AN ORDINANCE AMENDING THE FUTURE LAND USE PLAN
ELEMENT OF THE LOCAL COMPREHENSIVE PLAN OF THE CITY
OF DANIA BEACH, FLORIDA; REQUEST BY CHARLES PUTNAM &
ASSOCIATES, INC. REPRESENTING BARRY MORRIS, OCEAN
DEVELOPMENT PROPERTIES LLC., TO REDESIGNATE FROM
"RESIDENTIAL 16" AND "COMMERCIAL" TO "IRREGULAR
RESIDENTIAL 15" (15 DWELLING UNITS / ACRE) FOR PROPERTY
LOCATED ON THE EAST SIDE OF GULFSTREAM ROAD AND
ALONG THE NORTH SIDE OF DANIA BEACH BOULEVARD, DANIA
BEACH AND LEGALLY DESCRIBED IN EXHIBIT "A", A COPY OF
WHICH IS ATTACHED TO THIS ORDINANCE; PROVIDING THAT
ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT
WITH THIS ORDINANCE ARE REPEALED TO THE EXTENT OF
SUCH CONFLICT; FURTHER, PROVIDING FOR AN EFFECTIVE
DATE.
WHEREAS, Barry Morris, Ocean Development Properties, LLC. has made an
application to amend the local future land use plan for the proposed construction of a
288 unit multi-family development; and
WHEREAS, the City Commission desires to approve said application.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY
OF DANIA BEACH, FLORIDA:
Section 1. That the Future Land Use Element and Map is amended as
described below:
THE FUTURE LAND USE PLAN ELEMENT OF THE LOCAL COMPREHENSIVE
PLAN OF THE CITY OF DANIA BEACH, FLORIDA, IS AMENDED TO
REDESIGNATE FROM "RESIDENTIAL 16" AND "COMMERCIAL" TO
"IRREGULAR RESIDENTIAL 15" (15 DWELLING UNITS / ACRE) FOR
PROPERTY LOCATED ON THE EAST SIDE OF GULFSTREAM ROAD AND
ALONG THE NORTH SIDE OF DANIA BEACH BOULEVARD, DANIA BEACH
AND LEGALLY DESCRIBED IN EXHIBIT"A", A COPY OF WHICH IS ATTACHED
TO THIS ORDINANCE.
Section 2. If any section, clause, sentence or phrase of this ordinance is for any
reason held invalid or unconstitutional by a court of competent jurisdiction, the holding
shall not affect the validity of the remaining portions of this ordinance.

Section 3. All ordinances or parts of ordinances in conflict with the provisions of
this ordinance are hereby repealed.
Section 4. The staff shall submit this amendment to the Broward County
Planning Council for re-certification.
Section 5. This ordinance shall take effect immediately at the time of its
passage. However, this plan amendment shall not become effective until the conclusion
of the process and time frames set out in Section 163.3187(3)(a) of the Florida Statutes
and re-certification by the Broward County Planning Council.

SUBJECT: LU-22-03: Request by Charles Putnam & Associates, Inc.
representing Barry Morris, Ocean Development Properties
LLC., for property located on the east side of Gulfstream
Road and along the north side of Dania Beach Boulevard,
for Land Use Plan Amendment from "Residential 16" and
"Commercial" to "Irregular Residential 15" (15 dwelling
units/acre) (Second'Reading).
On May 28, 2003 the City Commission approved the applicant's request assigning
an additional 54 flex/reserve units to the subject property allowing a total of 288
• dwelling units to be constructed.
CURRENT COMPREHENSIVE PLAN DESIGNATION:
"Commercial" (Front Parcel: 4.76 acres fronting Dania Beach Boulevard)
"Residential 16" (Rear Parcel: 14.65 acres behind the Front Parcel)
PROPOSED COMPREHENSIVE PLAN DESIGNATION:
Irregular Density Residential (15 dwelling units per acre).
TOTAL PROPERTY SIZE:
19.41 gross acres.
Land Use Analysis
Based on information provided by the applicant, approximately 3 - 4 acres of the
front parcel consists of developable uplands. The back portion of the front parcel
and the rear parcel contain wetlands and mangroves. Based on current land use
plan designations, the applicant could construct approximately 60,000 — 80,000
square feet of retail/office space and 234 dwelling units.
The applicant proposes amending the Comprehensive Plan to allow "zero" square
feet of commercial and 288 dwelling units. Due to the environmental restrictions
affecting this property, all 288 dwelling units, if approved, would most likely have
to be located in one or two large buildings, estimated 10 — 14 floors in height,
located on the upland portion of the site adjacent to Dania Beach Boulevard.
Conceptually, the land use change would allow the applicant to "move" the
currently allowed 234 units from the rear wetland parcel to the front upland
parcel.
The Comprehensive Plan designation and existing land use for the surrounding
properties are as follows:

