Home My WebLink AboutR-2003-023 Interlocal Agreement with Griffin Lakes Community Development District CDD RESOLUTION NO. 2003- 023 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, AUTHORIZING THE PROPER CITY OFFICIALS TO EXECUTE AN INTERLOCAL AGREEMENT WITH THE GRIFFIN LAKES COMMUNITY DEVELOPMENT DISTRICT, TO ACKNOWLEDGE RECEIPT BY THE CITY OF PAYMENT BY THE DISTRICT OF PARKS AND RECREATION IMPACT FEES FOR THE GRIFFIN LAKES DEVELOPMENT; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA: Section 1. That the proper City Officials of the City of Dania Beach, Florida are authorized to execute an Interlocal Agreement on behalf of the City with the Griffin Lakes Community Development District, such Agreement to acknowledge receipt by the City from the District of a payment of $384,000.00 in connection with parks and recreation impact fees associated with the Griffin Lakes development in the City. A copy of the Agreement is attached as Exhibit "A". Section 2. That the City Manager and City Attorney are authorized to make minor revisions to such Agreement as are deemed necessary, proper and in the best interest of the City. Section 3. That all resolutions or parts of resolutions in conflict with this resolution shall be repealed to the extent of such conflict. 1 RESOLUTION NO. 2003-023 Section 4. AN BRO CITY ATTORNEY 2 RESOLUTION NO. 2003-023 INTERLOCAL AGREEMENT THIS INTERLOCAL AGREEMENT ("Agreement") is entered into this day of re-bry 2003 by and between the CITY OF DANIA BEACH,FLORIDA, a municipal corporation of the State of Florida ("City") and GRIFFIN LAKES COMMUNITY DEVELOPMENT DISTRICT, a local unit of special purpose government (the "District"). WITNESSTH: WHEREAS, the City has established the District by ordinance pursuant to Chapter 190, Florida Statutes; and WHEREAS,the City has required,as a condition of the development of the land within the boundaries of the District,that$384,000(the"District Funding Obligation")be paid to the City to fund the acquisition of land and/or improvements for parks and recreation within the City; and WHEREAS, the park and recreation improvements that are the subject of this Agreement will benefit the lands within the District and will provide enjoyment to the residents of the District; and WHEREAS,the District has issued tax-exempt special assessment bonds(the"Bonds") to finance the District Funding Obligation and other funding obligations and infrastructure improvements benefiting lands in the District; and WHEREAS, the parties hereto now desire to enter into this Interlocal Agreement to evidence the District's agreement to satisfy the District Funding Obligation, subject to the terms and conditions hereof; NOW,THEREFORE,in consideration of the mutual promises and other considerations contained herein, the parties hereto agree as follows: 1. The District hereby agrees to provide for fulfillment of the District's Funding Obligation from proceeds of the Bonds by payment to the City of$384,000 and the City hereby acknowledges receipt from the District of said sum in satisfaction of the District Funding Obligation. The City agrees that payment of the District Funding Obligation by the District shall fully satisfy the City's development conditions with respect to parks and recreation requirements applicable to residential development of lands within the boundaries of the ® District. These Agreements now require final execution by the Griffin Lakes Community Development District.
