The Broward County Park and Recreation Division indicates the amendment site is located adjacent to a portion of West Lake Park which is designated "Low (5) Residential" on the Broward County Land Use Plan. The portion of this area located immediately east of the amendment site is located within the City of Hollywood and is designated "Conservation"on the City of Hollywood Comprehensive Land Use Plan Map. The portion of this area located immediately south of the amendment site is located within the City of Dania Beach and is designated as"Low(1)Residential" on the City of Dania Beach Comprehensive Land Use Plan Map. The City of Dania Beach staff has verbally indicated that they will propose a local comprehensive plan amendment to change the parcel from "Low (1) Residential" to "Conservation." This proposed map amendment corresponds to Broward County Land Use Plan proposed text amendment PCT 03-3. PLANNING ANALYSIS The City of Dania Beach is proposing the"Local Activity Center"land use designation as a means to facilitate redevelopment activity within its traditional downtown core. The City has identified the subject amendment site as a blighted area. Our analysis finds that the amendment would further several goals, objectives and policies of the Broward County Land Use Plan which speak to the promotion of mixed use and urban infill development through innovative land development regulations, and to develop and implement land use programs to encourage redevelopment activities within identified blighted areas. Adequate potable water, sanitary sewer, drainage and solid waste capacity and park acreage will be available to serve the proposed designation. In addition, our analysis finds that the proposed amendment will not significantly impact the operating conditions of the regional roadway network. Our review indicates that the proposed amendment is generally in compliance with the BCLUP policies and implementation criteria concerning the "Local Activity Center" land use designation, noting that the subject area will support mass transit use by having all areas within a quarter-mile of such facilities and, through planned multiple nodes of activity, will support the location of uses in a _7 manner oriented around the five-minute walk. In addition,the City plans to incorporate an pedestrian trail system throughout the subject area. However,the Broward County School Board staff report indicates that the proposed amendment may negatively impact Dania Elementary which is projected to be over-capacity in the 2003/2004 school year. The subject amendment is projected to generate 161 additional elementary school students. - 10 - i li PROPOSED AMENDMENT PC 03-6 PLANNING ANALYSIS (continued) In summary, our analysis finds that the proposal may encourage mixed use redevelopment within an area that has been identified as blighted by the City and is within Broward County's designated "Urban Infill Area_" Although Planning Council staff is inclined to accommodate this first proposal to designate an area within Broward County as a"Local Activity Center," we note an over-riding issue regarding the amendment's estimated adverse impacts on the affected public elementary school. In this regard, the proposed amendment has not demonstrated consistency with the BCLUP objective and policy regarding impacts to over-capacity public schools_ Dania Elementary is projected to be over-capacity,with or without the amendment beginning in the 2003104 school year. It is noted that although the City proposes to restrict approximately 88%of the 2,465 dwelling units within the LAC to "high-rise" units, which have the lowest student generation rates, the proposed land use is estimated to generate 161 additional students to Dania Elementary. Due to the estimated adverse impacts to the public elementary school, we cannot support the amendment at this time. We note that the subject amendment area is within a proposed"Community Redevelopment Area" (CRA). The City's CRA plan has been approved by the City, but has not yet received approval from Broward County. We recommend that the amendment be deferred to allow ublic schools as part of their CRA plan process, in the City to address the estimated impacts to p consultation with Broward County. To fully understand the extent of these resources, an updated historic sites survey should be conducted by a qualified historic preservation consultant hired by the City to inventory the extent of those resources prior to redevelopment and land use plans being implemented. The application indicates that state and federal redevelopment(CDBG) funds are likely to be used during this process by the City and both have requirements to avoid, minimize and mitigate potential detrimental impacts to historic resources that may result from agency actions, including the receipt of funds or agency permits or approvals. A necessary first step to knowing what could be affected is to know-through a survey or inventory-what already existis and what has been lost. BROWARD COUNTY LAND USE PLAN OBJECTIVE AND POLICIES "LOCAL ACTIVITY CENTER" Planning Council Staff Review Comments Regarding Proposed Amendment PC 03-6 City of Dania Beach OBJECTIVE 10.03.00 Encourage compact development reflecting