The proposal is generally compatible with the surrounding properties. The parcel
• is somewhat isolated and does not directly abut single family residential use,
making it generally appropriate for high-rise multi-family use if quality
architecture, landscaping, and site design is applied. These issues will be
addressed during site plan review.
Staff has explained to applicant that the current zoning designation limits height
to 40 feet and that approval of the land use plan amendment confers no vested
rights or entitlements with of any kind beyond what is allowed under current
zoning The applicant has also been advised the maximum building height
cannot exceed 62 feet without a 4/5 vote of the City Commission.

The proposed land use plan amendment would result in the following:
® a) Increased demand for sanitary sewer and potable water from a net
increase of 54 dwelling units.
b) Decreased traffic trip generation due to the absence of commercial/retail
development.
c) Decreased school enrollment (High rise units generate fewer students
than mid-rise or garden apartment units).
The applicant will have to obtain written confirmation from the Public
Works/Utilities Director that sufficient sewer and water capacity is available.
PLANNING AND ZONING ADVISORY BOARD RECOMMENDATION
The Planning and Zoning Advisory Board recommended approval of the
requested Land Use Plan Amendment.
CITY COMMISSION ACTION (FIRST READING):
Approval.
STATE OF FLORIDA DEPARTMENT OF COMMUNITY AFFAIRS (DCA):
• DCA waived their right to review and comment on the Land Use amendment.
SOUTH FLORIDA REGIONAL PLANNING COUNCIL RECOMMENDATION:
On August 4, 2003 the South Florida Regional Planning Council Executive Board
denied the applicants proposal on first review because of unresolved school
impact concerns. The SFRPC suggested they would support the amendment
pending the approval of Bro ward County School Board staff.
STAFF RECOMMENDATION:
Approval, with the condition that the applicant confirms that school board staff
has verbally indicated no objection to the amendment.

I. INTRODUCTION AND OVERVIEW
Herein transmitted is an application package presenting the details of a proposed land use
amendment relative to a 19.41 acre tract of land that is located on the eastern side of the
City of Dania Beach. The general location of the site is shown on Exhibit A.
The subject property is currently land used to allow commercial development along the
Dania Beach Boulevard frontage, and medium density residential development up to 16
units per acre in the rear acreage. (See Exhibit D - Existing Land Use). This
amendment proposes to modify that land use classification to show an irregular
residential density_of 14.8 units per acre on the entire 19.41 acre site in the manner

• Reason for Amendment:
The petitioner would like to develop the acreage for residential purposes. The portion of
the site that is currently assigned a residential classification is in the rear of the property
in an area that contains jurisdictional wetlands. The front portion of the site contains
developable uplands but that area is classified as commercial. The proposed change will
make the entire property residential and allow all of the resulting density to be transferred
to the upland area where the applicant proposes to construct a multi-story residential
complex.
Impacts of the Proposed Amendment:
The enclosed application attempts to address all of the potential impacts of the proposed
amendment. However, the primary impacts will be as follows:
• The approval of the amendment will allow all development to occur on
the upland area of the site and the more sensitive areas to be preserved.
• Since the petition calls for the elimination of the commercial land use
classification on the site many of the impacts such as for traffic will
actually be reduced.

