A RESOLUTION OF THE CITY OF DANIA BEACH,APPROVING THE VARIANCE
REQUEST SUBMITTED BY WILLIAM E. ELMORE,JR. FOR VACANT PROPERTY
LOCATED ON THE WEST SIDE OF RAVENSWOOD ROAD NORTH OF
INTERSTATE — 595 (AKA 2967 RAVENSWOOD RD.), DANIA BEACH, FROM
CHAPTER 28, ZONING ARTICLE 6.21 SCHEDULE OF OFF-STREET PARKING
REQUIREMENTS; CHAPTER 28, ZONING, ARTICLE 27.60 SETBACK
REQUIREMENTS IROM DISTRICT; AND CHAPTER 26, VEGETATION,
LANDSCAPE — SECTION 26.51; PROVIDING FOR CONFLICTS; FURTHER,
PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, Chapter 28,Article 6.21 of the Dania Beach Code of Ordinances, sets the Off-
Street Parking requirements for the City of Dania Beach; and
WHEREAS, Chapter 28, Article 27.60 of the Dania Beach Code of Ordinances, sets the
setback requirements in the IROM zoning district for the City of Dania Beach; and
WHEREAS, Chapter 26,Vegetation, Section 26.51 of the Dania Beach Code of Ordinances
sets the landscaping requirements for the City of Dania Beach; and
WHEREAS, William E. Elmore, Jr., has applied for a variance (VA-62-02) requesting the
following:
1. Variance to allow 11 parking spaces for an office/warehouse building, (12 spaces
required — Chapter 28, Zoning Article 6.21 Schedule of Off-Street Parking
Requirements).
2. Variance to allow zero setback along the south property line(Minimum 10 foot setback
required — Chapter 28, Zoning, IROM - Article 27.60 IROM and Chapter 26,
Vegetation, Landscape -Section 26.51).
for vacant property located on the west side of Ravenswood Road north of Interstate 595 (2967
Ravenswood Road), in the City of Dania Beach; and
WHEREAS, the Planning &Zoning Board on November 20, 2002, recommended that the
City Commission grant variance request VA-62-02 based upon the criteria set forth in section 10.13
of Article 10, of Chapter 28, Zoning, of the Code of Ordinances of the City of Dania Beach;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF
DANIA BEACH, FLORIDA:

Section 1. That that certain application VA-62-02,for a variance as described above, a copy
of which is attached as Exhibit "A" is approved subject to the following conditions:
a) The addition of a window treatment to the front of the building.
b) Compliance with the following landscape comments:
1) Gumbo-limbo trees in rear yard to be located adjacent to the building (Gumbo
trees cannot be located in retention area).
2) Provide a 24" high, 24" spread, and 24" on center continuous (branch touching
branch)coco plum hedge along the entire perimeter of the site. Indicate the different
cross-hatching on each proposed shrub masses or hedges in order to distinguish
each material.
3) Add "minimum application of water to impervious areas" on the irrigation notes
and City of Dania Beach to the substitution note.
4) Change the proposed three deciduous Yellow Tabebua trees along the north
perimeter in front of Bay 1 to Green buttonwoods. Additionally, the proposed two
Sabal palms on each side of the Yellow Tabebuia should be in groups of three and
staggered (add one palm to each group of two).
5) The Sabal palm in the terminal landscape island next to the building should be a
group of three staggered palms. Lastly, the proposed Jacaranda tree should be a
Live Oak to keep the consistency in the design.
6) Indicate all sod areas on the landscape plans and add a one-year guarantee to
the notes on all landscape.
7) Change the proposed royal palms from Delonix regia to Toystonia elata on the
plant list. Additionally, indicate the FPL easement on the landscape plans, as the
palms may not be allowed in the present location because of the overhead
transmission lines. Lastly, add Florida fancy, heavy, and no pencil topping to the
specification of the Royal palms.

• c) Add "sumbrilla" material to awnings.
Section 2 . That all resolutions or parts of resolutions in conflict with this resolution are
repealed to the extent of such conflict.
Section 3. That this resolution shall be in force and take effect immediately upon its passage
and adoption.

The following questions pertain to the criteria upon which the City Commission and Planning and Zoning
Board will consider this application.
1) Describe how special conditions and circumstances exist which are peculiar to the land, structure or
building involved and which are not applicable to other lands, structures or buildings in the same
zoning district.
This lot has a narrow width greatly limiting develorment & use as the
proposed buildings reciuires -- 4— lnr�� Antranresc and

the property line imposing limitation on the as of obtaining an
architecturally pleasing development.
2) Provide evidence that the special conditions and circumstances do not result from the actions of the
applicant.
Lot line construction and lot width are hardship that have
to be overcome with the proposed project being submitted.
3) Describe how granting the requested variance(s) will not confer any special privilege on the applicant
that is denied by the zoning code to other lands, buildings or structures in this same zoning district.
Variance applied for in this project have now been Lap2lied to the
adjacent property to the South and as such are in tune with area
conditions.
4) Provide evidence that the literal interpretation of the provisions of the zoning code would deprive the
applicant of rights commonly enjoyed by other properties in the same zoning district and would work
unnecessary and undue hardship on the applicant.
The stated setbacks and buffers would reduce lot width to an
unusable building width and driveway.
5) Describe how the requested variance is the minimum variance that will make possible the reasonable
use of the land, building or structure.

foot office/warehouse building.
®ATE: February 12, 2003
The applicant proposes a new 7,760 office/warehouse building on the west side
of Ravenswood Road north of I-595. The properties to the north and to the
east (across Ravenswood Road) are both vacant.
The property to the south is developed as a warehouse built in the 1980's
under County M-2 zoning. The existing warehouse is built right up to the south
lot line of the subject property with no setback.
The subject parcel is only 70 feet wide and proposes only 28 feet of building
frontage facing Ravenswood. While the building elevations are generally
acceptable, staff recommends the building frontage contain some glass
treatment consistent with IROM requirements.
PLANNING AND ZONING BOARD RECOMMENDATIONS
• 1. Variance to provide 11 parking spaces (12 spaces required).
The parcel is only 70 feet wide, making 100% parking compliance
difficult. Also, the one space parking variance is minimal.
Approval of the parking variance, subject to the following:
a) The addition of a window treatment to the front of the building.
b) Compliance with the attached landscape comments.
2. Variance to allow zero setback along the south property line
(Minimum 10 foot setback required).
Approval, subject to compliance with building, fire, and life safety codes.
The parcel is 70 feet wide and abuts zero-lot line industrial to the south.
Providing a 10 foot side yard setback between buildings in this location
would serve no useful purpose and make the subject parcel difficult to
develop.
3. Site plan.
Approval, subject to the following:
a) The addition of a window treatment to the front of the building.
b) Compliance with the attached landscape comments.

NOTICE IS HEREBY GIVEN that on February 12, 2003 at 7:00 p.m., or as soon thereafter as possible,
in the Dania Beach City Commission Room,Administrative Center, 100 West Dania Beach Blvd., Dania
Beach, Florida 33004, the City Commissioner of the City of Dania Beach Florida, will hold a public
hearing on the following:
VA-62-02 —Variance Request by William E. Elmore, Jr. owner of property located at 2967
Ravenswood Road. Mr. Elmore is requesting variances from the following:
1. Variance to allow 11 parking spaces for an office/warehouse building, (12 spaces
required —Chapter 28, Zoning Article 6.21 Schedule of Off-Street Parking
Requirements).
2. Variance to allow zero setback along the south property line (Minimum 10 foot

Florida.