characteristics which includes a mixture of community-serving uses such as commercial, office, employment, civic and institutional, recreation and open space and residential, characterized by an efficient . infrastructure,close knit neighborhoods and sense of community,preservation of natural systems, promotion of pedestrian circulation and convenient access to mass transit facilities through the establishment of a Local Activity Center land use category within the Broward County Land Use Plan. Planning Council Staff Comment It is felt that the information submitted with the City's application,as described in the following Planning Council staff comments regarding the City's consistency with the Broward County Land Use Plan's "Local Activity Center" policies and implementation requirements, demonstrates that the proposed "Local Activity Center" would generally further Objective 10.03.00. • POLICY 10.03.01 A municipality may propose a specific land area for designation as a Local Activity Center within the Broward County Land Use Plan,consistent with the criteria contained within the Local Activity Center Permitted Uses subsection of the Plan Implementation Requirements section of the Broward County Land Use Plan. Planning Council Staff Comment The proposed Local Activity Center(LAC)consists of a specific area containing approximately 157.3 gross acres. POLICY 10.03.02 The municipality shall include within their land use element policies that ensure the proposed Local Activity Center will support the location of uses in a manner oriented around the five-minute (i.e. quarter-mile) walk. Multiple nodes of activity oriented around the five-minute (i.e. quarter- mile) walk may be included within one Local Activity Center. The municipality shall include within their land use element policies that ensure that the proposed Local Activity Center will support the location of uses and internal circulation such that pedestrian mobility is a priority.All land uses in a Local Activity Center shall be directly accessed via pedestrian ways, and accessible to existing or future alternate public transportation modes, including bicycle and transit. Planning Council Staff Comment Proposed City of Dania Beach Comprehensive Plan Policy 25.1 requires the LAC to support the location of uses in a manner oriented around the five-minute(i.e.,quarter-mile)walk. Proposed Policy 25.2 requires the LAC to support the location of uses and internal circulation such that pedestrian mobility is a priority with all land uses in the LAC being directly accessible. via j pedestrian ways and alternate public transportation modes. i 1 -1- I The City proposes three activity nodes that are either multi-use activity nodes or community transit hubs. See Attachment 7.A.1. In this regard, the City is planning to create an urban pedestrian trail network, which would provide access to the activity nodes and transit. See Attachment 7.A.2. Consistent with Attachments 7.A.2.and 7.A.3,pedestrian access within the proposed LAC is generally oriented around the five-minute walk. In addition, the proposed LAC is served by four(4) Broward County Transit routes and three (3) Community Shuttle routes,operated through an Interlocal Agreement by Broward County. All areas within the proposed LAC are located within one-quarter mile of the transit routes. See Attachment 7.A.3. POLICY 10.03.03 Park land and/or open space that is accessible to the public must be included as a functional component within a proposed Local Activity Center. Planning Council Staff Comment Proposed City of Dania Beach Comprehensive Plan Policy 25.3 requires publicly accessible park land and open space be included as a functional component within the LAC. No area within the boundary of the subject amendment site is currently developed or designated for"Recreation and Open Space" uses. However,the City's land use plan includes a 0.6 acre"Conservation" area which is proposed to remain as part of the LAC. The City is also proposing to create an urban pedestrian trail network to serve the LAC. See Attachment 7.A.2. The urban pedestrian trail network would serve.the entire LAC. Tile City states that it intends to revise its land development regulations to provide for implementation of the trail network as development occurs within the LAC. It is also noted that an approximate nine (9) acre public park, located at the southwest corner of NE 2"d Street and Fronton Boulevard,currently exists contiguous to the proposed LAC boundary. POLICY 10.03.04 Housing opportunities must be included as a functional component within a proposed Local Activity Center. Planning Council Staff Comment Proposed City of Dania Beach Comprehensive Plan Policy 25.4 requires housing opportunities be included as a functional component within a Local Activity Center. The subject amendment to the BCLUP proposes 2,465 existing or new dwelling units, consisting of high rise units, garden apartments and townhouses. If the BCLUP amendment is approved,the City will apply 335 "flexibility units" and"reserve units" to achieve a total of 2,800 dwelling units within the LAC. POLICY 10.03.05 Local governments shall consider community needs for affordable housing when proposing a Local Activity Center