• The net increase in residential potential resulting from the petition will be
54 multi-family units. While this is, in fact, an increase it is a small
change when considered City-wide and is expected to have minimal
impacts on any City services and functions.
• Clustering the remaining density on the smaller upland acreage will
require vertical rather than horizontal development and will allow the
resulting units to be classified as high-rise units which have even lower
rates of service impacts than do the existing garden apartments.
The approval of this petition will be consistent with City and County objectives calling
for the preservation of environmentally sensitive areas and the re-vitalization of urban
in-fill areas. The details of the proposed change and the related impacts are described in
more detail in the following sections of this application.

III. AMENDMENT SITE DESCRIPTION
A. Concise written description of the general boundaries and gross acreage (as
defined by BCLUP) of the proposed amendment.
The subject site consists of a total of 19.41 acres located north of Dania Beach
Boulevard in the eastern portion of the City. Exhibit A is an area sketch that
shows the general location of the site relative to area properties and roadways.
B. Sealed survey, including legal description of the area proposed to be amended.
Exhibits B and B.1 are copies of the current survey and legal description for
the site. The property is actually comprised of several individually described
parcels that make up the gross site area of 19.41 acres.
C. Map at a scale of V = 300' clearly indicating the amendment's location,
boundaries and proposed land uses.
Exhibit C is an aerial photograph showing the site relative to area land use and
. transportation corridors. The site is currently vacant. Current zoning and
land use allocations on the property are described in later sections.
The aerial photo for the property also serves to identify the existing
environmental conditions on the site. A majority of the land on the subject
property is wetland while portions on the south along Dania Beach Boulevard
are upland areas where future site development is proposed.

The intent of this land use amendment is to reclassify the entire parcel to an
irregular residential land use designation with an overall density limitation of
14.8 units per acre. See Exhibit D.3. It is the applicant's further intention to
re-zone the site to a residential PUD classification that will allow a clustered
development to occur on the upland portion of the site. See Exhibit E for the
City's Zoning Designations inclusive of and surrounding this property.
Exhibits E.1 and E.2 indicate the current zoning and proposed zoning of the
property.

The City and local land use plan allocations would allow the development of
234 multi family units on the site and an estimated 62,200 square feet of retail
commercial use. This application proposes to eliminate the commercial use on
the property and convert the entire area to an irregular residential
classification that will allow 288 multi family, high-rise units to be built.
V. ANALYSIS OF PUBLIC FACILITIES AND SERVICES
The items below must be addressed to determine the impact of an amendment on existing
and planned public facilities and services. Provide calculations for each public facility
and/or service. If more than one amendment is submitted, calculations must be prepared
on an individual and cumulative basis.
A. Sanitary Sewer Anal:
1. Identify whether the site is currently and/or proposed to be serviced by
septic tanks.
• The site is vacant. Public sewer will be used for new development.
2. Identify the sanitary sewer facilities serving the service area in which the
amendment is located including the current plant capacity, current and
committed demand on plant capacity, and committed plant capacity.
The proposed new development on the site will be served by existing
lines in place along Dania Beach Boulevard which connect to the
Southern Regional Wastewater Treatment Plant in Hollywood. As
noted on Exhibit G herein, the City has reserved a capacity of 3.5 mgd
in that plant. Current usage estimated at 2.8 mgd., leaving capacity
available for new development. As noted on Exhibit G the incremental
demand for sewer service resulting from this project will be 7,030 gp.d.
This is a very small increase for a system with such a large capacity
and will not represent a service problem.
3. Identify the change in demand on plant capacity resulting from this
amendment. Provide calculations, including anticipated demand per
square foot or dwelling units.
See Exhibit G. The increased demand resulting from the project is
• estimated to be 7,280 gp.d.

also plans in process to expand the current capacity.

