HomeMy WebLinkAboutO-2003-034 Amending Ordinances to create department of Park and recreation ORDINANCE NO. 2003-034 AN ORDINANCE OF THE CITY OF DANIA BEACH, FLORIDA, PERTAINING TO CERTAIN MUNICIPAL DEPARTMENTS; AMENDING THE CITY CODE OF ORDINANCES TO FORMALLY CREATE THE DEPARTMENT OF PARKS AND RECREATION; REPLACING THE TERM "DEPARTMENT OF ADMINISTRATIVE SERVICES" WITH THE TERM "DEPARTMENT OF HUMAN RESOURCES AND RISK MANAGEMENT'; CHANGING THE REFERENCE FROM THE "ADMINISTRATIVE SERVICES DIRECTOR" TO THE "DIRECTOR OF HUMAN RESOURCES AND RISK MANAGEMENT'; UPDATING THE DUTIES OF THE FINANCE DEPARTMENT; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERANCE; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA: Section 1. That Article III, to be entitled "Department of Parks and Recreation", consisting of sections 6-34 to 6-36, is created as a part of Chapter 6 of the City Code of < Ordinances, which Chapter is entitled "Beach, Parks and Recreation", to read as follows: Article III. DEPARTMENT OF PARKS AND RECREATION Section 6-34. Creation of department. The Department of Parks and Recreation is established to address the highly diversified recreational, cultural and environmental interests of children, youth, adults and senior citizens residing in or visiting the City of Dania Beach. The department is comprised of an administrative division and several operating divisions. Section 6-35. Appointment of director. There shall be a Director of Parks and Recreation, who shall be appointed by and who shall work under the direction and supervision of the City Manager. The Director of Parks and Recreation shall work at the pleasure of the City Manager at a salary established by the City Manager. The position of Director shall be deemed to be a department head of the city having both executive and administrative duties. Section 6-36. Duties. The Director of Parks and Recreation shall be responsible for the administration of all parks and recreation services, programs, facilities and projects. The Director of Parks and Recreation shall oversee daily operations of divisions within the Department, as well as be responsible for the effective and efficient coordination of all programs, improvement projects and contracts. Section 2. That Article VII, "Administrative Services Department", of Chapter 2 of the City Code of Ordinances, which Chapter is entitled "Administration", is amended to read as follows: Article VII. ADMINISTRATIVE SERVICES HUMAN RESOURCES AND RISK MANAGEMENT DEPARTMENT Sec. 2-123. Creation of department. The department of administrative services human resources and risk management is established as an administrative branch of the City of Dania Beach and shall be comprised of the following divisions: risk management and human resources management. Sec. 2-124. Appointment of director. There shall be ^„ ;stFatuye co„i a--dDirector, who shall be appointed by and who shall work under the direction and supervision of the city manager. The admi„ostrativo — vi— dDirector of Human Resources and Risk Management shall be responsible for overseeing human resource issues functions, including but not limited to the following areas: , empleYebeof� ayF0l1 „eRsien and Fetirerner# payroll maintenance functions, compensation and benefits performance management, training and development, labor negotiations, employee benefits, civil service recruiting, employee relations and any other areas as assigned by the city manager. The Director of Human Resources and Risk Management shall also be responsible for overseeing risk management functions including but not limited to Workers' Compensation, property, casualty and liability insurance safety, and any other areas as assigned by the city manager. Section 3. That Section 2-9 of the City Code of Ordinances, which section is entitled "Department of finance created; duties", is amended to read as follows: (a) Created. The position of finance director is created and such person shall be deemed to be a department head of the city having both executive and • administrative duties. The finance director shall be appointed by the city manager at a salary established by the city manager and shall be subject to the supervision and direction of the city manager and shall perform all duties of a budgetary or financial nature which are delegated to him or her by the city, manager. The finance director may be terminated by the city manager. (c) Duties. The finance director shall perform the following duties: (1) Be custodian of all moneys of the municipality and keep and preserve the same in the city depositories designated by the city commission; in addition, it shall be his or her duty to deposit in such depositories, as savings accounts or otherwise, any and all moneys belonging to the city, and collected and held as sinking funds, such investments to be made in the kind of securities authorized by law and as determiner! by ,including Florida Statutes, Section 218.41545). (2) Receive and, to the best of one's ability, to collect all moneys belonging to the city, including taxes, water collections, special assessments, license moneys, fines and income for all and from all other sources, and keep accurate records of them and make proper reports. (4-99) Furnish the city manager such estimates of the expenses of the city government as may be necessary to form the basis of the annual budget and to determine the revenue necessary to be raised each year. That all ordinances or parts of ordinances and all resolutions or parts of resolutions in conflict with this ordinance are repealed to the extent of such conflict. • Section 4. That if any section, clause, sentence or phrase of this ordinance is for any reason held invalid or unconstitutional by a court of competent jurisdiction, the holding shall not affect the validity of the remaining portions of this ordinance. After reviewing the materials submitted by Mike, I see no reason to make any further amendments to provisions applicable to his Department (since, as a result of the ordinance adopted on second reading at the August 26, 2003 City Commission meeting, the Department and Director name changes were made, i.e. from "Public Works Department", "Utility Department" or both to "Public Services Department"). The "engineering" function provisions can remain "as is", since in effect, Mike is serving as the "City Engineer".