and include within their local land use element policies which encourage affordable housing opportunities, through various mechanisms such as the utilization of "affordable housing units," the direction of public housing program funds into the Local Activity Center,reduced lot size for dwelling units,construction of zero lot line and cluster housing, vertical integration of residential units with non-residential uses, the allowance of accessory dwelling units, or through other mechanisms proven effective in increasing the affordable housing stock. To promote Local Activity Centers which propose to include "low income"housing as a viable component,Broward County shall support all reasonable means and methods to mitigate potential negative impacts to public facilities and services which may result from the amendment. Planning Council Staff Comment • Proposed City of Dania Beach Comprehensive Plan Policy 25.5 proposes to encourage affordable housing opportunities in the LAC through various mechanisms such as the allocation of"affordable housing units," as defined by the Broward County Land Use Plan, the direction of public housing program funds into the Local Activity Center, reduced lot size for dwelling units, construction of zero lot line and cluster housing, vertical integration of residential units with non-residential uses and the allowance of accessory dwelling units. POLICY 10.03.06 Local governments shall include within their local land use element policies that promote the rehabilitation and use of historic buildings within a proposed Local Activity Center. Planning Council Staff Comment Proposed City of Dania Beach Comprehensive Plan Policy 25.6 promotes the rehabilitation and use of historic building within the LAC. The City has adopted an Historic Preservation Plan to identify significant historic properties throughout the City. The City has already designated three (3) buildings as historically significant within the proposed LAC. POLICY 10.03.07 Local land use elements shall require design guidelines that incorporate pedestrian and bicycle paths and greenways to accomplish fully-connected routes to all destinations within the Local Activity Center.The paths should be spatially defined by buildings, trees and lighting, and should incorporate designs which discourage high speed traffic. Planning Council Staff Comment Proposed City of Dania Beach Comprehensive Plan Policy 25.7 will require the City to adopt design guidelines satisfying the above requirement. The City plans to implement an urban pedestrian trail system that will complement the mixed use development pattern of the proposed LAC. POLICY 10.03.08 To reduce reliance on automobile travel, local governments shall ensure convenient access to mass transit or multi-modal facilities within a proposed Local Activity Center. ! PlanninQ Council Staff Comment Proposed City of Dania Beach Comprehensive Plan Policy 25.8 will require the City to ensure convenient access to mass transit or multi-modal facilities. Four(4) Broward County Transit routes and three(3)Community Shuttle routes serve the proposed LAC. The proposed LAC is also served by transit access to Tri-Rail. All areas within the proposed LAC are located within one-quarter mile of the transit routes. See Attachment 7.A.3. BROWARD COUNTY LAND USE PLAN IMPLEMENTATION REQUIREMENTS • "LOCAL ACTIVITY CENTER" Planning Council Staff Review Comments Regarding Proposed Amendment PC 03-6 City of Dania Beach Consistent with Objective 10.03.00, the intent of the Local Activity Center land use designation is to support a balanced mix of land uses characterized by compactness,pedestrian friendly design, neighborhood-scale and framed by architecture and landscape design appropriate to local history and ecology.Development patterns within Local Activity Centers shall generally reflect planning .and design principles such as walkable neighborhoods oriented around the five-minute walk, primary orientation toward public transit systems,a centrally located community-serving land use or land uses and greater integration of housing, employment, shopping and recreation at the neighborhood level. Planning Council Staff Comment It is felt that the information submitted with the City's application, as described below per the LAC criteria, demonstrates general consistency with the Broward County Land Use Plan Implementation Requirements. The proposed LAC reflects a mix of residential uses and types, commercial uses,hotel rooms,community facilities and conservation areas. The City proposes the inclusion of new open space through the creation of greenways,new parks and pedestrian- friendly streetscapes,consistent with its Downtown Redevelopment Plan. The proposed system, will be served by existing and future County and Community Shuttle transit connections to • mixed-use areas. For an area to qualify as a Local Activity Center, the following criteria must be met: 1. A Local Activity Center shall be a specific geographic area not exceeding 160 gross contiguous acres,unless located within an approved Chapter 163,Florida Statutes,Redevelopment Area. At such time as 75% of the originally designated Local Activity Center is developed/redeveloped, consistent with Objective 10.03.00, an expansion to a subject Local Activity Center up to 100% may be proposed. Planning Council Staff Comment The amendment site consists of approximately 157.3 gross contiguous acres. 