A RESOLUTION OF THE CITY OF DANIA BEACH,APPROVING THE VARIANCE
REQUEST SUBMITTED BY MARVIN MANDEL OF MFA INVESTMENTS, LLC
FOR PROPERTY LOCATED AT 3901 & 3903 SOUTH RAVENSWOOD ROAD,
DANIA BEACH, FROM CHAPTER 28, ARTICLE 28. SECTION 28.120 (213);
PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE
DATE.
WHEREAS, Chapter 28, Article 28, Section 28.120(2B), of the Dania Beach Code of
Ordinances, sets the requirements for signage in the City of Dania Beach; and
WHEREAS, Marvin Mandel, MFA Investments, LLC, has applied for a variance(VA-65-02)
to increase the signage areas and permit a side street building signs for property located at 3901 &
3903 South Ravenswood Road, Dania Beach; and
WHEREAS, the Planning &Zoning Board on December 18, 2002, recommended that the
City Commission grant variance request VA-65-02 based upon the criteria set forth in section
10.13 of Article 10, of Chapter 28, Zoning, of the Code of Ordinances of the City of Dania Beach;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF
DANIA BEACH, FLORIDA:
Section 1. That that certain application VA-65-02, for a variance as described above (from
requirements in Chapter 28, Article 28. Section 28.120(2B), a copy of which is attached as Exhibit
"A" is approved, with the understanding that wall signage will be broken into three separate signs.
Section 2 . That all resolutions or parts of resolutions in conflict with this resolution are
repealed to the extent of such conflict.
Section 3. That this resolution shall be in force and take effect immediately upon its passage
and adoption.

VARIANCE MUST STAND ON ITS OWN MERITS WITHOUT REGARD TO ANY OTHER PROPERTY.
The following questions pertain to the criteria upon which the City Commission and Planning and Zoning
Board will consider this application.
1) Describe how special conditions and circumstances exist which are peculiar to the land, structure
or building involved and which are not applicable to other lands, structures or buildings in the
same zoning district.
This property is.located adjacent to,and faces 1-95 on the east. Allowing a larger sign will create
visibility of the bulding signage from the principal roadway frontage. Code compliant signaqe will not
effectively be visible from 1-95. There are no other industrial buildings adjacent to the site which are similarly
similarly affected by the visibility from 1-95.

2) Provide evidence that the special conditions and circumstances do not result from the actions of
the applicant.
The property and frontage visibilty are not related to any action by the applicant, but rather are
the results of the site location.
3) Describe how granting the requested variance(s) will not confer any special privilege on the
applicant that is denied by the zoning code to other lands, buildings or structures in this same
zoning district.
The variance will allow the applicant to identify the property usage and tennant locations and allow
for visibilty of the building signage from the 1-95 frontage which is a reasonable expection for
the p_ro�erty and not a special privilege.
4) Provide evidence that the literal interpretation of the provisions of the zoning code would deprive
the applicant of rights commonly enjoyed by other properties in the same zoning district and
would work unnecessary and undue hardship on the applicant.
The literal interpretation of the Code would not allow the tenant signs to be seen from 1-95 which the
builidina faces. The tennants will not be able to provide adequate visibilty and identification for the
principal building frontage.
5) Describe how the requested variance is the minimum variance that will make possible the
reasonable use of the land, building or structure.
Sight line analysis and review of the distance versus letter heights indicate the proposed signage
will be optimum for the building. This request is based upon the minimun effective increase in sign area.
6) Explain how the grant of the variance(s)will be.in harmony with the general intent and purpose of
the zoning code, and that such variance(s) will not be injurious to the area involved or otherwise
detrimental to the public welfare.
Grantina of the requested variance will result in an increase, over the Code allowance, of area for
signage but will allow for the signage to be reasonably visible to adjacent roadway.
There is no identified detrimental nor injurous impact which will result from the granting of the variance.
7) Please add any other comments which may assist the City Commission and the Planning and
Zoning Board in reviewing this request.
The location of this property Dresents a unique situation. The adjacent properties will likely be limited
in development. On the east is Ravenswood Road and the 1-95 right-of-way. On the north is the
airport clear zone. On the south is BCAD property. On the west will likely be an extension of the parking lot.

DATE: January 14, 2003
Applicant wishes to construct two wall signs facing Interstate-95 (50 sq. ft. and
125 sq. ft respectively) and one wall sign facing SW 39th Street (50 sq. ft.), for
total wall signage of 250 sq. ft.
The sign code allows to 1/2 square foot of wall signage for each lineal foot of
• building frontage. This is the total wall signage allowed, regardless of the
number or location of signs. Applicant's building has 134 lineal feet of frontage
on Ravenswood Road, limiting total wall signage to 67 square feet.
Staff has determined that some of the elements of hardship apply to this
property, including the following:
"That granting the variance request will not confer any special
privilege that is denied to other lands and buildings in this same
zoning district,"
"That the granting of the variance will be in harmony with the general
intent and purpose of this zoning code, and that such variance will not
be injurious to the area or detrimental to the public welfare."
Nearby signs (storage warehouse wall sign, electronic billboard sign, and
Ravenswood Tire wall signs) are larger or more obtrusive than the applicant's
signs. Also, the size and scale of the proposed wall signage is similar or smaller
than wall signage at Bass Pro (Outdoor World).

Dear Mr. Leeds:
On behalf of the property owner, MFA Investments, LLC and the applicant, Mr. Marvin Mandel,
• we are herewith submitting a Sign Variance application package to increase the signage areas
and permit a side street building sign for the above referenced site located at the southwest
corner of Ravenswood Road and SW 39th Street.
The subject property is unique in several respects. The principal frontage for the building is a
combination of an access road, a railroad and the Interstate 95 corridor between the State Road
84 and the Griffin Road interchanges. The building's intended use is primarily wholesale
business/industrial. Ravenswood Road functions as an access road and I-95 frontage road for the
area's industrial, office and retail properties and for access to the airport employee and remote
parking lots. The subject property will not be dependent upon a drive-by customer base from
Ravenswood Road, but rather will require a distinct location identity and visibility as a
destination for it's customers, which will primarily benefit from the I-95 visibility. The frontage
area includes the 80 foot wide Ravenswood Road right-of-way, then the CSX railroad
right-of-way, then the I-95 interchange ramps and mainline roadway. The intent of the sign
variance is to provide a minimum visibility from the I-95 corridor for the building signage.
MFA Investments, LLC is not requesting the variance for specific signs but is requesting
allowance to provide all current and future tenants the opportunity for I-95 visibility by the
proposed optimal visibility sign area variance.
