Home My WebLink AboutO-2003-028 Amending City Charter replacing public work department and utilities department with Department of public services ORDINANCE NO. 2003-028 AN ORDINANCE OF THE CITY OF DANIA BEACH, FLORIDA, AMENDING THE CITY CHARTER AND THE CITY CODE OF ORDINANCES TO UPDATE REFERENCES TO CERTAIN CITY DEPARTMENTS AND TO TRANSFER A DIVISION FROM ONE DEPARTMENT TO ANOTHER; REPLACING THE TERMS "PUBLIC WORKS DEPARTMENT" AND "UTILITIES DEPARTMENT' WITH THE TERM "DEPARTMENT OF PUBLIC SERVICES"; CHANGING THE REFERENCES TO THE DIRECTOR OF PUBLIC WORKS, UTILITIES OR BOTH TO THE "DIRECTOR OF PUBLIC SERVICES"; REPLACING THE TERM "GROWTH MANAGEMENT DEPARTMENT' WITH THE TERM "DEPARTMENT OF COMMUNITY DEVELOPMENT"; CHANGING THE REFERENCE TO THE "GROWTH MANAGEMENT DIRECTOR" TO THE "DIRECTOR OF COMMUNITY DEVELOPMENT"; TRANSFERRING THE INFORMATION SERVICES DIVISION FROM THE FINANCE DEPARTMENT TO THE OFFICE OF THE CITY MANAGER; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERANCE; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA: Section 1. That the City Charter and the City Code of Ordinances are each amended by replacing the terms "Public Works Department", "Utilities Department" or both with the term "Department of Public Services" wherever such terms appear within the Charter and the Code of Ordinances. Additionally, all references in the Charter and Code to the "Public Works Director", the "Utilities Director" or both are changed to refer to the "Director of Public Services". Section 2. That the City Charter and the City Code of Ordinances are each amended by replacing the term "Growth Management Department" with the term "Department of Community Development" wherever such term appears within the Charter and the Code of Ordinances. Additionally, all references in the Charter and the Code to the "Growth Management Director" are changed to refer to the "Director of Community Development". Section 3. That the Information Services Division is transferred from the Finance Department to the office of the City Manager and all applicable provisions of the City Charter and Code of Ordinances shall be and are amended to reflect such transfer. That all ordinances or parts of ordinances and all resolutions or parts of resolutions in conflict with this ordinance are repealed to the extent of such conflict. Section 5. That if any section, clause, sentence or phrase of this ordinance is for any reason held invalid or unconstitutional by a court of competent jurisdiction, the holding shall not affect the validity of the remaining portions of this ordinance. Section 6. That this ordinance shall be in force and take effect immediately upon its passage and adoption. PASSED AND ADOPTED on first reading on July 8, 2003.