2. The density and intensity of land uses permitted within a proposed Local Activity Center shall be specified for inclusion within the Plan Implementation Requirements section of the Broward County Land Use Plan. Planning Council Staff Comment The corresponding Broward County Land Use Plan text amendment (PCT 03-3) specifies the following density and intensity of permitted land uses: Commercial maximum of 500,000 square feet Residential maximum of 2,465 dwelling units: 2,165 high rise units 200 garden apartments 100 townhouses Hotel maximum 640 rooms Community Facilities 4.7 acres Conservation 0.6 acres(minimum) —1— 3. Uses proposed within a Local Activity Center shall include residential uses and park land and/or open space. One or more other uses such as commercial, civic, institutional, or employment-based activity shall also be included within a Local Activity Center. Planning Council Staff Comment In addition to the land uses identified in the comment to number 2 above,the City proposes the inclusion of new open space through the creation of greenways, new parks and pedestrian- friendly streetscapes. The City's proposal incorporates an urban pedestrian trail network identified in Attachment 7.A.2. The City states that it intends to revise its land development regulations to provide for implementation of the proposed park and open space uses, and trail network as development occurs within the LAC. 4. Park land must reflect no net loss of acreage of existing and designated parks within the proposed Local Activity Center. Park and open space land may include squares, greenbelts, greenways and playgrounds;ill-defined residual areas such as buffers and berms,for purposes of this criteria, are not considered park land or open space. Planning Council Staff Comment No area within the boundary of the subject amendment site is currently developed or designated for"Recreation and Open Space" uses. However, the City's land use plan includes a 0.6 acre "Conservation"area which is proposed to remain as part of the LAC. It is also noted that an approximate nine (9) acre public park, located at the southwest corner of NE 2"d Street and Fronton Boulevard, currently exists contiguous to the proposed LAC boundary. S. To address proposed residential density above what is yielded by the present land use designations, local governments shall first utilize at least 75% of available "flexibility units" and"reserve units" from the flexibility zone where the Local Activity Center is located,before an increase in density is requested via the land use plan amendment process.A proposed Local Activity Center located within an approved Chapter 163, Florida Statutes, Redevelopment Area is exempt from this criteria. Planning Council Staff Comment Pursuant to City of Dania Beach Resolution 2003-147,the City has allocated 335 "flexibility units" or "reserve units" to the subject amendment area consistent with the requirement to allocate 75%of such available units from Flexibility Zone 84. 6. A proposed Local Activity Center must have a geographic configuration of appropriate depth and frontage to support the location of uses in a manner oriented around the five-minute(i.e. quarter-mile)walk. Multiple nodes of activity oriented around the five-minute (i.e. quarter- mile)walk may be included within one Local Activity Center. Planning Council Staff Comment As discussed in Attachment 7.A,the City proposes three activity nodes that are either multi-use activity nodes or community transit hubs. In this regard,the City is planning to create an urban pedestrian trail network,which would provide access to the activity nodes and transit. It is felt that pedestrian access within the proposed LAC is generally oriented around the five-minute i walk. —2— i within' 7. Seventy-five percent(75%)of the land within a Local Activity Center must be locatied a quarter-mile of mass transit or multi-modal facilities or are included within an adopted plan to be located within a quarter-mile of mass transit or multi-modal facilities upon buildout of the Local Activity Center. Local governments shall ensure convenient access to mass transit, community shuttle or multi-modal facilities where such facilities are in place or planned to be in place at the time the Local Activity Center is proposed.Where such facilities are not in place or planned to be in place at the time of the proposal,the local government shall require design standards in the local land use element for a Local Activity Center that ensure that the primary priority is a safe,comfortable and attractive pedestrian environment that will allow for convenient interconnection to transit,will reduce the number of automobile trips internally and will ultimately support an integrated multi-modal transportation system. Planning Council Staff Comment All areas within the amendment site are located with a quarter-mile of existing mass transit service. The proposed LAC is served by both Broward County Transit and community transit. 