lateral hookups to the amendment site.
There are existing service lines in place on Dania Beach Boulevard
that can service the needs of the project.
B. Potable Water Analysis:
l. Provide the adopted level of service standard for the service area in which
the amendment is located.
The level of service for the area of the subject site is 100 gallons per day
per person.
2. Identify the facilities serving the service area in which the amendment is
located including the current plant capacity, current and committed
demand on the plant and the South Florida Water Management District
(SFWMD)permitted withdrawal.
Water service for new development on the site will be provided by Dania
Beach Water& Utilities. Currently, they have a plant capacity of 3.0
mgd with an estimated demand of 2.6 mgd. There are plans in process
to expand the system to a capacity of 5.0 mgd. by the year 2005. See
Exhibit G.
3. Identify the wellfield serving the service area in which the amendment is
located including the permitted capacity, committed capacity, remaining
capacity and expiration date of the permit.
The area is currently served by two well fields located off of Lake Shore
Drive in the City of Dania Beach.

As noted on Exhibit G, the incremental increase in water demand
resulting from this land use amendment is 5,338 gp.d. This is a very
small increase and will not have an impact on current levels of service.
5. Identify the projected capacity and demand for the short and long range
planning horizons as included within the adopted comprehensive plan -
provide demand projections and information regarding planned plant
capacity expansions including year, funding sources and other relevant
information. If additional wellfield are planned,provide status including
the status of any permit applications.
The incremental demand created by this land use amendment will not
require plant or well field expansion.
6. Provide information regarding existing and proposed trunk lines and
water main hookups to the amendment site.
Future site development will be served by existing lines currently in
place on Dania Beach Boulevard.
C. Drainage Analysis:
1. Provide the adopted level of service standard for the service area in which
the amendment is located.
The adopted level of service standard for the City of Dania Beach is
established by Broward County. Currently this area is in compliance.
2. Identify the drainage systems serving the service area in which the
amendment is located.
The project will drain through the existing network of facilities
currently serving the eastern area of Dania Beach or through other
acceptable methods allowed by permitting agencies. Since the
applicant proposes to cluster new development on the upland area, the

amount of impervious area to be addressed for drainage purposes will
not be great. In fact, it will be much less than if the entire 19.41 acres
was developed for residential use.
3. Identify any planned drainage improvements, including year, funding
sources and other relevant information.
The Dania Beach Public Works Department has indicated that they
would not anticipate this project creating any deficiencies in the area
drainage network. Some line extensions may be needed to connect to
existing facilities.
4. Indicate if a Surface Water Management Plan has been approved by, or
an application submitted to, the SFWMD and/or any independent
drainage district, for the amendment site.
No Water Management plans for the project have been generated as of
the date of this application.
5. If the area in which the amendment is located does not meet the adopted
level of service and there are no improvements planned (by the unit of
local government or drainage authority) to address the deficiencies,
provide an engineering analysis which demonstrated how the site will be
drained and the impact on the surrounding properties.
The information should include the wet season water level for the
amendment site, design storm elevation, natural and proposed land
elevation, one hundred year flood elevation, acreage for proposed water
management retention area, elevations for buildings, roads and years,
storage and runoff calculations for the design storm and estimated time
for flood waters to recede to the natural land elevation.
Service levels in the area drainage network will not be impacted by this
proposed land use amendment.
D. Solid Waste:
1. Provide the adopted level of service standard for the service area in which
the amendment is located.

The City estimates that multi family units generate 8.9 lbs. of solid
waste per unit per day.
2. Identify the facilities serving the service area in which the amendment is
located including the landfill/plant capacity, current demand on
landfill/plant capacity and committed landfill/plant capacity.
The City contracts with Reuter,Inc. to provide solid waste pick-up and
removal. Reuter,Inc. is permitted to process 5,000 tons of MSW daily
and their current demand is 2,000 tons with 1,500 tons committed. Any
residual solid waste is currently directed to either of two Waste
Management,Inc. of Florida Landfills -Central Disposal and Sanitary
Landfill or Okeechobee Landfill.
3. Identify the change in demand resulting from this amendment. Provide
calculations including assumed demand per square foot* or dwelling unit.
As noted on Exhibit H,the actual amount of solid waste to be generated
from the property as a result of this land use amendment is projected
• to decrease by 5,117 lbs./day. That is due primarily to the elimination
of the proposed commercial use.
E. Recreation and Open Space Anal
l. Provide the adopted level of service standard for the service area in which
the amendment is located and the current level of service.
City standards have established a service level for local parks of 3
acres/1,000 population.
2. Identify the parks serving the service area in which the amendment is
located including acreage and facility type, e.g. neighborhood,
community or regional park.
The community park currently serving the subject property is Frost
Park. (See Exhibit M for the Park's proximity to the subject property.)
This park is undertaking a total redesign. The City is currently
upgrading the facilities to include a new recreation building, new
tennis& basketball courts, as well as hiking trails and exercise stations.

