ORDINANCE NO. 2003- 032 AN ORDINANCE OF THE CITY OF DANIA, FLORIDA, APPROVING "PHILLIPS INDUSTRIAL PARK" PLAT, SUCH PROPERTY BEING GENERALLY LOCATED AT1300 SE 32ND STREET, IN THE CITY OF DANIA BEACH AND LEGALLY DESCRIBED IN EXHIBIT "A", A COPY OF WHICH IS ATTACHED TO THIS ORDINANCE; ACCEPTING THE DEDICATION FOR PUBLIC USE OF ALL STREETS, HIGHWAYS AND ALLEYS AS SHOWN ON SUCH PLAT OF "PHILLIPS INDUSTRIAL PARK" PLAT; PROVIDING FOR SEVERABILITY; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA: Section 1. That the plat of "Phillips Industrial Park" Plat (PL-51-03), an Ordinance of the City Of Dania Beach, Florida, approving the "Phillips Industrial Park" Plat, such property being generally located at 1300 SE 32"d Street, in the City Of Dania Beach and legally described in exhibit "A", a copy of which is attached to this ordinance; is hereby accepted and approved subject to Staff and the Planning Zoning Board conditions as follows: ® Prior to city signature on final plat, applicant shall obtain approval of the Public Services Department, the Fire Marshal and FDOT for vehicle access. Applicant shall record Conservation Easement for Parcel "B" prior to approval of any building permits. . The City of Dania Beach consents and agrees that such plat may be recorded in the Public Records of Broward County, Florida, upon further approval of all agencies of Broward County, Florida, having jurisdiction in the matter. Section 2. That the dedication for public use of all streets, highways and alleys, as shown on the plat of "Phillips Industrial Park" Plat, is accepted by the City of Dania Beach, Florida. Section 3. That all ordinances or parts of ordinances in conflict with the provisions of this ordinance are hereby repealed. Section 4. That this ordinance shall take effect immediately at its time of passage. SUBJECT: PL-51-03: Request by Jason Howe of the Stiles Corporation Sterling, on behalf of Conoco Phillips Company, for a preliminary plat for the property located at 1300 SE 32"d Street in Port Everglades west of SE 14th Avenue and north of Eller Drive. (Second Reading). The subject property is 28 acres located within the Port Everglades -Development District (PEDD) zoning district. As a prerequisite to developing the property, the developer is required to file what is known as a "perimeter plat" (similar to a boundary survey) of the property. As per the Zoning Code, this property, due to its • PEDD zoning, is exempt from the site plan review process The west portion of the plat will remain as preserve area, while the east portion will be developed for over 300,000 square feet of industrial space. Principal access is proposed from Eller Drive with secondary access via SE 14th Avenue. Staff has reviewed the revised plat and the applicant has addressed all Planning and Zoning Advisory Board conditions except as indicated below.