8. A proposed Local Activity Center shall demonstrate consistency with the goals,objectives and policies and other requirements of the Broward County Land Use Plan. Planning Council Staff Comment A detailed analysis of the proposal's consistency with the goals,objectives and policies of the BCLUP relevant to the LAC designation is included in Attachment 7.A. The consistency with the goals, objectives and policies of the BCLUP is also addressed in Section IV, Planning Considerations, of the staff report. 9. An interlocal agreement between the municipality and Broward County must be executed no later than six months from the effective date of the adoption of a Local Activity Center which provides that monitoring of development activity and enforcement of permitted land uses densities and intensities shall be the responsibility of the affected municipality. ORDINANCE NO. 2003-005-A- ® AN ORDINANCE OF THE CITY OF DANIA BEACH, FLORIDA, AMENDING THE FUTURE LAND USE ELEMENT OF THE DANIA BEACH COMPREHENSIVE PLAN TO CREATE THE LOCAL ACTIVITY CENTER ("LAC") LAND USE CLASSIFICATION; PROVIDING FOR TRANSMITTAL TO THE STATE AGENCIES PURSUANT TO SECTION 163.3184, FLORIDA STATUTES; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City desires to amend its Comprehensive Plan Future Land Use Element to create the land use classification for "Local Activity Center" ("LAC"); and WHEREAS, in conjunction with the creation of the land use classification, the City proposes to amend the City of Dania Beach Future Land Use Map to designate on the Future Land Use Map a Local Activity Center as applicable to a portion of the City's downtown; and ® WHEREAS, the City of Dania Beach Planning and Zoning Board, sitting as the Local Planning Agency, held a duly advertised public hearing on January 22, 2003, and determined that the proposed amendment is consistent with the goals and objectives of the City of Dania Beach Comprehensive Plan and therefore, recommended approval of the proposed amendment; and WHEREAS, the City Commission of the City of Dania Beach held a duly noticed public hearing on February 12, 2003, regarding the proposed amendment and determined that the amendment is in the interest of the City's public health, safety and welfare and should be adopted for transmittal to the Florida Department of Community Affairs for its review pursuant to Chapter 163, Florida Statutes. NOW THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA: 1 ORDINANCE NO. 2003-005-A- • Section 1. That the Future Land Use Element of the City of Dania Beach Comprehensive Plan is amended on first reading to establish the land use classification of "Local Activity Center" ("LAC") as follows: • s • III. ANALYSIS REQUIREMENTS — 9J-5.006(2) C. Land Requirements O • 1. Permitted uses in the City of Dania Beach Land Use Plan. t. Local Activity Center Use: • The intent of the Local Activity Center land use designation is to support a balanced mix of land uses characterized by compactness, pedestrian friendly design neighborhood-scale and framed by architecture and landscape design appropriate to local history and ecology. Development patterns within Local Activity Centers shall generally reflect planning and design principles such as walkable neighborhoods oriented around the five-minute walk primary orientation toward public transit systems, a centrally located community-serving land use or land uses and greater integration of housing employment shopping and recreation at the neighborhood level. For an area to qualify as a Local Activity Center, the following criteria must be met: 2 ORDINANCE NO. 2003-005-A- 1. A Local Activity Center shall be a specific geographic area • not exceeding 160 gross contiguous acres, unless located within an approved Chapter 163, Florida Statutes, Redevelopment Area. At such time as 75% of the originally designated Local Activity Center is developed/redeveloped an expansion to a subject Local Activity Center up to 100% may be proposed. 2. The density and intensity of land uses permitted within a proposed Local Activity Center shall be specified in the Dania Beach Land Use Element. 3. Uses proposed within a Local Activity Center shall include residential uses and park land and/or open space. One or more other uses such as commercial, civic, institutional, or employment-based activity shall also be included within a Local Activity Center. 4. Park land must reflect no net loss of acreage of existing and designated parks within the proposed Local Activity Center. Park and open spaces land may include squares, greenbelts, greenways and playgrounds; ill-defined residual areas such as buffers, and berms, for purposes of this criteria, are not considered park land or open space. 5. To address proposed residential density above what is yielded by the present land use designations, the City shall first utilize at least 75% of available "flexibility units" and "reserve units" from the flexibility zone where the Local Activity Center is located before an increase in density is requested via the land use plan amendment process. A proposed Local Activity Center located within an approved Chapter 163 Florida Statutes, Redevelopment Area is exempt from this criteria. 