3. Quantify the change .in need for park acreage resulting from this
amendment.
Based on current City standards, the proposed land use amendment
will have a minimal impact on park needs in the City. The anticipated
population increase of 11 S persons will create a need for.34 additional
park acres.
4. Identify the projected park needs for the short and long range planning
horizons as identified within the adopted comprehensive plan -provide
need projections and information regarding planned capacity expansions
including year,identified funding sources,and other relevant information.
The incremental park requirement of .34 acres will not create a
demand for new facilities or expansion of existing facilities. The
current expansion of Frost Park along with on-site facilities that can
be anticipated within any new project should serve to adequately meet
• the needs of the expanded needs.
F. Traffic Circulation Analysis:
l. Identify the roadways impacted by the proposed amendment and indicate
the number of lanes, current traffic volumes, adopted level of service and
current level of service for each roadway.
The property is and will be served by one primary roadway which is
Dania Beach Boulevard. Dania Beach Boulevard is a State maintained
road serving as a major east-west arterial in this south central area of
the County. Dania Beach Boulevard is part of the AIA roadway
system. It is currently a four-lane, divided roadway with an ultimate
design capacity of six lanes. Per the Broward County Department of
Planning& Environmental Protection, this road has a design capacity
sufficient to handle around 3,020 peak hour trips per segment.
Current usage is estimated at about 47% on the segment of Dania
Beach Boulevard from US I to Fronton Boulevard, and 68% on the
segment from Fronton Road to A.A. Both segments are well below
capacity.

2. Identify the projected level of service for the roadways impacted by the
proposed amendment for the short (five year) and long term (2025)
planning horizons. Please utilize average daily traffic volumes per
Broward County Metropolitan Planning Organization plans and
projections.
Exhibit I presents the trip generations comparison between the current
land use potentials and those proposed for this amendment. As shown
on this exhibit, it is anticipated that total traffic generation will
decrease by 496 peak hour trips. Thus, the approval of this amendment
will serve to improve the level of service on the roadways.
It should also be noted that the site is located in an urban in-fill area
which is exempt from concurrency.
G. Mass Transit Analvsis:
1. Identify the mass transit modes serving the amendment area.
This project is served by the Broward County Mass Transit network.
There is currently a bus stop located at Gulfstream Road and Dania
Beach Boulevard,part of Route 7. See Exhibit N.
2. Identify the change in demand resulting from this amendment.
With an increase to the population by only 115 people, there will not be
a significant demand to warrant any additional routes.
3. Identify the existing and planned mass transit routes and scheduled
service (headway) for the amendment area.
Bus route 7 is currently serving this area and has frequent stops along
Dania Beach Boulevard.

This development is residential and part of an area the City has
included in a proposed CRA district. It is consistent with a transit
oriented development due t being part of a network of mass transit
already in place in this area. Also, residential at this location
encourages other modes of transportation due to its proximity to the
City's downtown district and the Atlantic Ocean.
VII. ANALYSIS OF NATURAL AND HISTORIC RESOURCES:
Indicate if the site contains, is located adjacent to or has the potential to impact any of
the natural and historic resource(s) listed below, and if so, how they will protect or
mitigated. Planning Council staff will request additional information from the
Department of Planning and Environmental Protection and the Broward County
Historical Commission regarding the amendment's impact on natural and historic
resources. The applicant is encouraged to contact the individual review agencies to
discuss these issues.
A. Historic sites or districts on the National Register of Historic Places or locally
designated historic sites.
There are no known historical sites on the property.
B. Archaeological sites listed on the Florida Master Site File.

