A RESOLUTION OF THE CITY DANIA BEACH,
FLORIDA, DETERMINING THAT REAL PROPERTY
LEGALLY DESCRIBED AS LOT 12 IN BLOCK 5 OF
TOWN OF DANIA, A SUBDIVISION ACCORDING TO
THE PLAT THEREOF, AS RECORDED IN THE PUBLIC
RECORDS OF DADE COUNTY, FLORIDA; SAID LANDS
SITUATE, LYING AND BEING IN BROWARD COUNTY,
FLORIDA, IS SURPLUS PROPERTY; AUTHORIZING
THE CITY MANAGER TO ENTER INTO AN EXCLUSIVE
LISTING AGREEMENT WITH A REGISTERED REAL
ESTATE BROKER, SELECTED BY LOTTERY FROM
AMONG THE QUALIFIED BROKERS; FINDING THAT AN
APPRAISAL OF THE REAL PROPERTY HAS
DETERMINED THE VALUE OF THE PROPERTY TO BE
EIGHT THOUSAND ($8 ,000) DOLLARS; AUTHORIZING
THE CITY MANAGER TO ENTER INTO A CONTRACT
FOR SALE OF THE REAL PROPERTY WITH THE SALE
CONTINGENT UPON APPROVAL BY MAJORITY VOTE OF
THE CITY COMMISSION; PROVIDING THAT ALL
RESOLUTIONS OR PARTS OF RESOLUTIONS IN
CONFLICT HEREWITH BE REPEALED TO THE EXTENT
OF SUCH CONFLICT; AND PROVIDING FOR AN
EFFECTIVE DATE.
WHEREAS, Part VII, Article 3, Section 5 of the Charter of the
City of Dania Beach authorizes the City Commission to exchange,
sell or convey real property acquired by the City of Dania Beach
from enforcement or foreclosure of city liens and the transfer of
lands available for taxes from Broward County and determined by the
City Commission to be surplus real property;
WHEREAS, the City of Dania Beach foreclosed on multiple
municipal liens recorded against the property legally described as
Lot 12 in Block 5 of Town of Dania, a Subdivision, said lands
situate, lying and being in Broward County, Florida;

WHEREAS, the real property legally described above was
acquired by the City of Dania Beach by Certificate of Title
recorded the 21st day of August, 2002, in Official Records Book
33668 , Page 1280, of the Public Records of Broward County, Florida;
WHEREAS, the Dania Beach City Commission finds that it is cost
effective, in the best interests of the City of Dania Beach, and
promotes the welfare of the residents of the City to declare the
aforesaid property as surplus real property and to efficiently
dispose of the aforesaid real property by marketing the property
with a registered real estate broker.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF DANIA BEACH, FLORIDA;
Section 1 . That the real property described herein is
determined to be surplus property acquired as a transfer of lands
available for taxes from Broward County.
Section 2 . That the City Manager is authorized to enter into
an exclusive listing agreement for a period of six (6) months, with
a registered real estate broker, licensed to do business in the
State of Florida, and with its main office located in the City of
Dania Beach and possessing an occupational license to sell real
estate issued by the City of Dania Beach.
Section 3 . That the real estate broker shall be selected by
lottery from among the qualified brokers and shall be paid a
reasonable and customary real estate commission by the seller .

Section 4 . That an appraisal of the real property by a state
certified real estate appraiser with M.A. I . designation has
determined the value of the property to be Eight Thousand ($8 , 000)
Dollars as of November 19, 2002 .
Section 5 . That the City Manager is authorized to enter into
a contract for sale of the real property and to close the contract
for sale, so long as the purchase price is not less than ninety
( 900) percent of the appraised value .
Section 6 . That the contract for sale of the real property
executed by the City Manager shall be contingent upon approval by
majority vote of the City Commission at an advertised public
hearing held at a regularly scheduled commission meeting .
• Section 7 . That all resolutions or parts of resolutions in
conflict herewith be and the same are hereby repealed to the extent
of such conflict .
Section 8 . That this Resolution shall be in force and take
effect immediately upon its passage and adoption.

Dear Ms , Johnson:
The City Commission identified three properties at its
workshop meeting on October 1.0 , 2002 , for possible designation as
surplus real properties . The city obtained title to the three
nicipa7. liens or transfer of lands
parcels through foreclosure of mt
available for taxes from Broward County.
The first parcel is a vacant lot located on the north side of
S .W . 101", street between Phippen Road and North 2211 Avenue. The
as a
city obtained title to this property from Broward County appraisal
transfer of lands available for delinquent taxes . The
report dated November 19, 2002 , appraises this property at $9 , 000 .
The commission expressed a desiie that the transfer of this Parcel
include a restrictive covenant permitting only a single family
residence be constructed on the parcel .
The second property is a vacant lot located at 225 N.W .
Avenue in Dania Beach. This ',?roperty was acquired by the city
through foreclosure of an unsafe structures board lien. The
property is appraised at $8 , 000 in the appraisal report of November
19 , 2002 . The commission i.ndi_: ated at the workshop meeting that
this property should be sold wit.h a restrictive covenant permitting
only a single family residence on the parcel .

The third property is an approximate one quarter acre IROM
zoned vacant parcel located just west of Ravenswood Road and south
of the State toad 84 access road. Broward county conveyed this
property to the city as lands available for delinquent taxes . The
appraised value of this property as of November 19, 2002 is
$40 , 000 , Copies of the three appraisal reports are enclosed.
Please schedule these three properties for hearing before the
City Commission to designate the properties as surplus zeal
property in accordance with Ordinance 2002-023 . X will forward to
you the resolutions determinir,q the properties as surplus,
authorizing the city manager to enter into real estate listing
agreements , and authorizing the city manager to contract for sale
of the properties .
I have also enclosed the invoice of appraiser Bruce ownby in
the amount of $775 , for appraisal of the three -vacant lots . Please
submit this invoice to the finance department for payment directly
to Mr . ownby.