6. A proposed Local Activity Center must have a geographic configuration of appropriate depth end frontage to support the location of uses in a manner oriented around the five- minute (i.e. quarter-mile) walk. Multiple nodes of activity oriented around the five-minute (i.e. quarter-mile) walk may be included within one Local Activity Center. 7. Seventy-five percent (75%) of the land within a Local Activity Center must be located within a quarter-mile of mass transit or multi-modal facilities or are included within an adopted ® plan to be located within a quarter-mile of mass transit or 3 ORDINANCE NO. 2003-005-A- multi-modal facilities upon buildout of the Local Activity MCenter. Convenient access shall be provided to mass transit, community shuttle or multi-modal facilities where such facilities are in place or planned to be in place at the time the Local Activity Center is proposed. Where such facilities are not in place or planned to be in place at the time of proposal, the City shall provide design standards in the Land Use Element for a Local Activity Center that ensure that the Primary priority is a safe, comfortable and attractive pedestrian environment that will allow for convenient interconnection to transit, will reduce the number of automobile trips internally and will ultimately support an integrated multi-modal transportation system. 8. A proposed Local Activity Center shall demonstrate consistency with the goals, objectives and policies and other requirements of the Land Use Element. 9. An interlocal agreement between the City and Broward County shall be executed no later than six months from the effective date of the adoption of a Local Activity Center which provides that monitoring of development activity and enforcement of permitted land use densities and intensifies shall be the responsibility of the City. REQUIREMENTS FOR FUTURE LAND USE GOALS, OBJECTIVES AND POLICIES OBJECTIVE XXV. Encourage compact development reflecting characteristics which include a mixture of community-serving uses such as commercial, office, employment, civic, and institutional recreation and open space and residential, characterized by an efficient infrastructure, close-knit neighborhoods and sense of community, preservation of natural systems promotion of pedestrian circulation and convenient access to mass transit facilities through the establishment of a Local Activity Center land use category. Policy 25.1 Local Activity Centers shall support the location of uses in a manner oriented around the five-minute (i.e., quarter-mile) walk. Multiple nodes of activity oriented around the five-minute (i.e., quarter mile) walk may be included within one Local Activity Center. Policy 25.2 Local Activity Centers shall support the location of uses and internal circulation such that pedestrian mobility is a priority. All land uses in a Local Activity Center shall be directly assessed via pedestrian ways and accessible to existing or future alternate public transportation modes, including bicycle and transit. Policy 25.3 Park land and/or open space that is accessible to the public shall ® be included as a functional component within a Local Activity Center. 5 ORDINANCE NO. 2003-005-A- Policy 25.4 Housing opportunities shall be included as a functional component within a Local Activity Center. Policy 25.5 Encourage affordable housing opportunities in Local Activity Centers through various mechanisms such as the utilization of "affordable housing units." The direction of public housing program funds into the Local Activity Center, reduced lot size for dwelling units, construction of zero lot line and cluster housing, vertical integration of residential units with non-residential uses, the allowance of accessory dwelling units, or through other mechanisms proven effective in increasing the affordable housing stock. Policy 25.6 Promote the rehabilitation and use of historic buildings within Local Activity Centers. Policy 25.7 The City shall adopt design guidelines that incorporate pedestrian and bicycle paths and greenways to accomplish fully-connected routes to all destinations within the Local Activity Center. The paths should be spatially defined by buildings, trees and lighting, and should incorporate designs, which discourage high speed traffic. • Policy 25.8 The City shall ensure convenient access to mass transit or multi- modal facilities within Local Activity Centers. Policy 25.9 The City's community shuttle shall serve the residents and employees within the proposed Local Activity Centers. Policy 25.10 The City shall adopt local design guidelines that require transit shelters in the Local Activity Center to provide safe and comfortable service and to encourage transit usage. Policy 25.11 The City shall promote development of key intersections or major transit stops to create modes of development within a Local Activity Center. Policy 25.12 The City shall review existing zoning and land development regulations and adopt changes necessary to implement the Local Activity Center land use designation by 2004. Section 2. That the City Commission authorizes the City Manager to transmit the Future Land Use Element amendment to the state agencies as required by Section 163.3184, Florida Statutes. 