C. Wetlands.
Mangrove wetlands currently exist on the site. It is a forested system
consisting of red mangrove (Rhizophora mangle), white mangrove
(Laguncularia racemosa), and black mangrove (Avicennia germinans). No
encroachment into or use of these jurisdictional areas will be possible without
obtaining the necessary permits from the regulating agencies.

In accordance with Broward County's "Potable Water Supply Wellfield
Protection Zone of Influence"Ordinance, the project site is not located within
a wellfield protection zone.
H. Soils - describe whether the amendment will require the alteration of soil
conditions or topography. If so, describe what management practices will be used
to protect or mitigate the area's natural features.
The soil in the project site consist of Perrine variant silt loam (Pv),Perrine silty
clay loam (Ps), Lauderhill muck (La), and Udorthents (Um) or urban land
complex. The Perrine series of soils and Lauderhill muck is listed as a hydric
soil for Broward County.
Alterations to the topography will mainly be concentrated in the Udorthents soil
area, or upland area. Any alterations to the hydric soils will be mitigated on
site. Protection to the surrounding soils will be accomplished by the installation
of silt fences to contain any construction debris and excessive siltation.

public beach access will be addressed.
The property is not oceanfront land.
VIII. LAND USE COMPATIBILITY
Describe how the amendment is consistent with existing and planned future land uses
in the area(including adjacent communities). Identify specific land development code
provisions or other measures that have or will be utilized to ensure land use
compatibility.
As noted in the Introduction and Overview for this amendment, the creation of an
irregular land use classification for the site will allow for the clustering of the
resulting residential density on the available upland areas. These uplands are located
on Dania Beach Boulevard, which is a primary east-west arterial serving the City
and a street that the City has earmarked for major re-development. Existing land
uses along this corridor are the most intense in the City and a high-rise multi family
® development project such as is proposed to this site would be consistent with that
existing and anticipated pattern of use.
The only existing land use that will be near the proposed development area for the
project is an existing motel facility located several hundred feet west of the subject site
on Dania Beach Boulevard. This would be a compatible use to the proposed high-rise
facility.
IX. HURRICANE EVACUATION ANALYSIS
(Required for those land use plan amendments located in a hurricane evacuation zone
as identified by the Broward County Emergency Management Division)
Provide a hurricane evacuation analysis based on the proposed amendment, considering
the number of permanent and temporary residential dwelling units (including special
residential facilities) requiring evacuation, availability of hurricane shelter spaces, and
evacuation routes and clearance times. The hurricane evacuation analysis shall be based
on the best available data/modeling techniques as identified by the Broward County
Emergency Management Division.

This project is located in a "Plan B" evacuation area as defined by the Broward
Emergency Management Division (See Exhibit L). A "Plan B"area is required to
evacuate if a hurricane of a category 3 or higher threatens the area. Evacuation
routes are identified by signage along the major roadways leading west of the
property. Heading west on Dania Beach Boulevard and then north or south on
Federal Highway depending on which shelter or destination point the person is
seeking. The following two shelters are nearest the property:

There are also special needs shelters available to those who register with the County's
Elderly and Veteran Affairs Division. These shelter locations are not disclosed to the
general public and change by the year. Once registered these people are retrieved via
the public transportation system and taken to the shelters.
The proposed project will have approximately 288 permanent residential units and
will be designed with the features necessary to have an expedient response time if a
® category three hurricane were to threaten the residents.
X. REDEVELOPMENT ANALYSIS
Indicate if the amendment is located in an identified Redevelopment(i.e., Community
Redevelopment Agency, Community Development Block Grant) area. If so, describe
how the amendment will facilitate redevelopment and promote approved redevelopment
plans.
This site has been earmarked for inclusion in a CRA being proposed by City staff.
However, that proposal has not as yet been adopted.
XI. INTERGOVERNMENTAL COORDINATION:

XII. CONSISTENCY WITH GOALS OBJECTIVES AND POLICIES OF THE
DANIA BEACH LAND USE PLAN
List of objectives and policies of the Dania Beach Land Use Plan which the proposed
amendment furthers.
The Dania Beach Comprehensive Plan established a wide range of Goals and
Objectives relating to the arrangement of land uses, concurrency, levels of service,
etc. It would appear that this proposed amendment is consistent with all applicable
objectives and particularly furthers the following goals.
• Objection I.
Policy 1.1 - Provide for a mix of residential communities which will promote a
diverse population and a healthy environment.
Policy 1.13 - The City's land development regulations shall enable a variety of
housing types to accommodate the housing for all income levels in the City of
Dania Beach. The City shall encourage the inclusion of low and moderate
housing opportunities in large-scale residential developments. (B.C.P. #1.07.03)
• Objection VI.
Policy 6.2 - Maintain the quality of the existing wildlife habitats and natural
resources within the community.
Policy 6.3 - Continue to protect and identify environmentally sensitive lands.
Protect any identified future water wellfields in accordance with the wellfield
protection ordinance.
• Obi ction XVII.
Protect wetlands, hydric soils and the vegetative communities historic to the areas
within Dania Beach for their natural functions, such as storing freshwater,
filtering storm water runoff and preventing erosion. (B.C.P. #09.05.00)

XIII. POPULATION PROJECTIONS
1. Population projections for the 20 year planning horizon (indicate year).
The population projections called out in the Dania Beach Comprehensive Plan are
presented herein on Exhibit J. It is estimated that by the year 2010 the City will
have combined resident and seasonal population of 21,362 people.
2. Population projections resulting from proposed land use (if applicable).
Exhibit J shows the anticipated population increase to be generated by the
proposed amendment which is expected to be 115.02 people. It is further
anticipated that this population increase will be manifested in the 2005-2010
planning period.
3. Using population projections for the 20 year planning horizon, demonstrate the effect
of the proposed amendment on the land needed to accommodate the projected
population.
The potential population increase that could be generated from this project is less
than I% of the current projected totals and will not increase the amount of land
needed to accommodate those future residents.

PUBLIC EDUCATION ANALYSIS:
Please be advised that the Planning Council staff will request from the Broward County School
Board an analysis of the impacts of the amendment on public education facilities as indicated
below. The applicant is encouraged to contact the School Board staff to discuss these issues:
1. Identify the existing public elementary and secondary education facilities serving the area
in which the amendment is located.
This project is located in the Broward County School District 6. The schools currently
serving the area are shown on Exhibit K, and include the following:
• Elementary School - Dania Beach Elementary
• Middle School - Olsen Middle School
• High School - South Broward High School
2. Identify the existing school enrollment and permanent design capacity of the public
elementary and secondary education facilities serving the area.
The current enrollment and design capacity of each of the area schools are shown on
Exhibit K, contained herein.
3. Identify the additional student demand resulting from this amendment - calculations must
be based on applicable generation rates specified in the Broward County Land Development
Code.
Exhibit K,is a comparative chart showing anticipated student populations for the existing
level of development allowed by the City's Land Use Plan and that projected for the
proposed amendment. As noted on the exhibit, the impact on local school facilities is
projected to decrease by about 30 students due to the change from garden apartments to
high-rise.
4. Identify the planned and/or funded improvements to serve the area in which the amendment
is located as included within the School Board's five year capital plan - provide student
demand projections and information regarding planned permanent design capacities and
other relevant information.
As noted above,projected student generation is expected to decrease as a result of this
land use amendment, thus no new facility demand will be created.

The above requests are intended to permit a 288 unit
multi-family development.
CURRENT COMPREHENSIVE PLAN DESIGNATION:
"Commercial" (Front Parcel: 4.76 acres fronting Dania Beach Boulevard)
"Residential 16" (Rear Parcel: 14.65 acres behind the Front Parcel and Motel 6)
PROPOSED COMPREHENSIVE PLAN DESIGNATION:
Irregular Density Residential (15 dwelling units per acre).
TOTAL PROPERTY SIZE: 19.41 gross acres.
Land Use Analysis
Based on information provided by the applicant, approximately 3 - 4 acres of the
front parcel consists of developable uplands. The back portion of the front parcel
and the rear parcel contain wetlands and mangroves.

Based on current land use plan designations, the applicant could construct
approximately 60,000 — 80,000 square feet of retail/office space and 234
dwelling units. The applicant proposes amending the Comprehensive Plan to
allow "zero" square feet of commercial and 288 dwelling units. Due to the
environmental restrictions affecting this property, all 288 dwelling units, if
approved, would most likely be have to be located in one or two large buildings
(estimated 10 — 14 floors in height) located on the upland portion of the site
adjacent to Dania Beach Boulevard.
Conceptually, the land use change would allow the applicant to "move" the
currently allowed 234 units from the rear wetland parcel to the front upland
parcel. The applicant has requested an additional 54 flex/reserve units to allow a
total of 288 dwelling units.
The Comprehensive Plan designation and existing land use for the surrounding
properties are as follows:

The proposal is generally compatible with the surrounding properties. The parcel
is somewhat isolated and does not directly abut single family residential use,
making it generally appropriate for high-rise multi-family use if quality
architecture, landscaping, and site design is applied. These issues will be
addressed during site plan review.
Staff has explained to applicant that the current zoning designation limits height
to 40 feet and that approval of the land use plan amendment and/or reserve unit
allocation confers no vested rights or entitlements with of any kind beyond what
is allowed under current zoning. Applicant has also been advised the maximum
building height cannot exceed 62 feet without a 4/5 vote of the City Commission.
Flex Unit Assignment
This subject parcel is located within, a geographic planning area known as
Flexibility Zone 84. Flex Zone 84 includes that portion of the City east of the FEC
railroad tracks. Based on this application and other pending flex/reserve unit
applications, allocation of 54 flex/reserve units to the subject parcel will leave a
balance of approximately 90 flex units in Flex Zone 84. The reserve unit pool will
be exhausted.

Nearly 60% of the flex/reserve units in Flex Zone 84 (439 units) have already
been assigned to four projects along Sheridan Street.

The proposed land use plan amendment/reserve unit allocation would result in
the following:
a) Increased demand for sanitary sewer and potable water (due primarily
and in proportion to the additional 54 dwelling units).
b) Decreased traffic trip generation (due to the absence of commercial/retail
development).
c) Decreased school enrollment (High rise buildings generate fewer students
than mid-rise or garden apartments).
• The applicant will have to obtain written confirmation from the Public
Works/Utilities Director that sufficient sewer and water capacity is available.
PLANNING AND ZONING ADVISORY BOARD RECOMMENDATION
The Planning and Zoning Advisory Board recommended approval of the
requested Land Use Plan Amendment.
The Planning and Zoning Advisory Board recommended approval of the 54
reserve/flex units.
STAFF RECOMMENDATION
Land Use Plan Amendment: Approval.
Assignment of Reserve Units: Approval to allocate 54 flex and/or reserve
units for 12 months. At the end of the 12 month period, the applicant will have
to demonstrate to the satisfaction of the City Commission that he has made
sufficient progress to extend the flex allocation for additional time.
Staff is recommending a 12 month flex/reserve allocation because the State
Mandated Land Use Plan Amendment will take approximately 12 months

Staff also requests the properly owner acknowledge the following in writing:
1) The flex/reserve allocation confers no vested rights or entitlements with
respect to building design, building height, setbacks, density, required
parking, or landscaping beyond what is allowed or required under existing
zoning.
2) Due to the size and scale of the project, certain issues must be addressed
before the flex/reserve allocation can be made permanent. These include,
but are not limited to, density, building height, setbacks, design, and
architecture.