6 ORDINANCE NO. 2003-005-A- Section 3. If the LAC is ultimately approved, no change in zoning would take place until such time as the Commission adopts zoning code amendments to implement the LAC designation. EXISTING LAC AREA ZONING Existing zoning within the LAC Area is predominantly "commercial" (see attached map). Commercial zoning includes C-1, C-2, and C-3 zoning districts. All "C" Districts allow buildings up to three stories in height with a 10 foot front yard setback. The only residential zoning in the proposed LAC is 1.5 acres of RD-8000 located on the east side of SW 1st Court between Stirling Road and SW 1s, Street. EXISTING ZONING ABUTTING THE LAC Existing development abutting the LAC Area consists primarily of commercial, duplex, and multifamily uses. The only single family zoned parcel that abuts the LAC is the vacant tomato field north of Jai Alai, now zoned RS-8000. This Future Land Use Plan designation of this property (since 1980) is Residential 10. 2 CURRENT LAC FUTURE LAND USE The proposed LAC area (see attached map) currently contains 181 acres. As indicated below, most of the proposed LAC land consists of property with a "Commercial" or "Commercial Recreation" Land Use. The latter category is the existing Jai Alai Fronton and surrounding parking area. Please note the tomato field property is not within the proposed LAC boundaries. At this time, staff recommends preserving these units for small scale (1 - 3 acre), medium density (10 - 12 units per acre), residential and mixed-use redevelopment in other parts of the CRA, particularly along U.S. 1 south of Stirling Road. The current development potential of the LAC area is over 2 million square feet of commercial use. This is based on the current Future Land Use Plan, which identifies 130 acres of commercial land in the LAC area, and the existing "C zoning, which allows buildings up to three stories in height. Excluding Jai Alai, staff estimates over 200,000 square feet of retail, office, and hotel floor area currently in the downtown area. PROPOSED FUTURE LAND USE MAP DESIGNATIONS WITHIN THE LAC Instead of restricting each parcel of land within the LAC to a specific use, the proposed LAC land use would establish maximum development potential based on the densi and square footage of different types of uses. Site-specific regulations (use and area requirements) would be addressed by the zoning code. Garden apartment units: Three or fewer floors of residential. Townhouse units: Two or three story (up-and-down) units. The mix of high-rise, garden apartments, and townhouse units was based on recommendations from Henry Iler and Associates and Leigh Robinson Kerr and Associates. While the establishment of a new 2,800 unit pool is substantial, it • amounts to an area-wide average density of 16 units per acre. 4 Meadowbrook, the Danians, and the Sheridan Beach Club Apartments (located west of Publix on Sheridan) were built at 25 to 35 units per acre. If the LAC unit pool is not approved, new residential projects will be subjected to the lengthy and uncertain county land use plan amendment process. The LAC unit pool creates a "reservoir of units" available to be assigned on a site-specific basis, based upon the merits of each individual project. The City Commission can refuse to allocate LAC units if a proposal does not meet the city's adopted zoning and urban design requirements. Until new zoning and design criteria are adopted by the City Commission, the existing zoning controls remain in place. Preliminary technical analysis by Kerr and Associates indicates adopting the LAC as proposed would result in the following impacts. Please note this is a comparison of maximum development under current comprehensive plan vs. maximum development under the proposed LAC plan. (2) The City currently has sufficient park land to meet the parks requirement (The parks requirement need not be met within the LAC as long as It is provided within city boundaries). (3) Student generation from City Place (West Palm Beach) and Mlzner Park (Boca Raton) indicate that the student generation rates used by Broward County may greatly overestimate the number of students expected from "high-density, mixed-use" developments. Based on the other communities, Dania's 2,800 unit LAC would generate fewer than 55 additional students. 5 The consultant's technical analysis indicates the following: 1) The LAC would result in fewer vehicle trips as compared with the current Future Land Use Plan for the LAC area. Most traffic on US 1 is "pass though" traffic that neither originates nor terminates within Dania Beach city limits. Additional traffic is expected on U.S. 1 based on development activity occurring entirely outside the City. 2) The LAC would generate less solid waste than the current Future Land Use Plan for the LAC area. 3) The LAC would generate additional students, although the number of students varies considerably (between 50 and 299 students) depending on which standard is used. Further study is required in this area. 4) The LAC would generate additional demand for water and sewer service. The Public Works/Utilities Director indicates that sufficient water capacity will be available by October 1, 2003 and that sufficient sewer capacity is currently available based on contractual agreements with the City of Hollywood.
